PURPOSE: to\n define the next steps for Internet governance.
CONTEXT:\n governance of the Internet is a crucial public policy priority. Since the\n Internet became (from the mid 1990s) a truly global communications platform,\n governments have increasingly found themselves challenged with a whole host of\n public policy issues, ranging from finding ways to ensure their own citizens\n can fully benefit from the Internet’s potential, to dealing with\n inappropriate or illegal content, the need for appropriate consumer\n protection measures and addressing problems of jurisdiction in an\n increasingly globalised on-line world. Currently, Internet usage and\n penetration is now so high, especially in developed countries such as those\n of the EU, that it has become a critical resource, where any serious\n disruption in service can have potentially catastrophic effects on society\n and the economy. Most Internet users in the EU therefore have a legitimate\n expectation about the reliability of ‘their Internet’. Users will also\n inevitably turn to their governments if there is any major national\n disruption to their Internet service, and not to the various Internet\n governance bodies responsible for coordinating resources.
The EU has\n been in the forefront of international discussions on the management of the\n Internet since such discussions first began. The earliest\n communication from the Commission on this subject came in 1998 and the EU\n was a leading actor in the discussions on Internet governance in the context\n of the World Summit on the Information Society (WSIS) between 2003 and 2005.
In addition,\n the EU was an active and influential actor in the international discussions\n surrounding the setting-up of the Internet Corporation for Assigned Names and\n Numbers (ICANN) in the late 1990s and the shaping of the objectives for the\n organisation. The Commission Communication\n in April 2000 on the organisation and management of the Internet and the\n Council Resolution of 3 October 2000 noted, however, that the objectives\n which the EU had set itself on domain name management were not fully\n achieved. In the interim, it is important to note that the EU initiative to\n set up its own Top Level Domain ‘.eu’ has been a major success, with more\n than 3 million EU domain names registered to date.
CONTENT: the\n main points of the Communication are as follows:
(1)\n Internet governance principles: the experience of\n the last 10 years demonstrates the viability of the policy approach advocated\n by the EU for Internet governance so far. The Commission believes in\n maintaining the EU’s strong emphasis on the need for security and\n stability of the global Internet, the respect for human rights, freedom of\n expression, privacy, protection of personal data and the promotion of\n cultural and linguistic diversity. In addition, the key principles\n enabling the success of the Internet promoted by the EU remain:
(2)‘Accountability’\n in the ICANN context: at the moment it is ICANN\n (Internet Corporation for Assigned Names and Numbers (ICANN), a\n private-sector organisation established in the United States, that ensures\n the coordination of these resources. ICANN has now completed its first ten\n years. In September 2009 the latest in a series of agreements between ICANN\n and the US government regarding its objectives will come to an end. It is an\n appropriate time therefore for the EU to review the progress of ICANN to\n date, and to identify what changes if any may be desirable. The indication by\n the US government in 2006 that the current agreement should be the last such\n agreement with ICANN was largely welcomed by the international community\n (including the EU). At the same time, the US government has consistently\n indicated that it will maintain effective control of the coordination of key\n global naming and addressing functions and this is likely to mean that the\n problem regarding the ‘unilateral oversight’ of such resources will remain\n unresolved. The document discusses the question of accountability in the\n ICANN context. Accountability means an organisation such as ICANN being\n answerable for its decisions. ICANN has recently devoted significant efforts\n to reviewing arrangements for its internal accountability — i.e. the\n accountability to those who actively participate in each of the various ICANN\n constituencies. The problem is that the vast majority of Internet users do\n not participate in ICANN activities. There is therefore a need to ensure that\n ICANN is accountable externally to the global Internet community, which in\n the first instance (partly by virtue of the absence of alternatives in many\n countries) means being accountable externally to the governments of the\n various countries of the world. The only external accountability that ICANN\n currently has is to the US government under the JPA and the IANA contract,\n but this provides only for unilateral accountability to a single government.\n The stability and management of the root zone file is, however, a matter of\n crucial importance not just to the US government but to all countries of the\n world. However, there is no international consensus on the creation of a new\n intergovernmental organisation to exercise such oversight or on the\n delegation of such responsibilities to any existing organisation. An\n alternative would be to make ICANN externally accountable so that each\n government can exercise in their own interest those responsibilities which\n should properly sit at their level.
(3) Moving\n the agenda forward: the Commission proposes that\n the EU should actively engage its international partners in discussions on\n how to stimulate and support intergovernmental dialogue and cooperation\n to implement the public policy principles agreed for Internet governance in\n the WSIS beyond the existing work carried out through action lines. The\n starting point for such discussions should be the need to maintain private-sector\n leadership in all matters of the day-to-day management of the Internet. The\n multi-stakeholder process must also be encouraged wherever possible. At the\n same time, public policies for key global Internet resources (especially\n those that require global coordination) need to be based on multilateral\n intergovernmental cooperation. One element of an evolution of the current\n governance system could be the completion of an internal ICANN reform\n leading to full accountability and transparency. As regards external\n accountability, the current arrangements for unilateral oversight in regard\n to ICANN and IANA need to be replaced with an alternative mechanism to ensure\n that ICANN has multilateral accountability. This should be part of an\n evolutionary approach to allow governments to duly exercise their\n responsibilities. In this context, the question will need to be addressed of\n how to ensure that the legal character of ICANN’s incorporation in California does not prevent proper account being taken of governmental input.
In addition,\n the EU should take a leadership role in working towards the goal of increased\n security and stability of the Internet by initiating dialogue with\n international partners.
Lastly, the\n Commission proposes that the EU should seek to initiate discussions with the US government on how a more equitable arrangement might be found for oversight of the\n management of IANA which respects the national priorities of the US while at the same time reflecting the legitimate expectations and interests of the\n international community.
\nThe presidency\n briefed delegations on recent activities concerning Internet governance under\n the Swedish Presidency.
Two main\n events have marked the discussions this autumn, namely the new\n \"affirmation of commitment\" between the US Department of Commerce\n and the Internet Corporation for Assigned Names and Numbers (ICANN), which\n came into force on 1 October, and the 4th meeting on the Internet Governance\n Forum (IGF) in Egypt in November 2009.
\nThe Committee\n on Industry, Research and Energy adopted the report by Francisco SOSA WAGNER\n (NI, ES) in response to the Commission communication entitled “internet\n governance: the next steps”.
The committee\n considers that the internet is a global public\n good and, as such, its governance should be exercised in the common\n interest. It recognises that the internet is essential for the practical\n exercise of freedom of expression, cultural diversity, media pluralism and\n democratic citizenship, as well as for education and access to information,\n thus constituting one of the principal vectors for the dissemination of\n democratic values in the world.
Reiterating\n that access to the internet both guarantees and depends upon the exercise\n of a number of key fundamental rights, the committee underlines that\n institutions and stakeholders at all levels, therefore, have a general\n responsibility to assist in ensuring that everyone can exercise their right\n to participate in the information society while simultaneously attacking the\n twin challenges of e-illiteracy and democratic exclusion in the electronic\n age.
Members\n welcome the fact that the Commission understands the importance of “bridging\n the digital divide” and the development issues involved in internet\n governance. However, while they note that the internet can be an effective\n tool of social inclusion, our older citizens must be included. They\n therefore urge that action be taken to promote education on the use of\n the resources offered by the internet and the selection of criteria on how to\n use those resources.
Members\n recognise that the intensified use of the internet by citizens, consumers,\n companies and authorities implies that this communication instrument is\n becoming one of the fundamental elements of the completion of the internal\n market within the EU. In this context, they stress the need for appropriate\n protection of consumers and intellectual property rightsholders\n on the internet, as well as the fact that internet users’ civil rights and\n freedoms must be guaranteed.
The committee emphasises that internet governance should facilitate e-commerce\n and cross-border transactions by decentralising the self-regulatory roles,\n especially in setting entry conditions for new competitors.
It also calls\n for easier access to and development of the internet in newer Member States,\n particularly in rural areas, and in developing countries, through programmes\n funded by the EU.
To safeguard\n the EU interest in maintaining the internet as a global public good, Members\n consider that internet governance should be based on a broad, balanced\n public-private sector model, avoiding dominance by any individual entity\n or group of entities and attempts by state or supra-national authorities to\n control the flow of information on the internet, while interacting with\n multi-stakeholder processes on internet governance which continue to provide\n an effective mechanism for promoting global cooperation.
Members call\n on the European Commission and the Member States to ensure that all\n activities related to internet governance comply with the EU’s values and\n goals, as laid down in the TEU, in particular in those global internet\n governance fora where countries whose values differ greatly from those of\n Europe take part. They consider that, in the interest of avoiding conflict, international\n dialogue should be stepped up with these countries in the area of\n internet regulation.
They consider\n that governments should focus on issues vital to global internet public\n policy as private sector leadership needs to be based on respect for public\n policy principles and existing legislation and otherwise adhere to a\n principle of non-intervention, except as may be necessary in exceptional\n circumstances, and that, even then, their action should respect fundamental\n human rights and the proportionality principle
The committee\n stresses that any restrictions deemed indispensable should be limited to the\n minimum necessary in a democratic society, should be based on law, and should\n be effective and proportionate. It further emphasises that protection of\n minors must be guaranteed, and invites Member States to also take\n measures to enable minors to make responsible use of internet and on-line\n information services, and to improve the level of awareness of potential\n threats posed by new services.
It calls,\n moreover, for more initiatives to strengthen the safe exploration of the\n internet by children, to disseminate best practices worldwide and to\n reinforce international cooperation in the fight against harmful and illegal\n content online, particularly with regard to the sexual abuse of children. It\n reiterates that, when combating cybercrime and child pornography, criminal\n content should be deleted at the source before considering websites being\n blocked.
MEPs stress\n that the EU should address three critical public policy issues: i)\n protection of internet infrastructure to safeguard openness, availability,\n security and resilience against cyber attacks; ii) European dependence on\n dominant market solutions and associated public security risks, and iii)\n protection of data and privacy, in particular, as regards the establishment\n of effective international mechanisms for dispute resolution. They,\n therefore, call on the Commission to submit a proposal for the adaptation\n of the Data Protection Directive to the current digital environment.
Members urge\n all Member States that have not done so already to ratify and implement the\n Council of Europe Convention on Cybercrime, as well as to ratify and\n implement the Council of Europe Convention on the Prevention of Terrorism\n which would allow the development of a basis for international cooperation\n in countering the terrorist use of the internet in the form of\n large-scale attacks on and through computer systems which threaten national\n security, public safety or economic well-being.
The committee\n recommends, in addition, that the Commission and Member States work towards enhanced\n security and stability of the internet through measures aimed at\n increasing network and system diversity through the application of competition\n law, EU standards and procurement policy, as well as by: i) supporting\n ICANN’s work on security and stability of the domain name system, ii)\n supporting work in international fora, such as the OECD, the UN and the\n Council of Europe on improved legislative frameworks and national\n coordination.
It also\n stresses that the success of social networks, together with the\n internet’s technical capacities in terms of memory and data processing, is\n giving rise to problems of data retention and the use of archived data;\n deplores the fact, in this respect, that there is currently no “right to\n forget” on the internet.
Members\n consider there is a need to find a suitable balance between protecting\n users’ privacy and recording personal data. They deplore the fact that increasing\n use of internet networks does not yet go hand in hand with rules allowing\n users to manage the personal data they put on those networks.
They call on\n the Commission to present a proposal to extend the application of Regulation\n (EC) No 864/2007 on the law applicable to non-contractual obligations (Rome\n II) to include violations of data protection and privacy, and on the\n Council to authorise negotiations with a view to concluding an international\n agreement enabling effective redress by EU individuals in case of violations\n of their rights under EU law to data protection and privacy.
The committee\n points out that website security certification is becoming necessary to give\n consumers greater confidence in accessing online information and services.
It stresses\n the role of the European Network and Information Society Agency (ENISA) in\n the creation of a single European information space and, in particular, with\n respect to preventing, addressing and responding to network and information\n security problems. It underlines the need to further increase the\n effectiveness of ENISA by: i) identifying the research priorities, on a\n European level, in the areas of networking resilience and in network and\n information security, and offering knowledge of industry needs to potential\n research institutions; ii) drawing the attention of decision-makers to new\n technologies in security-related areas; and iii) developing forums for\n information-sharing and provide support to Member States.
Members\n request the Commission to facilitate the adoption of a coherent and\n comprehensive EU approach at the Internet Governance Forum (IGF) and\n other major internet governance events by submitting a draft EU position\n document well in advance of each such event to the European Parliament and\n Council for debate.
They recommend\n improving the IGF in the following ways: i) increased participation of\n developing countries, with attention paid to funding of their participation,\n ii) heightened visibility in the media, iii) more efficient organisation of\n meetings, e.g. by a reduction in the number of simultaneous meetings, the\n establishment of a stable platform to facilitate global participation, and\n greater multilingualism, iv) better coordination and cooperation between\n global, regional and national internet governance fora, and v) deepened\n cooperation between the European Parliament and national parliaments by using\n all technological means available, as well as the Inter-parliamentary\n EU-Information Exchange (IPEX).
The committee\n supports in general the Commission’s position in favour of the current ICANN\n management model based on private-sector leadership. It considers that\n improvements to ICANN should be made by: i) the introduction of an\n alternative, external dispute resolution mechanism allowing interested\n parties effective, neutral, timely and affordable review of ICANN decisions,\n ii) a gradually implemented diversified funding structure, with funding from\n any one entity or sector capped, in order to prevent undue influence over\n ICANN’s activities by any individual entity or group of entities; iii)\n appropriate representation of all interested parties in ICANN, iv) ensuring\n that ICANN’s board and top management represent a range of interests and\n regions; v) use of a reasonable part of its reserve fund in order to boost\n civil society’s participation to internet governance fora (especially from\n developing countries).
Lastly,\n Members request the Commission to provide Parliament with yearly reports on\n internet governance-related events during the preceding year, with the first\n such report to be provided by March 2011.
\nThe European Parliament adopted a\n resolution on “internet governance: the next steps” in response to the\n Commission’s communication on the subject.
A global\n public good: Parliament considers that the\n internet is a global public good and, as such, its governance should be\n exercised in the common interest. It recognises that the internet is\n essential for the practical exercise of freedom of expression, cultural\n diversity, media pluralism and democratic citizenship, as well as for\n education and access to information, thus constituting one of the principal\n vectors for the dissemination of democratic values in the world.

Limiting\n access restrictions:Members\n consider that governments should focus on issues vital to global internet\n public policy as private sector leadership needs to be based on respect for\n public policy principles and existing legislation and otherwise adhere to a principle\n of non-intervention, except as may be necessary in exceptional\n circumstances.
They call on\n governments to desist from imposing restrictions on internet access by way of\n censorship, blocking, filtering or otherwise, and from requiring private\n entities to do so. Institutions\n and international organisations: the resolution\n underlines that the EU institutions, bodies and Member States should coordinate\n their position with regard to internet governance in the various\n International bodies that deal with it, such as ICANN and its advisory bodies\n including the Government Advisory Committee (GAC). In this context, it\n emphasises the role of the European Network and Information Society Agency\n (ENISA) in the creation of a single European information space and, in\n particular, with respect to preventing, addressing and responding to network\n and information security problems. It underlines the need to further increase\n the effectiveness of ENISA and welcomes the fact that the Commission would\n shortly present a proposal for its modernisation.
It calls on\n the Commission to facilitate the adoption of a coherent and comprehensive EU\n approach at the Internet Governance Forum (IGF) and other major\n internet governance events by submitting a draft EU position document well in\n advance of each such event to the European Parliament and Council for debate.
The resolution\n recommends improving the IGF in the following ways: i) increased\n participation of developing countries, with attention paid to funding of\n their participation, ii) heightened visibility in the media, iii) more\n efficient organisation of meetings, e.g. by a reduction in the number of\n simultaneous meetings, the establishment of a stable platform to facilitate\n global participation, and greater multilingualism, iv) better coordination\n and cooperation between global, regional and national internet governance\n fora, and v) deepened cooperation between the European Parliament and\n national parliaments by using all technological means available such as\n video-conferences as well as the Inter-parliamentary EU-Information Exchange\n (IPEX).
Parliament\n supports in general the Commission’s position in favour of the current ICANN\n management model based on private-sector leadership. It considers that improvements\n to ICANN should be made by: i) the introduction of an alternative,\n external dispute resolution mechanism allowing interested parties effective,\n neutral, timely and affordable review of ICANN decisions, ii) a gradually\n implemented diversified funding structure, with funding from any one entity\n or sector capped, in order to prevent undue influence over ICANN’s activities\n by any individual entity or group of entities; iii) appropriate\n representation of all interested parties in ICANN, iv) ensuring that ICANN’s\n board and top management represent a range of interests and regions; v) use\n of a reasonable part of its reserve fund in order to boost civil society’s\n participation to internet governance fora (especially from developing\n countries).
Lastly, the\n resolution requests the Commission to provide Parliament with yearly reports\n on internet governance-related events during the preceding year, with the\n first such report to be provided by March 2011.
\nPURPOSE: to\n define the next steps for Internet governance.
CONTEXT:\n governance of the Internet is a crucial public policy priority. Since the\n Internet became (from the mid 1990s) a truly global communications platform,\n governments have increasingly found themselves challenged with a whole host of\n public policy issues, ranging from finding ways to ensure their own citizens\n can fully benefit from the Internet’s potential, to dealing with\n inappropriate or illegal content, the need for appropriate consumer\n protection measures and addressing problems of jurisdiction in an\n increasingly globalised on-line world. Currently, Internet usage and\n penetration is now so high, especially in developed countries such as those\n of the EU, that it has become a critical resource, where any serious\n disruption in service can have potentially catastrophic effects on society\n and the economy. Most Internet users in the EU therefore have a legitimate\n expectation about the reliability of ‘their Internet’. Users will also\n inevitably turn to their governments if there is any major national\n disruption to their Internet service, and not to the various Internet\n governance bodies responsible for coordinating resources.
The EU has\n been in the forefront of international discussions on the management of the\n Internet since such discussions first began. The earliest\n communication from the Commission on this subject came in 1998 and the EU\n was a leading actor in the discussions on Internet governance in the context\n of the World Summit on the Information Society (WSIS) between 2003 and 2005.
In addition,\n the EU was an active and influential actor in the international discussions\n surrounding the setting-up of the Internet Corporation for Assigned Names and\n Numbers (ICANN) in the late 1990s and the shaping of the objectives for the\n organisation. The Commission Communication\n in April 2000 on the organisation and management of the Internet and the\n Council Resolution of 3 October 2000 noted, however, that the objectives\n which the EU had set itself on domain name management were not fully\n achieved. In the interim, it is important to note that the EU initiative to\n set up its own Top Level Domain ‘.eu’ has been a major success, with more\n than 3 million EU domain names registered to date.
CONTENT: the\n main points of the Communication are as follows:
(1)\n Internet governance principles: the experience of\n the last 10 years demonstrates the viability of the policy approach advocated\n by the EU for Internet governance so far. The Commission believes in\n maintaining the EU’s strong emphasis on the need for security and\n stability of the global Internet, the respect for human rights, freedom of\n expression, privacy, protection of personal data and the promotion of\n cultural and linguistic diversity. In addition, the key principles\n enabling the success of the Internet promoted by the EU remain:
(2)‘Accountability’\n in the ICANN context: at the moment it is ICANN\n (Internet Corporation for Assigned Names and Numbers (ICANN), a\n private-sector organisation established in the United States, that ensures\n the coordination of these resources. ICANN has now completed its first ten\n years. In September 2009 the latest in a series of agreements between ICANN\n and the US government regarding its objectives will come to an end. It is an\n appropriate time therefore for the EU to review the progress of ICANN to\n date, and to identify what changes if any may be desirable. The indication by\n the US government in 2006 that the current agreement should be the last such\n agreement with ICANN was largely welcomed by the international community\n (including the EU). At the same time, the US government has consistently\n indicated that it will maintain effective control of the coordination of key\n global naming and addressing functions and this is likely to mean that the\n problem regarding the ‘unilateral oversight’ of such resources will remain\n unresolved. The document discusses the question of accountability in the\n ICANN context. Accountability means an organisation such as ICANN being\n answerable for its decisions. ICANN has recently devoted significant efforts\n to reviewing arrangements for its internal accountability — i.e. the\n accountability to those who actively participate in each of the various ICANN\n constituencies. The problem is that the vast majority of Internet users do\n not participate in ICANN activities. There is therefore a need to ensure that\n ICANN is accountable externally to the global Internet community, which in\n the first instance (partly by virtue of the absence of alternatives in many\n countries) means being accountable externally to the governments of the\n various countries of the world. The only external accountability that ICANN\n currently has is to the US government under the JPA and the IANA contract,\n but this provides only for unilateral accountability to a single government.\n The stability and management of the root zone file is, however, a matter of\n crucial importance not just to the US government but to all countries of the\n world. However, there is no international consensus on the creation of a new\n intergovernmental organisation to exercise such oversight or on the\n delegation of such responsibilities to any existing organisation. An\n alternative would be to make ICANN externally accountable so that each\n government can exercise in their own interest those responsibilities which\n should properly sit at their level.
(3) Moving\n the agenda forward: the Commission proposes that\n the EU should actively engage its international partners in discussions on\n how to stimulate and support intergovernmental dialogue and cooperation\n to implement the public policy principles agreed for Internet governance in\n the WSIS beyond the existing work carried out through action lines. The\n starting point for such discussions should be the need to maintain private-sector\n leadership in all matters of the day-to-day management of the Internet. The\n multi-stakeholder process must also be encouraged wherever possible. At the\n same time, public policies for key global Internet resources (especially\n those that require global coordination) need to be based on multilateral\n intergovernmental cooperation. One element of an evolution of the current\n governance system could be the completion of an internal ICANN reform\n leading to full accountability and transparency. As regards external\n accountability, the current arrangements for unilateral oversight in regard\n to ICANN and IANA need to be replaced with an alternative mechanism to ensure\n that ICANN has multilateral accountability. This should be part of an\n evolutionary approach to allow governments to duly exercise their\n responsibilities. In this context, the question will need to be addressed of\n how to ensure that the legal character of ICANN’s incorporation in California does not prevent proper account being taken of governmental input.
In addition,\n the EU should take a leadership role in working towards the goal of increased\n security and stability of the Internet by initiating dialogue with\n international partners.
Lastly, the\n Commission proposes that the EU should seek to initiate discussions with the US government on how a more equitable arrangement might be found for oversight of the\n management of IANA which respects the national priorities of the US while at the same time reflecting the legitimate expectations and interests of the\n international community.
\nThe presidency\n briefed delegations on recent activities concerning Internet governance under\n the Swedish Presidency.
Two main\n events have marked the discussions this autumn, namely the new\n \"affirmation of commitment\" between the US Department of Commerce\n and the Internet Corporation for Assigned Names and Numbers (ICANN), which\n came into force on 1 October, and the 4th meeting on the Internet Governance\n Forum (IGF) in Egypt in November 2009.
\nThe Committee\n on Industry, Research and Energy adopted the report by Francisco SOSA WAGNER\n (NI, ES) in response to the Commission communication entitled “internet\n governance: the next steps”.
The committee\n considers that the internet is a global public\n good and, as such, its governance should be exercised in the common\n interest. It recognises that the internet is essential for the practical\n exercise of freedom of expression, cultural diversity, media pluralism and\n democratic citizenship, as well as for education and access to information,\n thus constituting one of the principal vectors for the dissemination of\n democratic values in the world.
Reiterating\n that access to the internet both guarantees and depends upon the exercise\n of a number of key fundamental rights, the committee underlines that\n institutions and stakeholders at all levels, therefore, have a general\n responsibility to assist in ensuring that everyone can exercise their right\n to participate in the information society while simultaneously attacking the\n twin challenges of e-illiteracy and democratic exclusion in the electronic\n age.
Members\n welcome the fact that the Commission understands the importance of “bridging\n the digital divide” and the development issues involved in internet\n governance. However, while they note that the internet can be an effective\n tool of social inclusion, our older citizens must be included. They\n therefore urge that action be taken to promote education on the use of\n the resources offered by the internet and the selection of criteria on how to\n use those resources.
Members\n recognise that the intensified use of the internet by citizens, consumers,\n companies and authorities implies that this communication instrument is\n becoming one of the fundamental elements of the completion of the internal\n market within the EU. In this context, they stress the need for appropriate\n protection of consumers and intellectual property rightsholders\n on the internet, as well as the fact that internet users’ civil rights and\n freedoms must be guaranteed.
The committee emphasises that internet governance should facilitate e-commerce\n and cross-border transactions by decentralising the self-regulatory roles,\n especially in setting entry conditions for new competitors.
It also calls\n for easier access to and development of the internet in newer Member States,\n particularly in rural areas, and in developing countries, through programmes\n funded by the EU.
To safeguard\n the EU interest in maintaining the internet as a global public good, Members\n consider that internet governance should be based on a broad, balanced\n public-private sector model, avoiding dominance by any individual entity\n or group of entities and attempts by state or supra-national authorities to\n control the flow of information on the internet, while interacting with\n multi-stakeholder processes on internet governance which continue to provide\n an effective mechanism for promoting global cooperation.
Members call\n on the European Commission and the Member States to ensure that all\n activities related to internet governance comply with the EU’s values and\n goals, as laid down in the TEU, in particular in those global internet\n governance fora where countries whose values differ greatly from those of\n Europe take part. They consider that, in the interest of avoiding conflict, international\n dialogue should be stepped up with these countries in the area of\n internet regulation.
They consider\n that governments should focus on issues vital to global internet public\n policy as private sector leadership needs to be based on respect for public\n policy principles and existing legislation and otherwise adhere to a\n principle of non-intervention, except as may be necessary in exceptional\n circumstances, and that, even then, their action should respect fundamental\n human rights and the proportionality principle
The committee\n stresses that any restrictions deemed indispensable should be limited to the\n minimum necessary in a democratic society, should be based on law, and should\n be effective and proportionate. It further emphasises that protection of\n minors must be guaranteed, and invites Member States to also take\n measures to enable minors to make responsible use of internet and on-line\n information services, and to improve the level of awareness of potential\n threats posed by new services.
It calls,\n moreover, for more initiatives to strengthen the safe exploration of the\n internet by children, to disseminate best practices worldwide and to\n reinforce international cooperation in the fight against harmful and illegal\n content online, particularly with regard to the sexual abuse of children. It\n reiterates that, when combating cybercrime and child pornography, criminal\n content should be deleted at the source before considering websites being\n blocked.
MEPs stress\n that the EU should address three critical public policy issues: i)\n protection of internet infrastructure to safeguard openness, availability,\n security and resilience against cyber attacks; ii) European dependence on\n dominant market solutions and associated public security risks, and iii)\n protection of data and privacy, in particular, as regards the establishment\n of effective international mechanisms for dispute resolution. They,\n therefore, call on the Commission to submit a proposal for the adaptation\n of the Data Protection Directive to the current digital environment.
Members urge\n all Member States that have not done so already to ratify and implement the\n Council of Europe Convention on Cybercrime, as well as to ratify and\n implement the Council of Europe Convention on the Prevention of Terrorism\n which would allow the development of a basis for international cooperation\n in countering the terrorist use of the internet in the form of\n large-scale attacks on and through computer systems which threaten national\n security, public safety or economic well-being.
The committee\n recommends, in addition, that the Commission and Member States work towards enhanced\n security and stability of the internet through measures aimed at\n increasing network and system diversity through the application of competition\n law, EU standards and procurement policy, as well as by: i) supporting\n ICANN’s work on security and stability of the domain name system, ii)\n supporting work in international fora, such as the OECD, the UN and the\n Council of Europe on improved legislative frameworks and national\n coordination.
It also\n stresses that the success of social networks, together with the\n internet’s technical capacities in terms of memory and data processing, is\n giving rise to problems of data retention and the use of archived data;\n deplores the fact, in this respect, that there is currently no “right to\n forget” on the internet.
Members\n consider there is a need to find a suitable balance between protecting\n users’ privacy and recording personal data. They deplore the fact that increasing\n use of internet networks does not yet go hand in hand with rules allowing\n users to manage the personal data they put on those networks.
They call on\n the Commission to present a proposal to extend the application of Regulation\n (EC) No 864/2007 on the law applicable to non-contractual obligations (Rome\n II) to include violations of data protection and privacy, and on the\n Council to authorise negotiations with a view to concluding an international\n agreement enabling effective redress by EU individuals in case of violations\n of their rights under EU law to data protection and privacy.
The committee\n points out that website security certification is becoming necessary to give\n consumers greater confidence in accessing online information and services.
It stresses\n the role of the European Network and Information Society Agency (ENISA) in\n the creation of a single European information space and, in particular, with\n respect to preventing, addressing and responding to network and information\n security problems. It underlines the need to further increase the\n effectiveness of ENISA by: i) identifying the research priorities, on a\n European level, in the areas of networking resilience and in network and\n information security, and offering knowledge of industry needs to potential\n research institutions; ii) drawing the attention of decision-makers to new\n technologies in security-related areas; and iii) developing forums for\n information-sharing and provide support to Member States.
