PURPOSE: to establish a new instrument for nuclear\nsafety cooperation (INSC) from 2014 to 2020 in the framework of the\nreform of the EU external action financial instruments and\nfollowing on from the Instrument for Nuclear Safety\nCooperation 2007-2013.
\nPHILOSOPHY AND ACTION PLAN FOR EXTERNAL AID 2014-2020:\nwhat happens outside the borders of the EU can and does directly\naffect the prosperity and security of EU citizens. It is therefore\nin the interest of the EU to be actively engaged in influencing the\nworld around us, including through the use of financial\ninstruments. The Lisbon Treaty marks, in this regard, a new\ndeparture in the EUs relations with the rest of the\nworld.
\nThe EU's engagement needs to be tailored to\nindividual circumstances. Its partners range from development\neconomies to the least developed countries in need of specific\nassistance from the EU.
\nIn general, the overall objective for external action\nfor the period 2014-2020 may be summarised as follows:
\nA\nmajor rationalisation of the instruments took place in 2003 and has\nbegun to deliver more effective results. The Commission does not\nconsider that another major alteration of the legislative\narchitecture is necessary for the next MFF period, although\nsome improvements are being proposed and the overall investment is\nbeing stepped up.
\nThe Commission proposes to allocate EUR 70 billion\nfor the 2014-2020 period for external instruments broken down as\nfollows:
\nIn parallel and for the first time, the Commission\nproposes a single horizontal regulation establishing common rules and\nprocedures for the implementation of the\nUnions instruments for external action.
\nPROPOSED ACT: Council Regulation.
\nBACKGROUND: since the early 1990s, support for the\npromotion of nuclear safety and nuclear safeguards in third\ncountries has been an essential part of the Communitys work,\nboth in Central Europe and in the countries of the former Soviet\nUnion, under the nuclear safety programme components of the TACIS\nand PHARE programmes. From 2007, nuclear safety cooperation was\nextended to include third countries under the\nInstrument for Nuclear Safety Cooperation, while the Instrument for\nPre-Accession Assistance (IPA) provided for nuclear safety\ncooperation with the countries engaged in the process of accession\nto the EU.
\nThe Chernobyl accident in 1986 highlighted the global\nimportance of nuclear safety. The Fukushima Daiichi accident in\n2011 confirmed the need to continue the efforts to improve\nnuclear safety to meet the highest standards.
\nThe Community already pursues close cooperation, in\naccordance with Chapter 10 of the Euratom Treaty, with the\nInternational Atomic Energy Agency (IAEA), in relation both to\nnuclear safeguards and to nuclear safety.
\nIn order for the European Union to fulfil its role as\na global player in the promotion of human and strategic security,\nit is essential that the Community should have the capability and\nmeans to respond to challenges arising in the field of nuclear\nsafety, radiation protection and nuclear safeguards in any third\ncountries, building on the experience of the Community and of its\nMember States in these fields within the European Union.
\nWith this in mind, the proposed Instrument for Nuclear\nSafety Cooperation (INSC) will continue the actions initiated in\nthe 1990s in Central Europe and in the countries of the former\nSoviet Union, which have been extended since 2007 to third\ncountries.
\nRemediation of mining sites (the legacy of uranium\nmining which did not respect basic environmental requirements),\ndisposal of spent fuel, waste management and decommissioning of\ninstallations will need to be dealt with as a programme\npriority.
\nThe Commission's intervention is being shifted from\ntechnical assistance to cooperation. It focuses on\nactivities designed to improve nuclear safety radiation protection\nand safeguards, including studies, development of legislation,\ninstitution building, improvement of procedures and methodologies,\nincluding for the safe management of radioactive waste and spent\nnuclear fuel. Given the international commitments related to\nnuclear safety improvements, cooperation under the INSC should\nfurther exploit synergies with the Euratom Framework Programmes on\nnuclear research and training activities.
\nIMPACT ASSESSMENT: the Commission carried out an\nImpact Assessment, which reviewed four options as\nfollows:
\nThe option to amend the Regulation was found to be the\npreferred one. In comparison with the\noptions of 'no change' and 'a new Instrument', it would allow\ncontinuity and using the experience of a well tried system, while\nresolving a number of issues which have been identified.
\nLEGAL BASIS: Article 203 of the Treaty establishing\nthe European Atomic Energy Community (Euratom Treaty).
\nCONTENT: with this proposed Regulation, the Commission\nproposes to establish an Instrument for Nuclear Safety Cooperation\nwhich will support the promotion of a high level of nuclear safety,\nradiation protection and the application of efficient and effective\nsafeguards in third countries worldwide that are seeking\ncooperation in these fields.
\nObjectives: three\nspecific objectives are established:
\nThe overall progress in achieving the above specific\nobjectives shall be assessed, respectively, through the following\nperformance indicators set out in the proposal. Specific measures\nsupported by this Regulation and criteria applying to nuclear\nsafety cooperation are detailed in the Annex.
\nThird countries concerned: the Annex sets out the countries which will benefit\nfrom the present instrument. Two types of countries will be\nconcerned:
\nProgramming and indicative allocation of\nfunds: this Title includes two\nparts:
\nImplementation: \nthe implementation has been greatly simplified as an Article\nstipulates that the decision shall be implemented in accordance\nwith the future Regulation establishing common implementation rules\nfor external relations financing instruments.
\nBUDGETARY IMPLICATIONS: in accordance with the Multiannual Financial Framework for\n2014-2020, the Commission proposes to allocate\n70 billion for the period 2014-2020 for the external\ninstruments. The allocation earmarked for the INSC over the period\n2014 to 2020 is EUR 631.1 million (EUR 560 million at 2011\nprices).
\nThe Committee on Industry, Research and Energy\nadopted, in the context of a special legislative procedure\n(consultation of the European Parliament), the report by Holger\nKRAHMER (ALDE, DE) on the proposal for a Council Regulation\nestablishing an Instrument for Nuclear Safety\nCooperation.
\nThe parliamentary committee approves the\nCommissions proposal subject to the following\namendments:
\nStrengthening the upholding of nuclear safety\nstandards: as long as existing\nnuclear power stations remain in operation and new ones are being\nbuilt, this instrument should aim to ensure that the level of\nnuclear safety in assisted countries reflects European safety\nstandards, that such standards are upheld and that support for\nindependent supervisory authorities is made a main\npriority.
\nNuclear safety governance: Members stress that a\nnumber of countries around the world are considering or planning to\nbuild nuclear power plants, which brings about a wide range of\nchallenges and the need for creating adequate nuclear safety\ncultures and governance systems. It is necessary to find\nways of improving the safety and security of nuclear power plants\nbeing developed close to the Union's borders, in particular where\nthere is a lack of political cooperation with the Union. In this\nregard, stress tests should be carried out in all Member\nStates and third countries concerned in order to detect potential\nsafety hazards and the necessary measures to correct them should be\nimplemented immediately. By acting within common policies and\nstrategies with its Member States and by cooperating with\ninternational and regional organisations, the European Union is\nwell placed to respond to global challenges and to coordinate\ncooperation with third countries. Priority should be given to\nensuring support from independent supervisory authorities and to\nsupporting their regulators, as well as multilateral regional and\ninternational structures which can strengthen confidence and the\napplication of standards through peer review mechanisms.
\nMain objective: civilian nuclear: Members stipulate that the European Union finances\nmeasures seeking to support the promotion of a high level of\nnuclear safety, radiation protection and the application of\nefficient and effective safeguards of nuclear material in third\ncountries, in line with the provisions of this Regulation.\nThis will ensure that nuclear material is used only for the\ncivilian purposes for which it is intended.
\nSpecific objectives: among the specific objectives of the programme,\nMembers add the responsible and safe management of spent fuel and\nradioactive waste, decommissioning and remediation of former\nnuclear sites and installations in third countries.\nThe programmes objectives are: (i) the degree to which the\nassisted countries develop the highest nuclear safety standards\nwhich are similar to the levels required in the Union regarding\ntechnical, regulatory and operational respects; (ii) status of\ndevelopment of the spent fuel, nuclear waste and decommissioning\nstrategies, the number of and the scale of the remediation required\nin former nuclear sites and installations, the respective\nlegislative and regulatory framework and implementation of\nprojects; (iii) long-term impact on the environment.
\nFinanced measures: the\nobjectives shall be achieved primarily through the following\nmeasures:
\n(a) support for\nregulatory bodies to ensure their independence, competence and\ndevelopment and for investment in human resources;
\n(b) support for\nmeasures to strengthen and implement the legislative framework;
\n(c) support for the\ndesign and implementation of safety assessment systems based on\nstandards similar to those applied in the European Union;
\n(d) cooperation in\nthe following areas: expertise, experience and skills development,\naccident management procedures and accident prevention, strategies\nfor responsible and safe management of spent fuel and\ndecommissioning strategies.
\nThe measures shall\ninclude a substantial element of knowledge transfer\n(expertise sharing, support for both existing or new education and\ntraining programmes in the area of nuclear safety) in order to\nreinforce sustainability of the results achieved.
\nSpecific measures\nsupported by this Regulation and criteria applying to nuclear\nsafety cooperation are detailed in the Annex.
\nThe financial,\neconomic and technical cooperation provided under this Regulation\nshall be complementary to that provided by the Union under other\ndevelopment cooperation instruments.
\nEligible countries: in\nproviding aid under this instrument, priority shall be given to\ncountries beneficiaries of the Instrument for Pre-Accession\nAssistance and the European Neighbourhood Instrument.
\nFinancial envelope: Members point out that the financial envelope\nspecified in the legislative proposal constitutes only an\nindication to the legislative authority and cannot be fixed until\nagreement is reached on the proposal for a regulation laying down\nthe multiannual financial framework for the years\n2014-2020.
\nSpecific supported\nmeasures:
\n(a) The\nestablishment and promotion of an effective nuclear safety culture\nand governance and implementation of the highest nuclear safety\nstandards that reflect state of the art practices and radiation\nprotection at all levels, in particular through:
\n(b) Responsible and safe management of spent fuel\nand radioactive waste, decommission and remediation of former\nnuclear sites and installations;
\n(c) Assistance for ensuring a high level of\ncompetence and expertise of regulators, technical support\norganisations and operators (without distortion of competition) in\nthe fields covered by this Regulation, in particular\nthrough:
\nStrengthening the consistency and complementarity of\nactions to avoid duplication: there\nis a need to ensure better coordination, consistency and\ncomplementarity of efforts in the field of nuclear safety on EU and\nnational levels, but also with other international, local and\nregional organisations, in order to avoid overlaps and maximise\nthe effects of financing.
\nIn implementing\nthis Regulation, coherence shall be ensured with other areas and\ninstruments of the Union external action, as well as other relevant\nUnion policies. The Union and the Member States shall coordinate\ntheir respective support programmes with the aim of increasing\neffectiveness and efficiency in the delivery of support and policy\ndialogue in accordance with the established principles for\nstrengthening operational coordination in the field of external\nsupport, and for harmonising policies and procedures. Coordination\nshall involve regular consultations and frequent exchanges of\nrelevant information during the different phases of the support\ncycle.
\nThe Union shall, in\nliaison with the Member States, take the necessary steps to ensure\nproper coordination and cooperation with multilateral and regional\norganisations and entities, including, but not limited to, European\nfinancial institutions, international financial institutions,\nUnited Nations agencies, funds and programmes, private and\npolitical foundations and non-Union donors.
\nThe programme shall\nbe complementary to that provided by the Union under other\ndevelopment cooperation instruments and the Framework Programme for\nResearch and Innovation (2014 - 2020) (´Horizon 2020`) and the Research and Training programme of the European\nAtomic Energy Community (2014 - 2018)\ncomplementing Horizon 2020.
\nReporting: the\nCommission shall review the progress achieved in implementing the\nmeasures taken pursuant to this Regulation and shall submit to the\nEuropean Parliament and the Council a biannual report on the\nimplementation of the cooperation assistance.
\nThe report shall contain information relating to the\nprevious two years on the measures financed, information on the\nresults of monitoring and evaluation exercises and the\nimplementation of budget commitments and payments, broken down by\ncountry, region and type of cooperation, as well as the plans of\nthird countries in the area of nuclear\nsafety.
\nThe European Parliament adopted by 565 votes to 88,\nwith 31 abstentions, in the context of a special legislative\nprocedure (consultation of the European Parliament), a legislative\nresolution on the proposal for a Council Regulation establishing an\nInstrument for Nuclear Safety Cooperation.
\nParliament approved the Commission proposal subject to\nthe following amendments:
\nStrengthening the upholding of nuclear safety\nstandards: as long as existing\nnuclear power stations remain in operation and new ones are being\nbuilt, this instrument should aim to ensure that the level of\nnuclear safety in assisted countries reflects European safety\nstandards, that such standards are upheld and that support for\nindependent supervisory authorities is made a main\npriority.
\nNuclear safety governance: Parliament stressed that a number of countries\naround the world are considering or planning to build nuclear power\nplants, which brings about a wide range of challenges and the need\nfor creating adequate nuclear safety cultures and governance\nsystems. It is necessary to find ways of improving the safety\nand security of nuclear power plants being developed close to the\nUnion's borders, in particular where there is a lack of political\ncooperation with the Union. In this regard, stress tests\nshould be carried out in all Member States and third countries\nconcerned in order to detect potential safety hazards and the\nnecessary measures to correct them should be implemented\nimmediately. By acting within common policies and strategies with\nits Member States and by cooperating with international and\nregional organisations, the European Union is well placed to\nrespond to global challenges and to coordinate cooperation with\nthird countries. Priority should be given to ensuring support from\nindependent supervisory authorities and to supporting their\nregulators, as well as multilateral regional and international\nstructures which can strengthen confidence and the application of\nstandards through peer review mechanisms.
\nMain objective: civilian nuclear: Parliament stipulated that the European Union finances\nmeasures seeking to support the promotion of a high level of\nnuclear safety, radiation protection and the application of\nefficient and effective safeguards of nuclear material in third\ncountries, in line with the provisions of this Regulation. This\nwill ensure that nuclear material is used only for the civilian\npurposes for which it is intended.
\nSpecific objectives:\namongst the specific objectives, the following have been\nincluded:
\nFinanced measures: the\nobjectives shall be achieved primarily through the following\nmeasures:
\n(a) support for regulatory bodies to ensure their\nindependence, competence and development and for investment in\nhuman resources;
\n(b) support for measures to strengthen and implement\nthe legislative framework;
\n(c) support for the design and implementation of\nsafety assessment systems based on standards similar to those\napplied in the European Union;
\n(d) cooperation in the following areas: expertise,\nexperience and skills development, accident management procedures\nand accident prevention, strategies for responsible and safe\nmanagement of spent fuel and decommissioning strategies.
\nThe measures shall include a substantial element of\nknowledge transfer (expertise sharing, support for both\nexisting or new education and training programmes in the area of\nnuclear safety) in order to reinforce sustainability of the results\nachieved.
\nSpecific measures supported by this Regulation and\ncriteria applying to nuclear safety cooperation are detailed in the\nAnnex.
\nThe financial, economic and technical cooperation\nprovided under this Regulation shall be complementary to that\nprovided by the Union under other development cooperation\ninstruments.
\nEligible countries: in\nproviding aid under this instrument, priority shall be given to\ncountries beneficiaries of the Instrument for Pre-Accession\nAssistance and the European Neighbourhood Instrument.
\nFinancial envelope: in\naccordance with the Regulation laying down the multiannual\nfinancial framework for 2014-2020, the financial reference amount\nfor the implementation of this Regulation is EUR 225\n321 000.
\nStrengthening the consistency and complementarity of\nactions to avoid duplication: there\nis a need to ensure better coordination, consistency and\ncomplementarity of efforts in the field of nuclear safety on EU and\nnational levels, but also with other international, local and\nregional organisations, in order to avoid overlaps and maximise\nthe effects of financing.
\nIn implementing this Regulation, coherence shall be\nensured with other areas and instruments of the Union external\naction, as well as other relevant Union policies. The Union and the\nMember States shall coordinate their respective support programmes\nwith the aim of increasing effectiveness and efficiency in the\ndelivery of support and policy dialogue in accordance with the\nestablished principles for strengthening operational coordination\nin the field of external support, and for harmonising policies and\nprocedures. Coordination shall involve regular consultations and\nfrequent exchanges of relevant information during the different\nphases of the support cycle.
\nThe Union shall, in liaison with the Member States,\ntake the necessary steps to ensure proper coordination and\ncooperation with multilateral and regional organisations and\nentities, including, but not limited to, European financial\ninstitutions, international financial institutions, United Nations\nagencies, funds and programmes, private and political foundations\nand non-Union donors.
\nThe programme shall be complementary to that provided\nby the Union under other development cooperation instruments and\nthe Framework Programme for Research and Innovation (2014 - 2020)\n(´Horizon 2020`) and the Research and Training programme of the European\nAtomic Energy Community (2014 - 2018)\ncomplementing Horizon 2020.
\nReporting: the\nCommission shall review the progress achieved in implementing the\nmeasures taken pursuant to this Regulation and shall submit to the\nEuropean Parliament and the Council a biannual report on the\nimplementation of the cooperation assistance.
\nThe report shall contain information relating to the\nprevious two years on the measures financed, information on the\nresults of monitoring and evaluation exercises and the\nimplementation of budget commitments and payments, broken down by\ncountry, region and type of cooperation, as well as the plans of\nthird countries in the area of nuclear\nsafety.
\nAnnexes: a series of\namendments have been made to the Annex of the future Regulation\nfollowing amendments made in Plenary.
\nPURPOSE: to establish an Instrument for Nuclear Safety\nCooperation (INSC) 2014-2020 following the Instrument for\nNuclear Safety Co-operation with third countries,\n2007-2013.
\n\nNON-LEGISLATIVE ACT: Council Regulation (Euratom) No 237/2014\nestablishing an Instrument for Nuclear Safety\nCooperation.
\n\nBACKGROUND: this Regulation is placed within the\nframework of the new multiannual financial framework (MFF)\n2014-2020 applicable to the Unions external policy and\ncooperation with third countries. The measures provided are the\nfollowing:
\n\nAll of the procedures for the implementation of\nthese instruments would be governed by specific\nRegulation adopted at the same\ntime.
\n\nCONTENT: with this Regulation, the Unions\nprovides assistance aimed at supporting the promotion of a high\nlevel of nuclear safety and radiation protection as well as the\napplication of efficient and effective safeguards of nuclear\nmaterial in third countries.
\nSpecific objectives:\ncooperation under this Regulation shall pursue the following\nspecific objectives:
\n1. the promotion of an effective nuclear safety culture\nand implementation of the highest nuclear safety and radiation\nprotection standards, and continuous improvement of nuclear\nsafety;
\n2. responsible and safe management of spent fuel and\nradioactive waste (transport, pre-treatment, treatment, processing,\nstorage and disposal, and the decommissioning and remediation of\nformer nuclear sites and installations);
\n3. the establishment of frameworks and methodologies for\nthe application of efficient and effective safeguards for nuclear\nmaterial in third countries.
\n\nTo this end, a series of specific measures have\nbeen provided detailing the scope of targets to achieve\nincluding:
\n\nThe measures may include actions to promote\ninternational cooperation, including implementation and monitoring\nof international Conventions and Treaties, knowledge transfer in\nthe area of nuclear safety and research, cooperation with the\ncompetent authorities of Member States of the Union and/or with\nthird countries' authorities, nuclear regulators and their\ntechnical support organisations, and/or relevant international\norganisations, in particular the International Atomic Energy Agency\n(IAEA).
\n\nAn Annexe also defines the criteria for\ncooperation on nuclear safety (including priorities for\naction).
\n\nFinancial envelope: in line with the multiannual financial framework,\nthe financial reference amount for the implementation of this\nRegulation over the period 2014 to 2020 is fixed at EUR 225 321\n000.
\n\nIndicative financial\nprogramming: some measures provide\nfor the implementation of the financial programming framework and\nthe allocation of funds. The cooperation under this Regulation\nshall be implemented on the basis of a general multiannual\nstrategy paper on a general basis for the cooperation for a\nmaximum period of up to seven years. This document shall have\nregard to the needs of the countries concerned, the Community's\npriorities, the international situation and the activities of the\nrespective third countries.
\n\nThe preparation of the strategy paper shall be\nsubject to the principles of aid effectiveness: (national\nownership, partnership, coordination, harmonisation, alignment to\nrecipient country or regional systems, mutual accountability and\nresults orientation). The Commission shall approve the strategy\npaper in line with the examination procedure.
\n\nMultiannual indicative programmes\nwould also be drawn up on the basis of the\nstrategy paper (with a duration of two to four years) with actions\nand funding as well as annual action programmes. Different\nadoption and implementation rules are planned according to the\ntypes of measures to be financed.
\n\nCoherence and complementarity: the Union should seek the most efficient use of\navailable resources in order to optimise the impact of its external\naction. The Commission should ensure that the measures adopted are\nconsistent with the Union's overall strategic policy framework for\nthe partner country concerned, and, in particular, with the\nobjectives of that partner country's development and economic\ncooperation policies and programmes.
\n\nProgress towards the achievement of the specific\nobjectives shall be assessed through a series of performance\nindicators defined in the Regulation.
\n\nThe cooperation provided shall be complementary\nto that provided by the Union under other instruments.
\n\nImplementation procedures: most of the implementing rules for this Regulation\nare those laid down in the Instruments for financing\nexternal action to implement EU external\npolicy.
\n\nReport: the\nCommission should review progress made in the implementation of\nthis Instrument through an annual report to be submitted to the\nEuropean Parliament and to the Council.
\nENTRY INTO FORCE: 18.03.2014. The Regulation shall\napply from 01.01.2014 until 31.12.2020.
\nPURPOSE: to establish a new instrument for nuclear\nsafety cooperation (INSC) from 2014 to 2020 in the framework of the\nreform of the EU external action financial instruments and\nfollowing on from the Instrument for Nuclear Safety\nCooperation 2007-2013.
\nPHILOSOPHY AND ACTION PLAN FOR EXTERNAL AID 2014-2020:\nwhat happens outside the borders of the EU can and does directly\naffect the prosperity and security of EU citizens. It is therefore\nin the interest of the EU to be actively engaged in influencing the\nworld around us, including through the use of financial\ninstruments. The Lisbon Treaty marks, in this regard, a new\ndeparture in the EUs relations with the rest of the\nworld.
\nThe EU's engagement needs to be tailored to\nindividual circumstances. Its partners range from development\neconomies to the least developed countries in need of specific\nassistance from the EU.
\nIn general, the overall objective for external action\nfor the period 2014-2020 may be summarised as follows:
\nA\nmajor rationalisation of the instruments took place in 2003 and has\nbegun to deliver more effective results. The Commission does not\nconsider that another major alteration of the legislative\narchitecture is necessary for the next MFF period, although\nsome improvements are being proposed and the overall investment is\nbeing stepped up.
\nThe Commission proposes to allocate EUR 70 billion\nfor the 2014-2020 period for external instruments broken down as\nfollows:
\nIn parallel and for the first time, the Commission\nproposes a single horizontal regulation establishing common rules and\nprocedures for the implementation of the\nUnions instruments for external action.
\nPROPOSED ACT: Council Regulation.
\nBACKGROUND: since the early 1990s, support for the\npromotion of nuclear safety and nuclear safeguards in third\ncountries has been an essential part of the Communitys work,\nboth in Central Europe and in the countries of the former Soviet\nUnion, under the nuclear safety programme components of the TACIS\nand PHARE programmes. From 2007, nuclear safety cooperation was\nextended to include third countries under the\nInstrument for Nuclear Safety Cooperation, while the Instrument for\nPre-Accession Assistance (IPA) provided for nuclear safety\ncooperation with the countries engaged in the process of accession\nto the EU.
\nThe Chernobyl accident in 1986 highlighted the global\nimportance of nuclear safety. The Fukushima Daiichi accident in\n2011 confirmed the need to continue the efforts to improve\nnuclear safety to meet the highest standards.
\nThe Community already pursues close cooperation, in\naccordance with Chapter 10 of the Euratom Treaty, with the\nInternational Atomic Energy Agency (IAEA), in relation both to\nnuclear safeguards and to nuclear safety.
\nIn order for the European Union to fulfil its role as\na global player in the promotion of human and strategic security,\nit is essential that the Community should have the capability and\nmeans to respond to challenges arising in the field of nuclear\nsafety, radiation protection and nuclear safeguards in any third\ncountries, building on the experience of the Community and of its\nMember States in these fields within the European Union.
\nWith this in mind, the proposed Instrument for Nuclear\nSafety Cooperation (INSC) will continue the actions initiated in\nthe 1990s in Central Europe and in the countries of the former\nSoviet Union, which have been extended since 2007 to third\ncountries.
\nRemediation of mining sites (the legacy of uranium\nmining which did not respect basic environmental requirements),\ndisposal of spent fuel, waste management and decommissioning of\ninstallations will need to be dealt with as a programme\npriority.
\nThe Commission's intervention is being shifted from\ntechnical assistance to cooperation. It focuses on\nactivities designed to improve nuclear safety radiation protection\nand safeguards, including studies, development of legislation,\ninstitution building, improvement of procedures and methodologies,\nincluding for the safe management of radioactive waste and spent\nnuclear fuel. Given the international commitments related to\nnuclear safety improvements, cooperation under the INSC should\nfurther exploit synergies with the Euratom Framework Programmes on\nnuclear research and training activities.
\nIMPACT ASSESSMENT: the Commission carried out an\nImpact Assessment, which reviewed four options as\nfollows:
\nThe option to amend the Regulation was found to be the\npreferred one. In comparison with the\noptions of 'no change' and 'a new Instrument', it would allow\ncontinuity and using the experience of a well tried system, while\nresolving a number of issues which have been identified.
\nLEGAL BASIS: Article 203 of the Treaty establishing\nthe European Atomic Energy Community (Euratom Treaty).
\nCONTENT: with this proposed Regulation, the Commission\nproposes to establish an Instrument for Nuclear Safety Cooperation\nwhich will support the promotion of a high level of nuclear safety,\nradiation protection and the application of efficient and effective\nsafeguards in third countries worldwide that are seeking\ncooperation in these fields.
\nObjectives: three\nspecific objectives are established:
\nThe overall progress in achieving the above specific\nobjectives shall be assessed, respectively, through the following\nperformance indicators set out in the proposal. Specific measures\nsupported by this Regulation and criteria applying to nuclear\nsafety cooperation are detailed in the Annex.
\nThird countries concerned: the Annex sets out the countries which will benefit\nfrom the present instrument. Two types of countries will be\nconcerned:

\nImplementation: \nthe implementation has been greatly simplified as an Article\nstipulates that the decision shall be implemented in accordance\nwith the future Regulation establishing common implementation rules\nfor external relations financing instruments.
\nBUDGETARY IMPLICATIONS: in accordance with the Multiannual Financial Framework for\n2014-2020, the Commission proposes to allocate\n70 billion for the period 2014-2020 for the external\ninstruments. The allocation earmarked for the INSC over the period\n2014 to 2020 is EUR 631.1 million (EUR 560 million at 2011\nprices).

\nSpecific objectives: among the specific objectives of the programme,\nMembers add the responsible and safe management of spent fuel and\nradioactive waste, decommissioning and remediation of former\nnuclear sites and installations in third countries.\nThe programmes objectives are: (i) the degree to which the\nassisted countries develop the highest nuclear safety standards\nwhich are similar to the levels required in the Union regarding\ntechnical, regulatory and operational respects; (ii) status of\ndevelopment of the spent fuel, nuclear waste and decommissioning\nstrategies, the number of and the scale of the remediation required\nin former nuclear sites and installations, the respective\nlegislative and regulatory framework and implementation of\nprojects; (iii) long-term impact on the environment.
\nFinanced measures: the\nobjectives shall be achieved primarily through the following\nmeasures:
\n(a) support for\nregulatory bodies to ensure their independence, competence and\ndevelopment and for investment in human resources;
\n(b) support for\nmeasures to strengthen and implement the legislative framework;
\n(c) support for the\ndesign and implementation of safety assessment systems based on\nstandards similar to those applied in the European Union;
\n(d) cooperation in\nthe following areas: expertise, experience and skills development,\naccident management procedures and accident prevention, strategies\nfor responsible and safe management of spent fuel and\ndecommissioning strategies.
\nThe measures shall\ninclude a substantial element of knowledge transfer\n(expertise sharing, support for both existing or new education and\ntraining programmes in the area of nuclear safety) in order to\nreinforce sustainability of the results achieved.
\nSpecific measures\nsupported by this Regulation and criteria applying to nuclear\nsafety cooperation are detailed in the Annex.
\nThe financial,\neconomic and technical cooperation provided under this Regulation\nshall be complementary to that provided by the Union under other\ndevelopment cooperation instruments.
\nEligible countries: in\nproviding aid under this instrument, priority shall be given to\ncountries beneficiaries of the Instrument for Pre-Accession\nAssistance and the European Neighbourhood Instrument.
\nFinancial envelope: Members point out that the financial envelope\nspecified in the legislative proposal constitutes only an\nindication to the legislative authority and cannot be fixed until\nagreement is reached on the proposal for a regulation laying down\nthe multiannual financial framework for the years\n2014-2020.
\nSpecific supported\nmeasures:
\n(a) The\nestablishment and promotion of an effective nuclear safety culture\nand governance and implementation of the highest nuclear safety\nstandards that reflect state of the art practices and radiation\nprotection at all levels, in particular through:
\n(b) Responsible and safe management of spent fuel\nand radioactive waste, decommission and remediation of former\nnuclear sites and installations;
\n(c) Assistance for ensuring a high level of\ncompetence and expertise of regulators, technical support\norganisations and operators (without distortion of competition) in\nthe fields covered by this Regulation, in particular\nthrough:

\nFinancial envelope: in\naccordance with the Regulation laying down the multiannual\nfinancial framework for 2014-2020, the financial reference amount\nfor the implementation of this Regulation is EUR 225\n321 000.
\nStrengthening the consistency and complementarity of\nactions to avoid duplication: there\nis a need to ensure better coordination, consistency and\ncomplementarity of efforts in the field of nuclear safety on EU and\nnational levels, but also with other international, local and\nregional organisations, in order to avoid overlaps and maximise\nthe effects of financing.
\nIn implementing this Regulation, coherence shall be\nensured with other areas and instruments of the Union external\naction, as well as other relevant Union policies. The Union and the\nMember States shall coordinate their respective support programmes\nwith the aim of increasing effectiveness and efficiency in the\ndelivery of support and policy dialogue in accordance with the\nestablished principles for strengthening operational coordination\nin the field of external support, and for harmonising policies and\nprocedures. Coordination shall involve regular consultations and\nfrequent exchanges of relevant information during the different\nphases of the support cycle.
\nThe Union shall, in liaison with the Member States,\ntake the necessary steps to ensure proper coordination and\ncooperation with multilateral and regional organisations and\nentities, including, but not limited to, European financial\ninstitutions, international financial institutions, United Nations\nagencies, funds and programmes, private and political foundations\nand non-Union donors.
\nThe programme shall be complementary to that provided\nby the Union under other development cooperation instruments and\nthe Framework Programme for Research and Innovation (2014 - 2020)\n(´Horizon 2020`) and the Research and Training programme of the European\nAtomic Energy Community (2014 - 2018)\ncomplementing Horizon 2020.
\nReporting: the\nCommission shall review the progress achieved in implementing the\nmeasures taken pursuant to this Regulation and shall submit to the\nEuropean Parliament and the Council a biannual report on the\nimplementation of the cooperation assistance.
\nThe report shall contain information relating to the\nprevious two years on the measures financed, information on the\nresults of monitoring and evaluation exercises and the\nimplementation of budget commitments and payments, broken down by\ncountry, region and type of cooperation, as well as the plans of\nthird countries in the area of nuclear\nsafety.
\nAnnexes: a series of\namendments have been made to the Annex of the future Regulation\nfollowing amendments made in Plenary.
\nPURPOSE: to establish an Instrument for Nuclear Safety\nCooperation (INSC) 2014-2020 following the Instrument for\nNuclear Safety Co-operation with third countries,\n2007-2013.
\n\nNON-LEGISLATIVE ACT: Council Regulation (Euratom) No 237/2014\nestablishing an Instrument for Nuclear Safety\nCooperation.
\n\nBACKGROUND: this Regulation is placed within the\nframework of the new multiannual financial framework (MFF)\n2014-2020 applicable to the Unions external policy and\ncooperation with third countries. The measures provided are the\nfollowing:
\n\nAll of the procedures for the implementation of\nthese instruments would be governed by specific\nRegulation adopted at the same\ntime.
\n\nCONTENT: with this Regulation, the Unions\nprovides assistance aimed at supporting the promotion of a high\nlevel of nuclear safety and radiation protection as well as the\napplication of efficient and effective safeguards of nuclear\nmaterial in third countries.
\nSpecific objectives:\ncooperation under this Regulation shall pursue the following\nspecific objectives:
\n1. the promotion of an effective nuclear safety culture\nand implementation of the highest nuclear safety and radiation\nprotection standards, and continuous improvement of nuclear\nsafety;
\n2. responsible and safe management of spent fuel and\nradioactive waste (transport, pre-treatment, treatment, processing,\nstorage and disposal, and the decommissioning and remediation of\nformer nuclear sites and installations);
\n3. the establishment of frameworks and methodologies for\nthe application of efficient and effective safeguards for nuclear\nmaterial in third countries.
\n\nTo this end, a series of specific measures have\nbeen provided detailing the scope of targets to achieve\nincluding:
\n\nThe measures may include actions to promote\ninternational cooperation, including implementation and monitoring\nof international Conventions and Treaties, knowledge transfer in\nthe area of nuclear safety and research, cooperation with the\ncompetent authorities of Member States of the Union and/or with\nthird countries' authorities, nuclear regulators and their\ntechnical support organisations, and/or relevant international\norganisations, in particular the International Atomic Energy Agency\n(IAEA).
\n\nAn Annexe also defines the criteria for\ncooperation on nuclear safety (including priorities for\naction).
\n\nFinancial envelope: in line with the multiannual financial framework,\nthe financial reference amount for the implementation of this\nRegulation over the period 2014 to 2020 is fixed at EUR 225 321\n000.
\n\nIndicative financial\nprogramming: some measures provide\nfor the implementation of the financial programming framework and\nthe allocation of funds. The cooperation under this Regulation\nshall be implemented on the basis of a general multiannual\nstrategy paper on a general basis for the cooperation for a\nmaximum period of up to seven years. This document shall have\nregard to the needs of the countries concerned, the Community's\npriorities, the international situation and the activities of the\nrespective third countries.
\n\nThe preparation of the strategy paper shall be\nsubject to the principles of aid effectiveness: (national\nownership, partnership, coordination, harmonisation, alignment to\nrecipient country or regional systems, mutual accountability and\nresults orientation). The Commission shall approve the strategy\npaper in line with the examination procedure.
\n\nMultiannual indicative programmes\nwould also be drawn up on the basis of the\nstrategy paper (with a duration of two to four years) with actions\nand funding as well as annual action programmes. Different\nadoption and implementation rules are planned according to the\ntypes of measures to be financed.
\n\nCoherence and complementarity: the Union should seek the most efficient use of\navailable resources in order to optimise the impact of its external\naction. The Commission should ensure that the measures adopted are\nconsistent with the Union's overall strategic policy framework for\nthe partner country concerned, and, in particular, with the\nobjectives of that partner country's development and economic\ncooperation policies and programmes.
\n\nProgress towards the achievement of the specific\nobjectives shall be assessed through a series of performance\nindicators defined in the Regulation.
\n\nThe cooperation provided shall be complementary\nto that provided by the Union under other instruments.
\n\nImplementation procedures: most of the implementing rules for this Regulation\nare those laid down in the Instruments for financing\nexternal action to implement EU external\npolicy.
\n\nReport: the\nCommission should review progress made in the implementation of\nthis Instrument through an annual report to be submitted to the\nEuropean Parliament and to the Council.
\nENTRY INTO FORCE: 18.03.2014. The Regulation shall\napply from 01.01.2014 until 31.12.2020.
