In Article 5, paragraph 1b (new) is added: 1b. Member States shall take the necessary measures to ensure at least the following: (a) As of 1 January 2023, any combustion of fuels in installations listed in Annex I shall not result in greenhouse gas emissions exceeding 250gCO2e/kWh. This threshold shall be set at 100gCO2eq/kWh as of 1 January 2035, and at 0gCO2e/kWh at the latest by 2040; (b) As from 1 January 2040, the resulting greenhouse gas emissions of any fossil input used, including as feedstock, shall not exceed 40kg CO2eq/GJ output. During the period of 1 January 2030 to 1 January 2050, the resulting greenhouse gas emissions of any fuel used shall be a linear decrease, where the target of 1 January 2030 is 78kg CO2eq/GJ output and the 1 January 2050 target shall be 0kg CO2eq/GJ output; (c) The production of fuels of fossil origin for activities listed in points 1.2, 1.3 or 1.4 of Annex I cannot be considered BAT under any circumstances as from January 2040. The Commission shall by [OP please insert date = the first day of the month following 24 months after the date of entry into force of this Directive] adopt a delegated act in accordance with Article 76 to supplement this Directive by establishing further measures and reference points to be used. Those rules may exclude minor source, propose differentiated measures for activities where there is an overriding interest of a product / service and no technical feasibility to achieve those levels. The rules shall detail the methods and verification schemes applicable.

The revised draft shall be approved and adopted by the body referred to in paragraph 4. In Article 13, paragraph 3a (new) is inserted: (3a) The Commission shall be assisted by the Zero Pollution Ambition scrutiny board ‘ZPA Scrutiny board’ in relation to the following: (a) the validation of the EIPPCB proposal in regard to the background documents elaborated on the key milestones such as for the Kick off Meeting and the Final Meeting; (b) the listing of additional items for discussion and level of consensus and validation of split views; (c) scrutiny check on whether the scope, the ambition level of the BAT- Conclusions provide an added value to the stated objectives of the IED and the EU Green Deal (d) the shortlisting of candidates for BREF authors; (e) consideration of amendments to the final draft BAT conclusions following the opinion of the Forum; (f) scrutiny check of the draft Commission Implementing Decision prior to transmission to Member States for adoption. The ZPA Scrutiny board is composed of an equal share of representative(s): I. Member State (e.g. holding the Presidency); II. non- governmental organisations promoting the protection of human health; III. non- governmental organisations promoting the protection of the environment; IV. representative of workers union; V. representative(s) of industry representing operators; VI. representative(s) of industry representing technique providers; VII. an observer of the European Parliament. The ZPA Scrutiny board shall be chaired by a representative of non-governmental organisations promoting the protection of the environment and/or human health and adopt its rules of procedure by qualified majority. Its hall provide its favourable opinion in regard to the cases referred to under paragraph 4, its members shall be bound by taking decisions as closest aligned to the spirit and objective of this Directive referred to under Article 1, the BAT criteria and indicators mentioned in Annex III and the zero-pollution ambition. The Commission shall be bound by its opinions. In case the opinion relates to cases referred to under paragraph 4(e) or 4(f), the regulatory procedure referred to in Article 75(2) shall be adapted as follows: Where the ZPA Scrutiny board expresses a negative opinion, the proposed change may be adopted only in case of qualified majority with abstention or positive opinion expressed by the public interest representatives. Where the ZPA Scrutiny board expresses a positive opinion, the proposed change shall be adopted in case of a simple majority. The guidance shall take account of the opinion of the forum and shall be adopted in accordance with the regulatory procedure referred to in Article 75(2).
