PROPOSED ACT: Council Decision.
BACKGROUND: joint national and European\n efforts in the area of research and training are essential to promote and\n ensure economic growth and the well-being of citizens in Europe. Under\n Article 7 of the Euratom Treaty, the Euratom Framework Programme is the\n Community’s main instrument for supporting and complementing Member States’\n activities in nuclear research and development (R&D). The existing\n provisions are contained in Council Decision 2006/970/Euratom on the Euratom\n Framework Programme and they will expire at the end of 2011.
The principal aim of this proposal is to\n ensure the continuation of EU-funded research in these fields for a\n further two years in line with the activities carried out successfully\n during 2007-2011.
In accordance with the Council Decision\n concerning the Framework Programme of the European Atomic Energy Community\n for nuclear research and training activities (2012-2013), the Framework\n Programme (2012-2013) is to be implemented through specific programmes\n that define detailed rules for their implementation, fix their duration and\n provide for the means deemed necessary. The Framework Programme (2012 - 2013)\n comprises two types of activities: indirect actions in fusion energy\n research and research on nuclear fission and radiation protection, and direct\n actions for activities of the Joint Research Centre in the field of\n nuclear energy.
It should be noted that this proposal is\n closely linked to the proposal on the Framework Programme of the European\n Atomic Energy Community for nuclear research (2012 -2013), the proposal on the\n rules for the participation of\n undertakings, research centres and universities in indirect actions under the Framework\n Programme and the specific programme, to be carried out by means of direct actions, implementing the\n Framework Programme.
IMPACT ASSESSMENT: in accordance with\n Article 21 of the Implementing Rules for the Financial Regulation (Commission\n Regulation N° 2342/2002), the Commission has prepared an ex ante evaluation. Since\n this proposal aims to continue the activities of the Euratom Framework\n Programme for 2012-13 under the same financial perspectives, the requirement\n for an Impact Assessment has been waived.

The\n multi-annual work programme will take account of relevant research activities\n carried out by Member States, associated states and European and\n international organisations. It will be updated where appropriate.
Ethical aspects: the proposal states that\n during the implementation of the specific programme and in the research\n activities arising from it, fundamental ethical principles are to be\n respected. These include the principles enshrined in the Charter of\n Fundamental Rights of the European Union. In compliance with the principle of\n subsidiarity and given the diversity of approaches in Europe, participants in\n research projects must conform to the current legislation, regulations and\n ethical rules in the countries where the research will be carried out. In any\n case, national provisions apply and no research forbidden in any given Member State or other country will be supported by Euratom funding in that Member State or country.
BUDGETARY\n IMPLICATION: the total amount in commitment and payment appropriations for DG\n JRC is EUR 233 216 000.
\nThe Committee on Industry, Research and Energy\n adopted the report by Jan BREZINA (EPP, CZ) on the proposal for a Council\n decision concerning the specific programme, to be carried out by means of\n direct actions by the Joint Research Centre, implementing the Framework\n Programme of the European Atomic Energy Community for nuclear research and\n training activities (2012 to 2013).

\nFunding: new recitals\nstate that the JRC should aid in the supervision of the quality and\nefficiency of training, as well as the coordination of existing\neducational programmes in the field of nuclear energy within the\nUnion, and within candidate and neighbouring countries. Increased\nattention and budget spending are needed for initiatives ancillary\nto core nuclear research, in particular as regards investment in\nhuman capital and actions aimed at addressing the risk of skills\nshortages in the coming years (e.g. grants to researchers in the\nnuclear field) and the consequent loss of leadership for the\nUnion.
\nIn addition, the management of Union research funding\nshould be more trust-based and risk-tolerant at all stages of the\nprojects, while ensuring accountability, with flexible Union\nrules.
\nSpecial attention should be paid to the development of\ncontractual arrangements that reduce the risk of failure to perform\nas well as the reallocation of risks and costs over\ntime.
\nActivities under the programme: Parliament added decommissioning to the types of\nactivities which will be supported under this specific\nprogramme.
\nWork programme: the\nCommission, in its setting out of the multi-annual work programme\nfor the implementation of the specific programme, must also set out\nthe necessary funds when specifying in greater detail the\nobjectives and technological priorities of the\nprogramme.
\nAnnex: Parliament\ndeleted basic actinide research from the activities listed in the\nAnnex. It also adds the following:
\n\n· \nthe JRC will continue, in collaboration with its\ninternational partners, to develop networks for measuring\nradioactivity in the environment while making all findings\nimmediately available to the public;
\n\n· \nwith regard to the JRCs activities on\ndrinking water, this will take into account the Council directive,\nto be adopted pursuant to Article 31 of the Euratom Treaty, laying\ndown requirements for the protection of the health of the general\npublic with regard to radioactive substances in water intended for\nhuman consumption;
\n\n· \nin view of the growing importance of\ndecommissioning of nuclear reactors and the associated expanding\nmarket and engineering aspects, the JRC will also enhance its\nscientific expertise in the field. It will include in its programme\nkey aspects on research and training of experts on decommissioning\nof reactors (methodologies, on-the-job training, and scientific\nbackground).
\nLastly, a new recital states that the implementation\nof the Framework Programme (2012-2013) should be based on the\nprinciples of simplicity, stability, transparency, legal certainty,\nconsistency, excellence and trust following the recommendations of\nthe European Parliament in its Report on simplifying the\nimplementation of the Research Framework Programmes.
\nPURPOSE: to adopt the specific programme, to be\ncarried out by means of direct actions by the Joint Research\nCentre, implementing the Framework Programme of the European Atomic\nEnergy Community for nuclear research and training activities (2012\nto 2013).
\nNON-LEGISLATIVE ACT: Council Decision\n2012/95/Euratom concerning the specific programme, to be carried\nout by means of direct actions by the Joint Research Centre,\nimplementing the Framework Programme of the European Atomic Energy\nCommunity for nuclear research and training activities\n(2012-2013).
\nCONTENT: the Council extended, for a\ntwo-year period, the European Atomic Energy Community\n(Euratom) framework programme for nuclear research and training\nactivities. The Euratom programme, which expires at the end of\n2011, has been extended in order to align it with the end of the\nEU's current financial cycle in 2013.
\nIt should be noted that this Decision is closely\nlinked to the proposal on the Framework Programme of\nthe European Atomic Energy Community for nuclear research (2012\n-2013), the proposal on the rules for the\nparticipation of undertakings, research\ncentres and universities in indirect actions under the Framework\nProgramme and the specific programme, to be carried out by means of\ndirect actions,\nimplementing the Framework Programme.
\nThe Council Decision concerns the adoption of\nthe specific programme, to be carried out by means of direct\nactions by the Joint Research Centre (JRC), implementing the\nFramework Programme of the European Atomic Energy Community for\nnuclear research and training activities (2012 to 2013). The\nprogramme is to be adopted for the period from 1 January 2012 to 31\nDecember 2013.
\nThematic areas: the specific programme shall\nestablish the activities for the nuclear actions of the JRC,\nsupporting the whole range of research actions carried out in\ntrans-national cooperation in the following thematic\nareas:
\nThis specific programme should be implemented\nin a flexible, efficient and transparent manner, taking into\naccount the relevant needs of the JRC users and Union policies,\nwhile protecting the Union financial interests. The research\nactivities carried out under this specific programme should be\nadapted where appropriate to these needs and to scientific and\ntechnological developments and aim to achieve scientific\nexcellence.
\nIn the context of\nenlargement and\nintegration activities, the JRC aims to promote the integration of\nthe organisations and researchers of new Member States within its\nactivities in particular for implementing of the science and\ntechnology components of the Union acquis, as well as increased\ncooperation with organisations and researchers from accession and\ncandidate countries. A progressive opening should also be envisaged\ntowards the neighbouring countries, specifically on priority topics\nof the European Neighbourhood Policy.
\nEthical issues: research activities carried out\nwithin this specific programme should respect fundamental ethical\nprinciples, including those reflected in the Charter of Fundamental\nRights of the European Union.
\nFinancial envelope: the\nmaximum amount for the execution of the specific programme is\nEUR 233 216 000.
