Lа. whereas basic freedoms, human rights and equal opportunities should be guaranteed for all the citizens of countries seeking to join the European Union; whereas, however, the protection of national minorities and regional and minority languages in some of these countries is a major issue, which cannot be resolved simply by combating xenophobia and discrimination but which requires the adoption of specific legal, linguistic, cultural, social and other arrangements and ways of treating people;

Reiterates its support for dedicated human rights dialogues as a tool of EU human rights policy; recognises the value of engagement in human rights-specific dialogue also with countries with serious human rights problems; underlines, however, the need for the EU to draw clear political conclusions when the human rights dialogue does not lead to positive outcomes, and in such cases to place more emphasis on public diplomacy with a view to ensuring that the public credibility of the EU’s human rights policy is not endangered; warns, furthermore, against diverting human rights discussions away from high-level political dialogues; in the case of gross violations of human rights calls for the issue to be placed at the core of the political dialogue at all levels;

Welcomes the annulment in October 2013 of the Moldovan law prohibiting the ‘propagation of any other relations than those related to marriage or family’, and calls on Lithuania and Russia to follow the Moldovan example; regrets the outcome of the Croatian referendum of December 2013, which endorsed a constitutional ban on equal marriage; stresses that such referendums contribute to a climate of homophobia and discrimination; considers that LGBTI persons’ fundamental rights are more likely to be safeguarded if they have access to legal institutions such as cohabitation, registered partnership or marriagebut points out that issues around the rights of LGBTI persons are internal matters about which each country should be entitled to choose; welcomes the manner in which the constitutional ban on equal marriage was adopted in Croatia, as popular consultation via referendum is the ultimate form of democracy, demonstrating the people’s real views on particular issues;
