PURPOSE: to\n lay down health rules as regards animal by-products not intended for human\n consumption.
PROPOSED ACT:\n Regulation of the European Parliament and of the Council.
BACKGROUND: in\n response to several crises linked to products of animal origin which\n threatened the
safety of\n public and animal health (TSE, dioxin, FMD), the Community introduced a\n comprehensive legislative framework to maintain a high level of safety along\n the whole production and distribution chain, from \"farm to fork\".\n In this context, Regulation (EC) No 1774/2002 laying down health rules concerning\n animal by-products not intended for human consumption was adopted. The\n Regulation, which has been applicable since 1 May 2003, consolidated and\n recast the various existing rules covering animal by-products (ABP).
The Commission\n presented a report in October 2005 reflecting the experience of all 25 Member\n States in applying the legislation. In addition, the Commission's Food and\n Veterinary Office (FVO) carried out a round of inspections in all 25 Member\n States throughout 2004 and 2005 to assess the level of compliance of the\n Member States.
The following\n major issues emerged from consultations on the report as meriting\n reconsideration:
a) \n the basic framework of safeguards applicable\n to all ABP should be maintained;
b) \n the scope of the rules on ABP should be adjusted;\n
c) \n the interaction of the rules on ABP with other\n Community legislation should be clarified;
d) \n a more risk-based approach for the\n categorisation of ABP, as well as controls, should be introduced.
CONTENT: the\n proposal takes into account the results of the review carried out on\n Regulation and re-enacts the reviewed provisions, as well as the remaining\n part of the enacting provisions, in a single text. In the light of the practical and\n scientific experience gained and the outcome of the consultation, the main\n elements of the proposal are to maintain a high level of food and feed safety\n and consumer protection, and at the same time to provide:
1) Clarification
2) A more risk-based approach
The provisions\n laid down in the Annexes to the Regulation, as well as provisions laid down\n in separate Community acts implementing or derogating from that Regulation,\n such as Regulations (EC) No 811/2003, 79/2005, 92/2005 or 181/2006, will be\n re-enacted in an implementing Regulation, under the comitology procedure.\n This will be prepared in parallel, so as to enter into application\n simultaneously with the current proposal.
\nThe Committee\n on the Environment, Public Health and Food Safety adopted the report drawn up\n by Horst SCHNELLHARDT (EPP-ED, DE) amending, under the first reading of the\n codecision procedure, the proposal for a regulation of the European\n Parliament and of the Council laying down health rules as regards animal\n by-products not intended for human consumption (Animal by-products\n Regulation).
The main\n amendments adopted by the committee are as follows:
Definitions: MEPs note that the proposal introduces new definitions different\n from those which figured in previous legislation, meaning the user must be prepared\n for new concepts. In keeping with the principle of good, consistent\n lawmaking, MEPs expanded the definitions of the proposed regulation and added\n references to provisions in force (Regulation (EC) No 852/2004 on\n the hygiene of foodstuffs, for example). With a view to making clear that the\n regulation covers only animal by-products, the definition of 'animal\n by-products' should include a reference to the fact that they have been\n excluded from human consumption.
Scope: according to MEPs, the regulation shall not apply to:
Hygiene: the general hygiene requirements should not be dealt with in the\n implementing provisions, which are covered by the comitology procedure.\n Instead their importance is such that they should be set out in the body of\n the regulation. A new ‘Annex I’ therefore deals with general hygiene\n requirements for the handling and processing of animal by-products.
Pets: MEPs call for the ban on the use of raw materials in Categories\n 1 and 2 to manufacture pet food to be maintained.
General\n animal health restrictions: MEPs deleted\n Article 5 of the proposal because the provisions on combating animal\n diseases, which are essentially based on EU law, already lay down in detail\n which products can be removed from restricted areas.
Placing on\n the market of other derived products outside the feed chain: MEPs believe that animal by-products can be processed to such an\n extent that they pose no risk to human or animal health. The end point in the\n life cycle of an ABP is a concept central to the new, revised regulation and\n limits its scope as defined in Section 1 of Chapter 1. They therefore propose\n that the end point should already be described in Section I.
Plants and\n establishments requiring approval: MEPs consider\n that the text does not make it clear whether pet food factories must be\n registered or approved. They believe that across-the-board approval for all\n pet food manufacturing establishments is essential for uniformity in the\n sector, in order to forestall problems in connection with trade. Within the\n EU, for the purposes of issuing health certificates an establishment must be\n approved in the country in question, so that imports into the EU can be\n approved. MEPs also call for the compulsory registration of operators who\n transport animal by-products.
Exemptions\n from the requirement for approval: MEPs reject\n the exemption from the requirement for approval in respect of the processing,\n storage and handling of animal by-products in establishments registered\n pursuant to Regulations (EC) No 853/2004 and No 183/2005 or\n approved pursuant to Regulation (EC) No 183/2005 laying down\n requirements for feed hygiene. Moreover, they consider that a blanket exemption\n from the requirement for approval for biogas and composting plants in which\n animal by-products or derived products are transformed in accordance with the\n standard parameters laid down in the regulation is unacceptable. Operators\n whose plants or establishments are exempt from approval shall, before\n commencing operations, notify the relevant competent authority of the\n existence of the plants or establishments.
Approval of\n establishments and plants: according to MEPs,\n this provision (approval of plants following an on-site visit, conditional\n approval) should also apply to establishments. The wording should be brought\n into line with the parallel provision in Regulation (EC) No 882/2004. In\n addition, it should then be made clear that the granting of both conditional\n and final approval can be made subject to compliance with specific\n requirements.
In this\n context, the competent authority shall initiate procedures to withdraw the\n establishment's or plant's approval if, when carrying out official controls.\n it identifies serious deficiencies or has to stop production at an\n establishment or plant repeatedly and the operator is not able to provide\n adequate guarantees regarding future production. However, the competent\n authority may suspend an establishment's or plant's approval if the operator\n can guarantee that it will resolve deficiencies within a reasonable time.
Operators’\n obligations and responsibility: MEPs\n specify that the responsibility for ensuring that animal by-products and\n derived products are accompanied by a commercial document - so that this\n provision can be enforced and breaches of it punished - should lie with the transporter.\n With a view to facilitating trade, the commercial document may also be drawn\n up electronically. Any operator consigning, transporting or receiving animal\n by-products or derived products shall keep a record of consignments.
In line with\n previous legislation on food production, operators should continue to be\n held responsible. In particular, operators of such plants shall take the\n following measures: (i) identify any hazards that must be prevented,\n eliminated or reduced to acceptable levels; (ii) identify the critical\n control points at the step or steps at which control is essential to prevent\n or eliminate a hazard or to reduce it to acceptable levels; (iii) establish\n critical limits at critical control points which separate acceptability from\n unacceptability for the prevention, elimination or reduction of identified\n hazards; (iv) establish and implement effective monitoring procedures at\n critical control points; (v) establish corrective actions and procedures,\n which shall be carried out regularly, to verify that the measures are working\n effectively; (vi) establish a system ensuring the traceability of each batch\n dispatched.
Restrictions\n concerning the use of animal by-products: MEPs\n consider that the feeding of fur animals with processed animal protein and\n grazing on organically fertilised land are fundamental issues dealt with by\n the regulation. They should not be regulated in the implementing rules.\n However, technical details concerning compliance with prohibitions and\n thresholds in connection with the contamination of feed with animal protein\n should be regulated in such a way.
Disposal of\n by-products: a new article has been added\n covering all the possibilities for disposal for all categories of by-products\n in order to avoid repetition of their final uses.
Disposal\n and use of catering waste: MEPs recall that the\n Directive currently in force permits national regulation of the use of\n catering waste in biogas and composting plants. Until efficient Community\n provisions are adopted, the law currently in force should continue to apply.\n MEPs believe that, with regard to storage, collection and transport of\n catering waste, uniform provisions should also apply, in the interests of\n uniform economic conditions in the EU.
Derogations\n regarding the collection and use of animal by-products for the specific\n purpose of animal feed: a new article\n provides that implementing measures may be adopted by the Member States, with\n notification to the European Commission, in order to exclude the collection\n of material from Categories 1, 2 and 3 in certain areas of the Natura 2000 network or other areas in which, for reasons of conservation of endangered and\n protected species, or protected necrophagous birds, such measures are needed.\n
Official\n controls: the entire chain of animal by-products,\n from the place where the by-product arises to processing, use or disposal,\n shall be subject to official controls.
Traceability: the report stresses that cooperation between the competent\n authorities of Member States controlling the flow of material should be\n enhanced so as to ensure traceability and to avoid illegal relabeling of meat\n and meat products, which has led to rotten meat scandals in the past. Lastly,\n MEPs consider that every effort should be made to promote the use of animal\n by-products as sources of bioenergy.
\nThe European Parliament\n adopted by 391 votes to 3, with 4 abstentions, a legislative resolution\n modifying, under the first reading of the codecision procedure, the proposal\n for a regulation of the European Parliament and of the Council laying down\n health rules as regards animal by-products not intended for human consumption\n (Animal by-products Regulation).

Definitions: for the purposes of this Regulation, \"animal\n by-products\" means entire bodies or parts of animals, products of animal\n origin or other products obtained from animals, which are not intended for\n human consumption, including oocytes, embryos and semen; \"derived\n products\" means products obtained from one or more treatments,\n transformations or steps of processing of animal by-products; \"products\n of animal origin\" means products of animal origin as defined in\n Regulation (EC) No 853/2004; \"carcase\" means carcase as defined in\n point 1(9) of Annex I to Regulation (EC) No 853/2004.
Responsibilities: as soon as operators generate animal by-products or derived\n products falling within the scope of this Regulation, they shall identify\n them and ensure that they are dealt with in accordance with this Regulation\n (starting point).
Operators\n shall ensure at all stages of collection, transport, handling, treatment,\n transformation, processing, storage, placing on the market, distribution, use\n and disposal within the businesses under their control that animal\n by-products and derived products satisfy the requirements of this Regulation\n which are relevant to their activities.
Members States\n shall monitor and verify that the relevant requirements of this Regulation\n are fulfilled by operators along the entire chain of animal by-products and\n derived products. For that purpose, they shall maintain a system of official\n controls.
Member States shall\n also ensure that an adequate system is in place on their territory ensuring\n that animal by-products are: (i) collected, identified and transported\n without undue delay; and (ii) treated, used or disposed of in accordance with\n this Regulation.
Member States\n may fulfil their obligations in cooperation with other Member States or third countries.
Starting\n point: the starting point is the precise moment\n in the life cycle of animal by-products following which, the requirements of\n this Regulation should apply. Once a product has become an animal by-product,\n it should normally not re-enter the food chain.
However,\n special circumstances apply for the handling of certain raw materials, such\n as hides, handled in establishments or plants integrated at the same time\n into the food chain and the animal by-products manufacturing chain. In those\n cases, the necessary measures should be taken by means of segregation to\n mitigate potential risks for the food and feed chain which can arise from\n cross-contamination. For other establishments, risk-based conditions should\n be determined to prevent cross contamination in particular through separation\n between the two chains.
End point: for reasons of legal certainty and proper control of potential\n risks, an end point in the manufacturing chain should be determined for\n products without direct relevance for the safety of the feed chain. For\n certain products regulated under other Community legislation, such an end\n point should be determined at the stage of manufacturing. Products which have\n reached this end point should be exempt from controls under this Regulation.\n In particular, products beyond the end point should be allowed to be placed\n on the market without restriction under this Regulation and may be handled\n and transported by operators which have not been approved or registered in\n accordance with this Regulation.
However, it\n should be possible to modify such an end point, particularly in the case of\n new emerging risks.
Approved\n establishments or plants: operations with animal\n by-products which give rise to a considerable degree of risk to public and\n animal health should only be carried out in establishments or plants which\n have been approved in advance for such operations by the competent authority.\n This condition should apply in particular to processing plants and other\n establishments or plants which handle or store animal by-products with a\n direct relevance for the safety of the feed chain.
Approval: establishments or plants should be approved following the\n submission of information to the competent authority and following a visit\n carried out on site which demonstrates that the requirements of this\n Regulation for the infrastructure and equipment of the establishment or plant\n will be met, so that any risks to public and animal health arising from the\n process used will be adequately contained. It should be possible to grant the\n approvals conditionally in order to allow operators to rectify deficiencies\n before the establishment or plant obtains full approval.
Establishments\n and plants which have been approved or registered under hygiene legislation\n should be under the obligation to comply with the requirements of this\n Regulation and subject to official controls carried out for the purposes of\n verifying compliance with the requirements of this Regulation.
Each Member State shall draw up a list of plants, establishments and operators which have been\n approved or registered in accordance with this Regulation within its\n territory.
Animals\n used for experiments: animal by-products from\n animals used for experiments as defined in Directive 86/609/EEC should also\n be excluded from use in feed, due to the potential risks arising from those\n animal by-products. However, Member States may allow the use of animal\n by-products from animals which have been used for experiments to test new\n feed additives, in accordance with Regulation (EC) No 1831/2003 on additives\n for use in animal nutrition.
Traceability: the respective basic obligation of operators to ensure\n compliance with this Regulation should be further clarified and specified as\n regards the means by which traceability is ensured, such as separate\n collection and channelling of animal by-products. Established systems\n ensuring traceability for products exclusively circulating on national level\n by other means should continue to operate, if they provide equivalent\n information. Every effort should be made to promote the use of electronic and\n other means of documentation which do not involve paper records, as long as\n they ensure full traceability.
Own checks: a system of own checks is necessary to ensure that within an\n establishment or plant, the requirements of this Regulation are fulfilled.\n During official controls, the competent authorities should take into account\n the performance of own checks.
In certain\n establishments or plants own checks should be carried out through a system\n based on the principles of hazard analysis and critical control points\n (HACCP). The principles of HACCP should be based on the experience with their\n implementation under Community legislation on food and feed hygiene. In this\n respect, national guides to good practice could serve as a useful tool to\n facilitate the practical implementation of the HACCP principles, and of other\n aspects of this Regulation.
Placing on\n the market of animal by-products and derived products intended for feeding\n purposes and of organic fertilisers and soil improvers: in order to ensure the protection of the food and feed chain, the\n text clarifies the requirements on these points. Only Category 3 material\n should be used for feeding farmed animals other than fur animals.
Fertilisers\n produced on the basis of animal by-products may affect the safety of the feed\n and food chain. Where they have been manufactured from meat-and-bone meal of\n Category 2 or from processed animal protein, a component, such as an\n inorganic or an indigestible substance, should be added in order to prevent\n their direct use for feeding purposes. Such mixing should not be required if\n the composition or packaging of products, in particular of products destined\n for use by the final consumer, excludes the misuse of the product for feeding\n purposes. When determining the components, different circumstances regarding\n climate and soil and the objective for the use of particular fertilisers\n should be taken into account.
Official\n controls: the possible courses of action which\n the competent authority can take when carrying out official controls should\n be specified in order to ensure legal certainty, in particular regarding the\n suspension or permanent prohibition of operations or the imposition of\n conditions to ensure the proper application of this Regulation.
These official\n controls should be carried out in the framework of multi-annual control plans\n under Regulation (EC) No 882/2004 on official controls performed to\n ensure the verification of compliance with feed and food law, animal health\n and animal welfare rules.
Powers of\n the Commission (comitology): the Commission shall\n be empowered to adopt:
· \n rules modifying the end point in the manufacturing\n chain of certain derived products and establishing such an end point for\n certain other derived products;
· \n rules in regard to serious transmissible diseases in\n the presence of which the dispatch of animal by-products and derived products\n should not be allowed and/or the conditions allowing such a dispatch;
· \n measures changing the categorisation of animal\n by-products;
· \n measures regarding restrictions on the use and\n disposal of animal by-products;
· \n measures laying down conditions for the application\n of certain derogations regarding the use, collection and disposal of animal\n by-products as well as measures authorising or rejecting a particular alternative\n method for the use and disposal of animal by-products.
The Commission\n shall also be empowered to adopt more specific rules concerning:
These measures\n shall be adopted in accordance with the regulatory procedure with scrutiny.
\nPURPOSE: to\n lay down health rules as regards animal by-products not intended for human\n consumption
LEGISLATIVE\n ACT: Regulation (EC) No 1069/2009 of the European Parliament and of the\n Council laying down health rules as regards animal by-products and derived\n products not intended for human consumption and repealing Regulation (EC)\n No 1774/2002 (Animal by-products Regulation)
CONTENT: the\n Council adopted this Regulation modernising the EU rules for animal by\n products, following a first reading agreement with the European Parliament.\n The new Regulation is aimed at introducing more risk-proportionate rules and\n at clarifying the rules on animal by-products, as well as their interaction\n with other EU legislation.
The Regulation\n lays down public health and animal health rules for animal by-products and\n derived products, in order to prevent and minimise risks to public and animal\n health arising from those products, and in particular to protect the safety\n of the food and feed chain .Animal by-products are products of animal origin\n which are not intended for human consumption. They arise mainly during the slaughter\n of animals for human consumption, during the production of products of animal\n origin such as dairy products, and in the course of the disposal of dead\n animals. Past crisis related to outbreaks of foot-and-mouth disease or the\n spread of bovine spongiform encephalopathy (BSE) have shown that the improper\n use of certain animal by-products pose a risk to public and animal health,\n the safety of the food and feed chain and consumer confidence. More than 15\n million tonnes of animal by-products are produced in the EU every year.
The main\n points of the Regulation are as follows:
· \n the concept of an \"end point\"\n in the manufacturing of animal by-products is introduced, after which the\n processed products are no longer subject to the animal by-products Regulation,\n as some potential risks have been eliminated for example by heat or chemical\n substances. Instead, the general rules on product safety apply. Under the current\n rules, almost all material from animals which does not enter the food chain,\n is subject to the rules on animal by-products;
· \n the distinction between foodstuffs and animal\n by-products is clarified by confirming that operators need to make an\n irreversible decision, if products are destined for purposes other than human\n consumption. This means that once a product has become an animal by-product,\n it must not re-enter the food chain;
· \n modification of the current classification 1 of\n animal by-products by Comitology procedure is permitted. In addition, certain\n animal by-products, which so far have been classified by default as category\n 2 material but which have been proven to pose no major risks, are\n reclassified as belonging to category 3, so as to allow their use for certain\n feeding purposes. For any other animal by-products which are not listed under\n one of the three categories, the classification by default as category 2\n material is maintained for precautionary reasons;
· \n a registration obligation is introduced for\n operators who transport animal by-products, in order to strengthen\n traceability;
· \n the coherence between the Regulation on animal\n by-products and other EU legislation (for instance the legislation on food\n hygiene and waste) is improved by clarifying when the appropriate legislation\n applies. This removes unnecessary burdens for operators (for example, approvals\n of slaughterhouses and dairy plants under food and feed legislation are\n recognised).
The current\n classification scheme is maintained. This means\n that animal by-products of category 1 (injurious to health) and category 2\n (unfit for human consumption) must not be placed on the market as food,\n whereas material of category 3 (which comply with certain rules regarding\n their possible use for human consumption) may be used for certain feeding\n purposes.
The basic\n principles of Regulation (EC) No 1774/2002 on animal by-products,\n however, remain unchanged. These include:
The technical\n details for the Regulation will be laid down in a separate legal act, to be adopted\n by comitology procedure. This implementing regulation will be prepared in the\n next year, so that it can enter into application simultaneously with the new\n basic regulation.

\nPURPOSE: to\n lay down health rules as regards animal by-products not intended for human\n consumption.
PROPOSED ACT:\n Regulation of the European Parliament and of the Council.
BACKGROUND: in\n response to several crises linked to products of animal origin which\n threatened the
safety of\n public and animal health (TSE, dioxin, FMD), the Community introduced a\n comprehensive legislative framework to maintain a high level of safety along\n the whole production and distribution chain, from \"farm to fork\".\n In this context, Regulation (EC) No 1774/2002 laying down health rules concerning\n animal by-products not intended for human consumption was adopted. The\n Regulation, which has been applicable since 1 May 2003, consolidated and\n recast the various existing rules covering animal by-products (ABP).
The Commission\n presented a report in October 2005 reflecting the experience of all 25 Member\n States in applying the legislation. In addition, the Commission's Food and\n Veterinary Office (FVO) carried out a round of inspections in all 25 Member\n States throughout 2004 and 2005 to assess the level of compliance of the\n Member States.
The following\n major issues emerged from consultations on the report as meriting\n reconsideration:
a) \n the basic framework of safeguards applicable\n to all ABP should be maintained;
b) \n the scope of the rules on ABP should be adjusted;\n
c) \n the interaction of the rules on ABP with other\n Community legislation should be clarified;
d) \n a more risk-based approach for the\n categorisation of ABP, as well as controls, should be introduced.
CONTENT: the\n proposal takes into account the results of the review carried out on\n Regulation and re-enacts the reviewed provisions, as well as the remaining\n part of the enacting provisions, in a single text. In the light of the practical and\n scientific experience gained and the outcome of the consultation, the main\n elements of the proposal are to maintain a high level of food and feed safety\n and consumer protection, and at the same time to provide:

The provisions\n laid down in the Annexes to the Regulation, as well as provisions laid down\n in separate Community acts implementing or derogating from that Regulation,\n such as Regulations (EC) No 811/2003, 79/2005, 92/2005 or 181/2006, will be\n re-enacted in an implementing Regulation, under the comitology procedure.\n This will be prepared in parallel, so as to enter into application\n simultaneously with the current proposal.
\nThe Committee\n on the Environment, Public Health and Food Safety adopted the report drawn up\n by Horst SCHNELLHARDT (EPP-ED, DE) amending, under the first reading of the\n codecision procedure, the proposal for a regulation of the European\n Parliament and of the Council laying down health rules as regards animal\n by-products not intended for human consumption (Animal by-products\n Regulation).
The main\n amendments adopted by the committee are as follows:
Definitions: MEPs note that the proposal introduces new definitions different\n from those which figured in previous legislation, meaning the user must be prepared\n for new concepts. In keeping with the principle of good, consistent\n lawmaking, MEPs expanded the definitions of the proposed regulation and added\n references to provisions in force (Regulation (EC) No 852/2004 on\n the hygiene of foodstuffs, for example). With a view to making clear that the\n regulation covers only animal by-products, the definition of 'animal\n by-products' should include a reference to the fact that they have been\n excluded from human consumption.
Scope: according to MEPs, the regulation shall not apply to:
Hygiene: the general hygiene requirements should not be dealt with in the\n implementing provisions, which are covered by the comitology procedure.\n Instead their importance is such that they should be set out in the body of\n the regulation. A new ‘Annex I’ therefore deals with general hygiene\n requirements for the handling and processing of animal by-products.
Pets: MEPs call for the ban on the use of raw materials in Categories\n 1 and 2 to manufacture pet food to be maintained.
General\n animal health restrictions: MEPs deleted\n Article 5 of the proposal because the provisions on combating animal\n diseases, which are essentially based on EU law, already lay down in detail\n which products can be removed from restricted areas.
Placing on\n the market of other derived products outside the feed chain: MEPs believe that animal by-products can be processed to such an\n extent that they pose no risk to human or animal health. The end point in the\n life cycle of an ABP is a concept central to the new, revised regulation and\n limits its scope as defined in Section 1 of Chapter 1. They therefore propose\n that the end point should already be described in Section I.
Plants and\n establishments requiring approval: MEPs consider\n that the text does not make it clear whether pet food factories must be\n registered or approved. They believe that across-the-board approval for all\n pet food manufacturing establishments is essential for uniformity in the\n sector, in order to forestall problems in connection with trade. Within the\n EU, for the purposes of issuing health certificates an establishment must be\n approved in the country in question, so that imports into the EU can be\n approved. MEPs also call for the compulsory registration of operators who\n transport animal by-products.
Exemptions\n from the requirement for approval: MEPs reject\n the exemption from the requirement for approval in respect of the processing,\n storage and handling of animal by-products in establishments registered\n pursuant to Regulations (EC) No 853/2004 and No 183/2005 or\n approved pursuant to Regulation (EC) No 183/2005 laying down\n requirements for feed hygiene. Moreover, they consider that a blanket exemption\n from the requirement for approval for biogas and composting plants in which\n animal by-products or derived products are transformed in accordance with the\n standard parameters laid down in the regulation is unacceptable. Operators\n whose plants or establishments are exempt from approval shall, before\n commencing operations, notify the relevant competent authority of the\n existence of the plants or establishments.
Approval of\n establishments and plants: according to MEPs,\n this provision (approval of plants following an on-site visit, conditional\n approval) should also apply to establishments. The wording should be brought\n into line with the parallel provision in Regulation (EC) No 882/2004. In\n addition, it should then be made clear that the granting of both conditional\n and final approval can be made subject to compliance with specific\n requirements.
In this\n context, the competent authority shall initiate procedures to withdraw the\n establishment's or plant's approval if, when carrying out official controls.\n it identifies serious deficiencies or has to stop production at an\n establishment or plant repeatedly and the operator is not able to provide\n adequate guarantees regarding future production. However, the competent\n authority may suspend an establishment's or plant's approval if the operator\n can guarantee that it will resolve deficiencies within a reasonable time.
Operators’\n obligations and responsibility: MEPs\n specify that the responsibility for ensuring that animal by-products and\n derived products are accompanied by a commercial document - so that this\n provision can be enforced and breaches of it punished - should lie with the transporter.\n With a view to facilitating trade, the commercial document may also be drawn\n up electronically. Any operator consigning, transporting or receiving animal\n by-products or derived products shall keep a record of consignments.
In line with\n previous legislation on food production, operators should continue to be\n held responsible. In particular, operators of such plants shall take the\n following measures: (i) identify any hazards that must be prevented,\n eliminated or reduced to acceptable levels; (ii) identify the critical\n control points at the step or steps at which control is essential to prevent\n or eliminate a hazard or to reduce it to acceptable levels; (iii) establish\n critical limits at critical control points which separate acceptability from\n unacceptability for the prevention, elimination or reduction of identified\n hazards; (iv) establish and implement effective monitoring procedures at\n critical control points; (v) establish corrective actions and procedures,\n which shall be carried out regularly, to verify that the measures are working\n effectively; (vi) establish a system ensuring the traceability of each batch\n dispatched.
Restrictions\n concerning the use of animal by-products: MEPs\n consider that the feeding of fur animals with processed animal protein and\n grazing on organically fertilised land are fundamental issues dealt with by\n the regulation. They should not be regulated in the implementing rules.\n However, technical details concerning compliance with prohibitions and\n thresholds in connection with the contamination of feed with animal protein\n should be regulated in such a way.
Disposal of\n by-products: a new article has been added\n covering all the possibilities for disposal for all categories of by-products\n in order to avoid repetition of their final uses.
Disposal\n and use of catering waste: MEPs recall that the\n Directive currently in force permits national regulation of the use of\n catering waste in biogas and composting plants. Until efficient Community\n provisions are adopted, the law currently in force should continue to apply.\n MEPs believe that, with regard to storage, collection and transport of\n catering waste, uniform provisions should also apply, in the interests of\n uniform economic conditions in the EU.
Derogations\n regarding the collection and use of animal by-products for the specific\n purpose of animal feed: a new article\n provides that implementing measures may be adopted by the Member States, with\n notification to the European Commission, in order to exclude the collection\n of material from Categories 1, 2 and 3 in certain areas of the Natura 2000 network or other areas in which, for reasons of conservation of endangered and\n protected species, or protected necrophagous birds, such measures are needed.\n
Official\n controls: the entire chain of animal by-products,\n from the place where the by-product arises to processing, use or disposal,\n shall be subject to official controls.

Every effort should be made to promote the use of electronic and\n other means of documentation which do not involve paper records, as long as\n they ensure full traceability.
Own checks: a system of own checks is necessary to ensure that within an\n establishment or plant, the requirements of this Regulation are fulfilled.\n During official controls, the competent authorities should take into account\n the performance of own checks.
In certain\n establishments or plants own checks should be carried out through a system\n based on the principles of hazard analysis and critical control points\n (HACCP). The principles of HACCP should be based on the experience with their\n implementation under Community legislation on food and feed hygiene. In this\n respect, national guides to good practice could serve as a useful tool to\n facilitate the practical implementation of the HACCP principles, and of other\n aspects of this Regulation.
Placing on\n the market of animal by-products and derived products intended for feeding\n purposes and of organic fertilisers and soil improvers: in order to ensure the protection of the food and feed chain, the\n text clarifies the requirements on these points. Only Category 3 material\n should be used for feeding farmed animals other than fur animals.
Fertilisers\n produced on the basis of animal by-products may affect the safety of the feed\n and food chain. Where they have been manufactured from meat-and-bone meal of\n Category 2 or from processed animal protein, a component, such as an\n inorganic or an indigestible substance, should be added in order to prevent\n their direct use for feeding purposes. Such mixing should not be required if\n the composition or packaging of products, in particular of products destined\n for use by the final consumer, excludes the misuse of the product for feeding\n purposes. When determining the components, different circumstances regarding\n climate and soil and the objective for the use of particular fertilisers\n should be taken into account.
Official\n controls: the possible courses of action which\n the competent authority can take when carrying out official controls should\n be specified in order to ensure legal certainty, in particular regarding the\n suspension or permanent prohibition of operations or the imposition of\n conditions to ensure the proper application of this Regulation.
These official\n controls should be carried out in the framework of multi-annual control plans\n under Regulation (EC) No 882/2004 on official controls performed to\n ensure the verification of compliance with feed and food law, animal health\n and animal welfare rules.
Powers of\n the Commission (comitology): the Commission shall\n be empowered to adopt:
· \n rules modifying the end point in the manufacturing\n chain of certain derived products and establishing such an end point for\n certain other derived products;
· \n rules in regard to serious transmissible diseases in\n the presence of which the dispatch of animal by-products and derived products\n should not be allowed and/or the conditions allowing such a dispatch;
· \n measures changing the categorisation of animal\n by-products;
· \n measures regarding restrictions on the use and\n disposal of animal by-products;
· \n measures laying down conditions for the application\n of certain derogations regarding the use, collection and disposal of animal\n by-products as well as measures authorising or rejecting a particular alternative\n method for the use and disposal of animal by-products.
The Commission\n shall also be empowered to adopt more specific rules concerning:
These measures\n shall be adopted in accordance with the regulatory procedure with scrutiny.
\nPURPOSE: to\n lay down health rules as regards animal by-products not intended for human\n consumption
LEGISLATIVE\n ACT: Regulation (EC) No 1069/2009 of the European Parliament and of the\n Council laying down health rules as regards animal by-products and derived\n products not intended for human consumption and repealing Regulation (EC)\n No 1774/2002 (Animal by-products Regulation)
CONTENT: the\n Council adopted this Regulation modernising the EU rules for animal by\n products, following a first reading agreement with the European Parliament.\n The new Regulation is aimed at introducing more risk-proportionate rules and\n at clarifying the rules on animal by-products, as well as their interaction\n with other EU legislation.
The Regulation\n lays down public health and animal health rules for animal by-products and\n derived products, in order to prevent and minimise risks to public and animal\n health arising from those products, and in particular to protect the safety\n of the food and feed chain .Animal by-products are products of animal origin\n which are not intended for human consumption. They arise mainly during the slaughter\n of animals for human consumption, during the production of products of animal\n origin such as dairy products, and in the course of the disposal of dead\n animals. Past crisis related to outbreaks of foot-and-mouth disease or the\n spread of bovine spongiform encephalopathy (BSE) have shown that the improper\n use of certain animal by-products pose a risk to public and animal health,\n the safety of the food and feed chain and consumer confidence. More than 15\n million tonnes of animal by-products are produced in the EU every year.
The main\n points of the Regulation are as follows:
· \n the concept of an \"end point\"\n in the manufacturing of animal by-products is introduced, after which the\n processed products are no longer subject to the animal by-products Regulation,\n as some potential risks have been eliminated for example by heat or chemical\n substances. Instead, the general rules on product safety apply. Under the current\n rules, almost all material from animals which does not enter the food chain,\n is subject to the rules on animal by-products;
· \n the distinction between foodstuffs and animal\n by-products is clarified by confirming that operators need to make an\n irreversible decision, if products are destined for purposes other than human\n consumption. This means that once a product has become an animal by-product,\n it must not re-enter the food chain;
· \n modification of the current classification 1 of\n animal by-products by Comitology procedure is permitted. In addition, certain\n animal by-products, which so far have been classified by default as category\n 2 material but which have been proven to pose no major risks, are\n reclassified as belonging to category 3, so as to allow their use for certain\n feeding purposes. For any other animal by-products which are not listed under\n one of the three categories, the classification by default as category 2\n material is maintained for precautionary reasons;
· \n a registration obligation is introduced for\n operators who transport animal by-products, in order to strengthen\n traceability;
· \n the coherence between the Regulation on animal\n by-products and other EU legislation (for instance the legislation on food\n hygiene and waste) is improved by clarifying when the appropriate legislation\n applies. This removes unnecessary burdens for operators (for example, approvals\n of slaughterhouses and dairy plants under food and feed legislation are\n recognised).
The current\n classification scheme is maintained. This means\n that animal by-products of category 1 (injurious to health) and category 2\n (unfit for human consumption) must not be placed on the market as food,\n whereas material of category 3 (which comply with certain rules regarding\n their possible use for human consumption) may be used for certain feeding\n purposes.
The basic\n principles of Regulation (EC) No 1774/2002 on animal by-products,\n however, remain unchanged. These include:
The technical\n details for the Regulation will be laid down in a separate legal act, to be adopted\n by comitology procedure. This implementing regulation will be prepared in the\n next year, so that it can enter into application simultaneously with the new\n basic regulation.
