PURPOSE: to\nconclude the Agreement in the form of an Exchange of Letters\nbetween the EU and Russia relating to the administration of\ntariff-rate quotas applying to exports of wood from the Russia to\nthe EU and the Protocol between the EU and the Government of Russia\non technical modalities pursuant to that Agreement.
\nPROPOSED ACT:\nCouncil Decision.
\nBACKGROUND: the Agreement in the form of an Exchange\nof Letters between the European Union and Russia relating to the\nadministration of tariff-rate quotas applying to exports of wood\nfrom Russia to the European Union and the Protocol between the\nEuropean Union and the Government of Russia on technical modalities\npursuant to that Agreement, were signed and subject to their\nconclusion.
\nIt is now necessary to approve the Agreement and the\nProtocol.
\nIMPACT ASSESSMENT: no impact assessment was\ncarried out.
\nLEGAL BASE: the first subparagraph of Article\n207(4) in conjunction with Article 218(6)(a) of the Treaty on the\nFunctioning of the European Union (TFEU).
\nCONTENT: in the context of the process of its\naccession to the WTO, Russia has agreed to reduce its currently\napplied export duty rates on raw wood products. For certain types\nof wood, namely some coniferous wood species, Russia has\nagreed to open tariff-rate quotas for exports of those products and\nallocate a specific quota share to the EU. The quotas have been set\nat a level that is relatively large for the EU at least in\nconsideration of expected demand during the first periods of\napplication. The export duty rates and tariff-rate quotas, as well\nas the share of those quotas allocated to exports to the EU, have\nbeen included in Russia's Schedule of Concessions, which will be\nannexed to Russia's WTO accession Protocol.
\nA bilateral agreement, in the form of an\nexchange of letters, negotiated between the EU and the Russian\nFederation establishes general provisions on the implementation\nof the share of the tariff-rate quotas for exports of wood products\nconcerned to the EU. In particular, the Agreement provides that\nquantities of the EU share of the tariff-rate quotas shall be\nmanaged by the EU, and that the Russian Federation shall issue\nexport licences based on the relevant import documentation issued\nby the EU.
\nThe Agreement also provides for the elaboration by the\nEU and the Russian Federation of more detailed technical modalities\non the management of the tariff-rate quotas by the entry into force\nof the Agreement. Such technical modalities are contained in a\nProtocol, negotiated between the EU and the Government of the\nRussian Federation (hereinafter referred to as the \"Protocol\"). The\nProtocol establishes the rules regarding the management of the\nexport tariff-rate quotas and of exports within those quotas,\nincluding provisions on the cooperation of the competent\nauthorities of the European Union and the Government of the Russian\nFederation necessary to ensure the adequate operation of the\nsystem.
\nIn order to ensure the effective application of the\nmanagement system provided for in the Agreement and the Protocol by\nthe time of the accession of the Russian Federation to the WTO, the\nAgreement and the Protocol should be applied provisionally from the\ndate of such accession.
\nImplementing provisions:\nin order to ensure uniform conditions for the implementation of the\nprovisions of the Agreement and the Protocol regarding the\nmanagement of the tariff-rate quotas applying to exports of wood\nfrom the Russian Federation to the Union, implementing powers\nshould be conferred on the Commission. Those powers should be\nexercised in accordance with Regulation (EU) No 182/2011\nof the European Parliament and of the Council laying down the rules\nand general principles concerning mechanisms for control by the\nMember States of the Commission's exercise of implementing\npowers.
\nBUDGET IMPLICATION: the proposal has no implication\nfor the EU budget.
\nThe Committee on International Trade adopted the\nreport drafted by Inese VAIDERE (EPP, LV) in which it recommends\nthe European Parliament to give its consent to the conclusion of\nthe Agreement in the form of an Exchange of Letters between the\nEuropean Union and the Russian Federation relating to the\nadministration of tariff-rate quotas applying to exports of wood\nfrom the Russian Federation to the European Union and the Protocol\nbetween the European Union and the Government of the Russian\nFederation on technical modalities pursuant to that\nAgreement.
\nMembers recall that the EU has a strong offensive\ninterest in this agreement as it provides for significant\nimprovement in the supply of wood from Russia. It is paramount\nto avoid recurrence of the consecutive increases of wood export\nduties applied by Russia since 2007 which affected many EU\nproducers. The agreement brings more predictability and better\ntrade conditions.
\nThe European Parliament adopted a legislative\nresolution on the draft Council decision on the conclusion of the\nAgreement in the form of an Exchange of Letters between the\nEuropean Union and the Russian Federation relating to the\nadministration of tariff-rate quotas applying to exports of wood\nfrom the Russian Federation to the European Union and the Protocol\nbetween the EU and the Government of the Russian Federation on\ntechnical modalities pursuant to that Agreement.
\nParliament gave its consent\nto conclusion of the Agreement and of the Protocol.

\nBACKGROUND: in accordance with Council Decision\n2012/105/EU, the Agreement in the form of an Exchange of\nLetters between the European Union and Russia\nrelating to the administration of tariff-rate quotas applying to\nexports of wood from Russia to the EU and the Protocol between the\nEU and Russia on technical modalities pursuant to that Agreement,\nwere signed on 16 December 2011, subject to their\nconclusion.
\nThe Agreement and the Protocol should now be approved\non behalf of the EU.
\nCONTENT: with this Decision, the Agreement in the form\nof an Exchange of Letters between the European Union and the\nRussian Federation relating to the administration of tariff-rate\nquotas applying to exports of wood from the Russian Federation to\nthe European Union, and the Protocol between the European Union and\nthe Government of the Russian Federation on technical modalities\npursuant to that Agreement are hereby approved on behalf of the\nUnion.
