PURPOSE: to\n approve, on behalf of the European Community, the Amendments of Annex II and\n Annex III to the Convention for the protection of the marine environment of\n the North-East Atlantic (OSPAR Convention) in relation to the storage of\n carbon dioxide streams in geological formations.
PROPOSED ACT:\n Council Decision.
BACKGROUND:\n the EC is a Contracting Party to the Convention for the protection of the\n marine environment of the north-east Atlantic (OSPAR Convention) pursuant to\n Council Decision 98/249/EC. The aim of the Convention is to prevent and\n eliminate pollution and to protect the maritime area against the harmful\n effects of human activities. The Convention entered into force on 25 March\n 1998.
The Commission\n Communication\n of January 2007 on Sustainable Power Generation from Fossil Fuels identified\n the need for a regulatory framework on carbon capture\n and sequestration (CCS) and supported the adoption of\n amendments to the OSPAR Convention to permit environmentally sound geological\n storage of CO2 under the seabed.
The European\n Commission also proposed a Directive\n of the European Parliament and of the Council on the geological storage of\n carbon dioxide, which will establish a permitting regime covering inter alia\n composition of the CO2 stream, site selection, monitoring and reporting, site\n closure, corrective measures in case of leakage, financial security and the\n conditions for transfer of responsibility to the State.
The European\n Council, at its March 2007 meeting, urged Member States and the Commission to\n work towards strengthening R&D and developing the necessary technical,\n economic and regulatory framework to bring environmentally safe carbon\n capture and sequestration to deployment with new fossil-fuel power plants, if\n possible by 2020, as this could be expected to imply removing legal obstacles\n to CCS from the OSPAR Convention.
CONTENT: the\n OSPAR Commission adopted by consensus of the Contracting Parties amendments\n of Annexes II and III to the Convention at its meeting in June 2007 in Ostend (Belgium) in relation to the storage of carbon dioxide streams in subsoil\n geological formations, with a view to legally enabling Carbon Capture and\n Storage (CCS) operations in the OSPAR maritime area. The Commission took part\n in negotiating these amendments, in accordance with the Council Conclusions\n concerning negotiating directives for the Convention for the protection of\n the marine environment of the North-East Atlantic, and in the adoption by\n consensus of the Amendments to Annexes II and III to the Convention.
Through\n Community coordination in the context of the OSPAR negotiations, there was\n substantial improvement of the draft OSPAR Decisions on CCS accompanying the\n amendments to the Annexes, in terms of more explicit requirements for risk\n management and public participation. The Community delegation at the OSPAR\n Commission meeting that adopted these instruments stated that, with respect\n to matters relating to EC competence, it was pleased to be able to be part of\n the consensus accepting the package and that it would provide a good basis\n for the development of European legislation following the conclusions of the\n European Council on CCS.
Therefore, this proposal is for the\n Community to approve the Amendments to the OSPAR Convention Annexes II and\n III, the text of which appears in the Annex to the draft decision.
\nThe Committee\n on the Environment, Public Health and Food Safety adopted the report drawn up\n by Anna ROSBACH (EFD, DK) amending, under the consultation procedure, the proposal\n for a Council decision concerning the approval on behalf of the European\n Community, of the Amendments of Annex II and Annex III to the Convention for\n the protection of the marine environment of the North-East Atlantic (OSPAR\n Convention) in relation to the storage of carbon dioxide streams in\n geological formations.
The committee\n approves the proposal for a Council Decision as well as the amendments to\n Annexes II and III of the Convention.
Through these\n amendments, MEPs wish to recall in two new recitals that:
· \n the amendment of the OSPAR Convention\n supplements the measures recently taken at Community level on the storage of\n carbon dioxide under Directive\n 2009/31/EC;
· \n the Community and its Member States should, if\n possible simultaneously, approve the amendment of Annexes II and III of the\n OSPAR Convention by 1 June 2010. Otherwise, there would be a risk of\n discrepancies in the links between Community and Member State international\n law.
Another\n amendment insists that Member States which are Contracting Parties to the\n Convention shall endeavour to take the necessary steps with a view to depositing\n their instruments of ratification or approval simultaneously with those of\n the European Community and the other Member States and as far as possible not\n later than 1 June 2010.
\nThe European\n Parliament adopted by 624 votes to 30 with 14 abstentions, a legislative\n resolution amending, under the consultation procedure, the proposal for a\n Council decision concerning the approval on behalf of the European Community,\n of the Amendments of Annex II and Annex III to the Convention for the\n protection of the marine environment of the North-East Atlantic (OSPAR\n Convention) in relation to the storage of carbon dioxide streams in\n geological formations.
It adds the\n following recitals:
