PURPOSE: to suspend Common\n Customs Tariff duties on certain fishery products intended for domestic\n consumption in the Canary Islands: 2007-2013.
PROPOSED ACT: Council\n Regulation.
BACKGROUND: due to the\n geographical location of the Canary Islands, the sourcing of certain fishery\n products intended for domestic consumption can entail considerable extra\n costs. In order to lessen the impact of the Canary Islands’ geographical\n handicap, the Community has suspended, either partially or in full, the\n Common Customs Tariff duties on imports of certain fishery products into the Canary Islands. This measure is based on Article 299 (2) of the EC Treaty, which provides\n for specific measures to assist the Community’s outermost regions. The\n measure is also in line with the EU’s commitment to reduce, and possibly\n eliminate, common customs tariff duties to allow for the supply of\n non-agricultural raw material to the outermost regions.
In 2004 and 2006, the Spanish\n authorities submitted reports to the Commission on the implementation of\n these measures and requested the extension of these measures to cover the\n 2007-2013 period. Having examined the reports in considerable detail the Commission\n has concluded that similar tariff quotas are indeed warranted given that they\n cover the needs of the Canary Islands’ domestic market, whilst at the same\n time ensuring that reduced-duty imports into the Community remain predictable\n and clearly identifiable. Further given that previous quotas have not been\n exhausted, the new quotas should be set at a lower level.
CONTENT: the Commission\n therefore proposes that, from 1 January 2007 to 31 December 2013, the Common\n Customs Tariff duties that apply to imports into the Canary Island of certain fishery products, will be suspended in full. The list of fish products, as\n well as the quantities that apply to the proposed Regulation, are listed in\n Annex. The proposed Regulation will apply exclusively to products intended\n for the Canary Islands’ domestic market only. Further, the Regulation will\n apply only to those products which are unloaded from ship or aircraft before\n the customs declaration for release is submitted to the authorities in the Canary Islands. Provision is also made for regular reports on the Regulation’s\n implementation. The proposal reserves the right of the Commission to suspend\n the Regulation, if it has reason to believe that the provisions are being\n abused.
\nThe Committee\n on Regional Development adopted the report by Gerardo GALEOTE (EPP-ED,\n ES) approving unamended, under the consultation procedure, the proposal for a\n Council regulation opening and providing for the administration of autonomous\n Community tariff quotas on imports of certain fishery products into the\n Canary Islands.
\nThe European Parliament\n adopted, by 569 votes to 53 with18 abstentions, a legislative resolution\n approving, under the consultation procedure, the\n proposal for a Council regulation opening and providing for the\n administration of autonomous Community tariff quotas on imports of certain\n fishery products into the Canary Islands.
The report had been tabled for consideration in plenary\n by Gerardo GALEOTE (EPP-ED, ES) on behalf of the Committee on Regional\n Development.

LEGISLATIVE ACT:\n Council Regulation (EC) No 645/2008 opening and providing for the\n administration of autonomous Community tariff quotas on imports of certain\n fishery products into the Canary Islands
CONTENT: the Council adopted a Regulation temporarily suspending, for\n specified tariff quotas, customs duties on imports of certain fishery\n products into the Canary Islands. The purpose of this measure is to offset\n the natural handicap resulting from the exceptional geographical situation of\n the Canary Islands and concerns only the supply of fishery products intended\n exclusively for the islands' domestic market. The\n list of fish products, as well as the quantities that apply to the\n Regulation, are listed in the Annex. The Regulation will apply only to those\n products which are unloaded from ship or aircraft before the customs\n declaration for release is submitted to the authorities in the Canary Islands.
By 31 May 2010 , the competent Spanish authorities must submit a report to the Commission on\n the implementation of the measures relating to the suspension on duties\n normally applicable. The Commission shall examine the impact of those\n measures and, on the basis of that report, propose to the Council, if\n necessary, any relevant amendments to the quantities to be imported.
By 31 May 2012 , the competent Spanish authorities shall submit a report to the Commission\n on the implementation, after 2010, of the measures relating to the suspension\n of duties. The Commission shall re-examine the impact of those measures and,\n on the basis of its findings, submit to the Council any relevant proposals\n for the period after 2013.
The proposal\n reserves the right of the Commission to suspend the Regulation, if it has\n reason to believe that the provisions are being abused.
