(5) 'making available on the market' means the holding for the purpose of sale within the Union, including offering for sale or for any other form of transfer, and the sale, distribution, import into, and export out of, the Union and other forms of transfer, the Union and other forms of transfer in the EU to third parties (other than providers of services for processing or packaging who do not acquire title to plant reproductive material thus supplied) aimed at commercial exploitation of plant reproductive material whether free of charge or not;

Article 15 a (new)
Article 15 a Requirements for niche varieties 1. Plant reproductive material may be produced and made available on the market in small packages and in limited quantities as niche market varieties registered in a national variety register referred to in Article 51, on the basis of an officially recognised description, with due observance of the conditions referred to in paragraph 3 of this article. If the package size or maximum quantity is exceeded, the variety will have to be registered in accordance with Article 56 and will for the purpose of this Regulation no longer be regarded as niche market variety. 2. The professional operators who produce niche market varieties shall keep records of the quantities of the material produced and made available on the market, per genera, species or type of material. On request, they shall make those records available to the competent authorities. 3. The Commission shall adopt delegated acts in accordance with Article 140, setting out, with regard to the production and making available on the market of niche market varieties the following: (a) the maximum size of packages, maximum quantity, containers or bundles per particular genera or species concerned; (b) requirements concerning traceability, lots and labelling of the niche market varieties concerned; (c) modalities of making available on the market.

Article 15 b (new)
Article 15 b Heterogeneous material 1. Plant reproductive material may be produced and made available on the market as heterogeneous material, registered in a national variety register referred to in Article 51, on the basis of a description for heterogeneous material, with due observance of the conditions referred to in paragraph 2 of this article. 2. The Commission shall adopt delegated acts, in accordance with Article 140, setting out the conditions under which heterogeneous material of particular generaor species may be made available on the market. 3. Those delegated acts shall set out the following: (a) the genera or species to which the provisions of this Article may apply; (b) requirements concerning traceability and the labelling and packaging of the heterogeneous material concerned; (c) modalities of making available on the market in a manner ensuring that such modalities do not constitute a barrier to the registration and marketing of the heterogeneous material concerned; (d) Requirements guaranteeing that no official examination was performed on the distinctness, uniformity and stability as set out in articles 60, 61 and 62 on the heterogeneous material concerned and that this material did not meet one or more of the requirements.
