\n\t\t\t\t\t\t\t \t\t\tOBJECTIVE: Provide a legal basis for consumer protection activities eligible for Community\nfunding for the period from 01/01/1999 to 31/12/2003.\nSUBSTANCE: The legal framework proposed is based on Article 129a of the Treaty and seeks to\nunderpin and supplement the policy followed by the Member States in this area.\nThe mechanism which will have a budget limited to ECU 114 million over a five year period and\nis not a multi-annual programme of measures, since it is not possible to foresee the problems which\nwill require Community intervention, but rather a general framework of activities seeks to provide\nfunding for measures in the following four sectors: \n(1) Consumer health and safety: risk assessment inspection and control measures will be funded, for\nexample the preparation and drawing up of opinions of scientific committees or the expert\nknowledge required for inspections in the food, veterinary and plant health sectors.\n(2) Protection of the economic interests of consumers with regard to products and services: Funding\nwill be provided to improve cooperation between the market monitoring organizations and\nmechanisms for resolving disputes, particularly of a cross-border nature.\n(3) Education and awareness of consumers: funding will be provided for comparative product testing\nand the promotion of specialized European centres.\n(4) Promotion and representation of consumer interests: funding will be provided to take account\nof consumer views in drawing up Community standards and policies and supporting certain\nrepresentative organizations at European level. \nThe actions will be limited to consumer policy within the Union. In the wake of a recent ruling by the Court of Justice, which questioned the legality of certain categories of expenditure, this framework is intended to provide a legal base for Community spending on consumer protection in accordance with Article 129a of the Maastricht Treaty. \nThe committee report calls for an increase from ECU 114 million to ECU 130 million in the funding proposed for the framework, which covers the five years 1999 to 2003.\nRecommending the increase, Mr Whitehead warned that the budget proposed by the Commission would lead to a severe downgrading of consumer protection. \"The rapporteur is extremely concerned that the budget being proposed will not give the pride of place to consumer protection and consumer health assured by Commission President Santer in the wake of the BSE crisis\".\nIn amending the proposal, the committee wants the framework to help promote the consumer interest internationally and to give more opportunity to consumer protection bodies. On the basis of the Commission's amended proposal, the Council\nadopted a common position providing for a financial framework of ECU 112.5 m, not including\nthe EHLASS programme (the original proposal by the Commission provided for a framework of\nECU 114 m, including ECU 7.5 m for EHLASS). \n\t\t\t\t\t\t\t \t\t\tPURPOSE: to establish a legal base for a general framework for Community activities in favour of consumers for the period 01.01.1999 to 31.12.2003.\nCOMMUNITY MEASURE: European Parliament and Council Decision 283/1999/EC establishing a general framework for Community activities in favour of consumers.\nCONTENT: This Decision establishes, at Community level, a general framework for activities promoting the interests of consumers and providing them with a high level of protection.\nThe financial framework for the implementation of this general framework for the period 1 January 1999 to 31 December 2003 is EUR 112.5 million (excluding the sum of EUR 7.5 million earmarked for funding EHLASS).\nThe framework comprises actions designed to help protect the health, safety and economic interests of consumers and to promote their right to information and education and their right to join forces in order to protect their interests. \nMore specifically, within these 4 categories, the following activities are eligible:\n1) Consumer health and safety as regards products and services, e.g. technical expertise to assess, adopting a preventive approach, risks relating to products, in particular for foodstuffs; actions relating to consumer products and services causing danger to consumers; dissemination of information about dangerous products and services, as well as about potential risks.\n2) Protecting the economic and legal interests of consumers, including access to dispute resolution, as regards products and services, taking into account horizontal aspects, e.g. actions to ensure the respect of consumer rights in the supply of goods and services; actions to improve cooperation between the bodies participating in market surveillance; improving common extra-judicial procedures; development of, and support for, actions aiming at facilitating access to justice; actions to monitor environmental claims on product labels, on packaging and, in general, in advertising and through other types of marketing.\n3)Educating and informing consumers, e.g. raising awareness among consumers for the need for sustainable production and consumption patterns; developing education and training of consumers, particularly in schools; development of and support for European centres providing information and advice to cross-border consumers in the Community.\n4) Promotion and representation of the interests of consumers, e.g. strengthening the representation of the interests of consumers at the Community and international level; supporting consumer organisations in the Member States, in particular when their means are limited; pilot projects promoting sustainable consumption models, in particular those that are environmentally friendly.\nThe activities to support and supplement the policy conducted by the Member States shall consist of:\n- actions taken by the Commission;\n- actions providing financial support for activities of the European consumer organisations, as defined in this Decision;\n- actions providing financial support for specific projects to promote the interests of consumers in the Member States, as defined in this Decision, in particular by consumer organisationsand appropriate independent public bodies.\nThe Decision also lays down criteria regarding the eligibility of organisations and the conditions for granting financial support. Strict selection conditions are laid down in the Decision. These include:\n- a satisfactory level of cost-effectiveness,\n- an added value ensuring a high and uniform level of the representation of the interests of consumers,\n- a lasting multiplier effect at national or European level,\n- the widest possible dissemnation of the results of the activities and projects supported.\nThe Commission is responsible for the management, monitoring, evaluation and supervision of the activities it funds. It will be assisted in this by an Advisory Committee composed of Member State representatives. In 2002/03 a total number of 540 meetings took place, resulting in the adoption of 381 reports and scientific opinions, at a cost of about EUR 1.7 million. The kind of work carried out included on-the-spot checks of national control systems in the food, veterinary and phytosanitary sectors by the Food and Veterinary Office (FVO). Other actions funded under this Directive include, amongst others, validating test methods to detect BSE and the preparatory work for a Community Reference Laboratory on analytical methods for the authorisation of feed additives. Other activities funded under the terms of the Directive include a database of unfair contractual terms, a survey of fees for cross border payments in retail banking across the EU and a survey of mortgage credit suppliers to assess the uptake and effectiveness of the Voluntary Code of Conduct on Pre-contractual Information for Home Loans.","Under the Education and Information heading, the Report notes that the health and consumer policy web site was revised in 2002/03 with visits to the site peaking at 2 774 321 in October 2003. The Consumer Voice Newsletter was sent out to over 10 000 subscribers. Total expenditure for technical support including web site, e-mail service and newsletter added up to around EUR 1 million, with an additional EUR 72 500 spent on print publications. Other forms of expenditure included an evaluation of EU food labelling legislation, the European Young Consumer Competition, the development of on-line interactive education tools, supporting 15 European Consumer Centres Networks and funding workshops for consumer association experts. Grants for operating costs were awarded to the European Association for the Co-ordination of Consumer Representatives in Standardisation (ANEC) and to the European Consumers\u2019 Organisation (BEUC). In terms of financing for specific projects, the Report notes that in 2002/03, a total of 44 specific projects were co-financed, with national consumer organisations and NGO\u2019s being the main beneficiaries. The number of applications, approved projects and the total amount committed has stabilised. Noteworthy is the fact that the average size of projects has decreased though the administrative cost has increased \u2013 this being largely thanks to the need for external evaluators.","To conclude, the Report states that expenditure in 2002/03 was more policy driven that in previous years (1999-2001). The Commission attributes this new direction to the clear objective and more coherent approach of the Consumer Policy Strategy 2002- 2006. Actions to build a knowledge-base for policy making has increased in importance and efforts to improve the efficiency of the European Consumer Centres and Extra-Judicial networks has led to the merging of the two into a single structure. This allows them to focus their activities more on cross-border consumer problems. In addition the specific projects appear to be more effective as a means to support national consumer organisations. \n\t\t\t\t\t\t\t \t\t\tOBJECTIVE: Provide a legal basis for consumer protection activities eligible for Community\nfunding for the period from 01/01/1999 to 31/12/2003.\nSUBSTANCE: The legal framework proposed is based on Article 129a of the Treaty and seeks to\nunderpin and supplement the policy followed by the Member States in this area.\nThe mechanism which will have a budget limited to ECU 114 million over a five year period and\nis not a multi-annual programme of measures, since it is not possible to foresee the problems which\nwill require Community intervention, but rather a general framework of activities seeks to provide\nfunding for measures in the following four sectors: \n(1) Consumer health and safety: risk assessment inspection and control measures will be funded, for\nexample the preparation and drawing up of opinions of scientific committees or the expert\nknowledge required for inspections in the food, veterinary and plant health sectors.\n(2) Protection of the economic interests of consumers with regard to products and services: Funding\nwill be provided to improve cooperation between the market monitoring organizations and\nmechanisms for resolving disputes, particularly of a cross-border nature.\n(3) Education and awareness of consumers: funding will be provided for comparative product testing\nand the promotion of specialized European centres.\n(4) Promotion and representation of consumer interests: funding will be provided to take account\nof consumer views in drawing up Community standards and policies and supporting certain\nrepresentative organizations at European level. \nThe actions will be limited to consumer policy within the Union. \n\t\t\t\t\t\t\t \t\t\tAn increase in budget proposed by the Commission for a new Community framework for consumer activities has been requested by the Committee.\nThe committee adopted a report by Phillip WHITEHEAD (PES, UK) amending a Commission proposal for an EP and Council Decision establishing a general framework for Community activities in favour of consumers. In the wake of a recent ruling by the Court of Justice, which questioned the legality of certain categories of expenditure, this framework is intended to provide a legal base for Community spending on consumer protection in accordance with Article 129a of the Maastricht Treaty. \nThe committee report calls for an increase from ECU 114 million to ECU 130 million in the funding proposed for the framework, which covers the five years 1999 to 2003.\nRecommending the increase, Mr Whitehead warned that the budget proposed by the Commission would lead to a severe downgrading of consumer protection. \"The rapporteur is extremely concerned that the budget being proposed will not give the pride of place to consumer protection and consumer health assured by Commission President Santer in the wake of the BSE crisis\".\nIn amending the proposal, the committee wants the framework to help promote the consumer interest internationally and to give more opportunity to consumer protection bodies. The legal interests of consumers must be protected, including their right to redress and access to justice. The impact of the Euro on products and services also needs attention and measures should be taken to make consumers aware of the possible benefits of the internal market and of sustainable and environmentally sound patterns of consumption. Measures must be taken to deal with potentially hazardous services as well as products. Funding should be available for high-quality independent scientific advice, globally recognized risk assessment and effective control and inspection. On the basis of the Commission's amended proposal, the Council\nadopted a common position providing for a financial framework of ECU 112.5 m, not including\nthe EHLASS programme (the original proposal by the Commission provided for a framework of\nECU 114 m, including ECU 7.5 m for EHLASS). The Council:\n- reworded the introductory sentence to Article 2 (activities to support and supplement the policy\nconducted by the Member States) to bring it more into line with the Treaty;\n- altered the description of the beneficiaries to take account of the special position of consumer\norganisations in some Member States;\n- took account, as regards the arrangements for implementation, of the differing structures of\nconsumer organisations in the Member States;\n- introduced an advisory committee to ensure better dialogue between Member States and the\nCommission with regard to the selection of the projects and activities to receive funding under\nArticle 2(b) and (c). \n\t\t\t\t\t\t\t \t\t\tPURPOSE: to establish a legal base for a general framework for Community activities in favour of consumers for the period 01.01.1999 to 31.12.2003.\nCOMMUNITY MEASURE: European Parliament and Council Decision 283/1999/EC establishing a general framework for Community activities in favour of consumers.\nCONTENT: This Decision establishes, at Community level, a general framework for activities promoting the interests of consumers and providing them with a high level of protection.\nThe financial framework for the implementation of this general framework for the period 1 January 1999 to 31 December 2003 is EUR 112.5 million (excluding the sum of EUR 7.5 million earmarked for funding EHLASS).\nThe framework comprises actions designed to help protect the health, safety and economic interests of consumers and to promote their right to information and education and their right to join forces in order to protect their interests. \nMore specifically, within these 4 categories, the following activities are eligible:\n1) Consumer health and safety as regards products and services, e.g. technical expertise to assess, adopting a preventive approach, risks relating to products, in particular for foodstuffs; actions relating to consumer products and services causing danger to consumers; dissemination of information about dangerous products and services, as well as about potential risks.\n2) Protecting the economic and legal interests of consumers, including access to dispute resolution, as regards products and services, taking into account horizontal aspects, e.g. actions to ensure the respect of consumer rights in the supply of goods and services; actions to improve cooperation between the bodies participating in market surveillance; improving common extra-judicial procedures; development of, and support for, actions aiming at facilitating access to justice; actions to monitor environmental claims on product labels, on packaging and, in general, in advertising and through other types of marketing.\n3)Educating and informing consumers, e.g. raising awareness among consumers for the need for sustainable production and consumption patterns; developing education and training of consumers, particularly in schools; development of and support for European centres providing information and advice to cross-border consumers in the Community.\n4) Promotion and representation of the interests of consumers, e.g. strengthening the representation of the interests of consumers at the Community and international level; supporting consumer organisations in the Member States, in particular when their means are limited; pilot projects promoting sustainable consumption models, in particular those that are environmentally friendly.\nThe activities to support and supplement the policy conducted by the Member States shall consist of:\n- actions taken by the Commission;\n- actions providing financial support for activities of the European consumer organisations, as defined in this Decision;\n- actions providing financial support for specific projects to promote the interests of consumers in the Member States, as defined in this Decision, in particular by consumer organisationsand appropriate independent public bodies.\nThe Decision also lays down criteria regarding the eligibility of organisations and the conditions for granting financial support. These include:\n- a satisfactory level of cost-effectiveness,\n- an added value ensuring a high and uniform level of the representation of the interests of consumers,\n- a lasting multiplier effect at national or European level,\n- the widest possible dissemnation of the results of the activities and projects supported.\nThe Commission is responsible for the management, monitoring, evaluation and supervision of the activities it funds. It will be assisted in this by an Advisory Committee composed of Member State representatives. The actions funded are to be evaluated regularly, both by the Commission and independent experts.\nEach year, the Commission shall submit a report to the European Parliament and to the Council on the implementation of this general framework. The kind of work carried out included on-the-spot checks of national control systems in the food, veterinary and phytosanitary sectors by the Food and Veterinary Office (FVO). Other actions funded under this Directive include, amongst others, validating test methods to detect BSE and the preparatory work for a Community Reference Laboratory on analytical methods for the authorisation of feed additives. Other activities funded under the terms of the Directive include a database of unfair contractual terms, a survey of fees for cross border payments in retail banking across the EU and a survey of mortgage credit suppliers to assess the uptake and effectiveness of the Voluntary Code of Conduct on Pre-contractual Information for Home Loans.","Under the Education and Information heading, the Report notes that the health and consumer policy web site was revised in 2002/03 with visits to the site peaking at 2 774 321 in October 2003. The Consumer Voice Newsletter was sent out to over 10 000 subscribers. Total expenditure for technical support including web site, e-mail service and newsletter added up to around EUR 1 million, with an additional EUR 72 500 spent on print publications. Other forms of expenditure included an evaluation of EU food labelling legislation, the European Young Consumer Competition, the development of on-line interactive education tools, supporting 15 European Consumer Centres Networks and funding workshops for consumer association experts. Grants for operating costs were awarded to the European Association for the Co-ordination of Consumer Representatives in Standardisation (ANEC) and to the European Consumers\u2019 Organisation (BEUC). In terms of financing for specific projects, the Report notes that in 2002/03, a total of 44 specific projects were co-financed, with national consumer organisations and NGO\u2019s being the main beneficiaries. The number of applications, approved projects and the total amount committed has stabilised. Noteworthy is the fact that the average size of projects has decreased though the administrative cost has increased \u2013 this being largely thanks to the need for external evaluators.","To conclude, the Report states that expenditure in 2002/03 was more policy driven that in previous years (1999-2001).
