1a. Stresses that, in designing the "solidarity clause", care should be taken that it is done on the basis of the principles of subsidiarity and proportionality in accordance with Article 5 of the TEU and in full compliance with the respective national legislation, and above all that the provisions of all Member States’ constitutions continue to prevail;

14. Calls for sufficient flexibility ason the Council, the Commission and the High Representative to clear up the uncertainties that exist regardsing the types of attacks and disasters for which the clause may be triggered, to ensure that no significant threats, such as attacks in cyberspace, pandemics, or energy shortages, are overlookimplementation of Article 222 TFEU, especially in terms of its scope and operational scenarios, the competences and conditions governing its activation and the appropriate use of resources for specific emergencies; stresses that in this context there must be no obligation on the country concerned to avail itself of specific assistance, that the country providing assistance must ultimately decide on the means it chooses to fulfil the obligation, and that the clause is not automatically triggered;

34. Stresses that any decision-making process in the Council following a request for assistance under the solidarity clause must not be detrimental to EU reactivity, and that crisis response through the existing mechanisms, such as the Civil Protection Mechanism, must be able to start immediately, irrespective of such political decision; points out to the fact that the use of military assets to support civil protection operations is already possible on operational level without the activation of the solidarity clause, as evidenced by the successful cooperation between the Commission and the EU Military Staff on past operations in Pakistan or Libya;
