PURPOSE: alignment of\nRegulation (EC) No 774/94 with the new provisions foreseen under\nArticles 290 and 291 of the Treaty, following the entry into force\nof the Lisbon Treaty.
\nPROPOSED ACT: Regulation of the European\nParliament and of the Council.
\nBACKGROUND: Articles\n290 and 291 of the Treaty on the Functioning of the European Union\n(TFEU) distinguish two different types of Commission\nacts:
\nAs a consequence of the entry into force of the Lisbon\nTreaty, the powers conferred upon the Commission under Regulation\n(EC) No 774/94 need to be aligned to Articles 290 and 291 of the\nTreaty on the Functioning of the European Union.
\nIMPACT ASSESSMENT: there was no need for consultation of interested\nparties or for an impact analysis since the proposal to align\nCouncil Regulation (EC) 774/94 with the TFEU is an\ninter-institutional matter that will concern all Council\nRegulations.
\nLEGAL BASIS: Article 207 of the Treaty on the\nFunctioning of the European Union (TFEU).
\nCONTENT: the\nobjective of the present proposal consists in aligning Council\nRegulation (EC) No. 774/94 opening and providing for the\nadministration of certain Community tariff quotas for high-quality\nbeef, and for pigmeat, poultrymeat, wheat and meslin, and brans,\nsharps and other residues to Articles 290 and 291 of the\nTreaty.
\nBUDGETARYIMPLICATION: this proposal has no budgetary\nimplications for the EU budget.
\nThe Committee on International Trade adopted the\nreport by Vital MOREIRA (ALDE, PT) on the proposal for a regulation\nof the European Parliament and of the Council amending Council\nRegulation (EC) No 774/94 opening and providing for the\nadministration of certain Community tariff quotas for high-quality\nbeef, and for pigmeat, poultrymeat, wheat and meslin, and brans,\nsharps and other residues.
\nThe committee recommends that the European\nParliaments position in first reading following the ordinary\nlegislative procedure should amend the Commission proposal as\nfollows:
\nPowers conferred on the Commission: the committee made the following\namendments:
\n\n· \nit emphasised the need for the European\nParliament to be duly involved in preparation and implementation of\ndelegated acts;
\n\n· \nthe delegation of power shall be conferred on\nthe Commission for a period of five years (rather than for an\ninterderminate period, as the Commission had\nproposed) ;
\n\n· \nthe Commission shall draw up a report in\nrespect of the delegation of power not later than nine months\nbefore the end of the five-year period. The delegation of power\nshall be tacitly extended for periods of an identical duration,\nunless the European Parliament or the Council opposes such\nextension not later than three months before the end of each\nperiod;
\n\n· \nthe European Parliament and Council will have\nfour months (rather than two) to object to a delegated\nact.
\nWritten procedure in committee: the Commission shall be assisted by a Committee\nwithin the meaning of Regulation (EU) No 182/2011. Where the\nopinion of the committee is to be obtained by written procedure,\nthat procedure shall be terminated without result when,\nwithin the time-limit for delivery of the opinion, the chair of the\ncommittee so decides or a majority of committee members so\nrequest.
\nThe European Parliament adopted by 654 votes to 7,\nwith 13 abstentions, amendments to the proposal for a Regulation of\nthe European Parliament and of the Council amending Council\nRegulations (EC) No 774/94 opening and providing for the\nadministration of certain Community tariff quotas for high-quality\nbeef, and for pigmeat, poultrymeat, wheat and meslin, and brans,\nsharps and other residues.
\nThe matter was sent back to the committee responsible\nand the vote was postponed until a later session.
\nPowers conferred on the Commission: the main amendments are as follows:
\nWritten procedure in committee (implementing\npowers): the Commission shall be\nassisted by a Committee established by the future aligned Single\nCMO Regulation within the meaning of Regulation (EU) No 182/2011.\nThe amended text stipulates that where the opinion of the committee\nis to be obtained by written procedure, that procedure shall be\nterminated without result when, within the time-limit for delivery\nof the opinion, the chair of the committee so decides or a majority\nof committee members so request.
\nThe European Parliament adopted by 655 votes to 21,\nwith 8 abstentions, a legislative resolution on the proposal for a\nRegulation of the European Parliament and of the Council amending\nCouncil Regulations (EC) No 774/94 opening and providing for the\nadministration of certain Community tariff quotas for high-quality\nbeef, and for pigmeat, poultrymeat, wheat and meslin, and brans,\nsharps and other residues.
\nThe matter had been sent back for reconsideration to\nthe committee responsible at the plenary session of 12 September\n2013.
\nParliament adopted its position in first reading\nfollowing the ordinary legislative procedure. The amendments\nadopted in plenary are the result of an agreement between\nParliament and Council. They amend the proposal as\nfollows:
\nPowers delegated to the Commission: in order to comply with international commitments\nand where the volumes and other conditions of the quota\narrangements referred to in the\nRegulation are adjusted by the European Parliament\nand the Council or by the Council, in particular by\na Council decision concluding an agreement with\none or more third countries, the Commission shall be empowered\nto adopt delegated acts concerning the resulting amendments to the\nRegulation.
\nThe power to adopt delegated acts shall be\nconferred on the Commission for a period of five years\nfrom the date of entry into force of the Regulation and may be\ntacitly extended.
\nThe period for expressing objections to proposed\ndelegated acts shall be two months.
\nApplication of written procedure (implementing\npowers): the Commission shall be\nassisted by the Committee for the Common Organisation of the\nAgricultural Markets established by Article 229 of Regulation (EU)\nNo 1308/2013 of the European Parliament and of the Council.\nThat Committee shall be a committee within the meaning of\nRegulation (EU) No 182/2011.
\nThe amended text states that where the opinion of the\ncommittee is to be obtained by written procedure, that procedure\nshall be terminated without result when, within the time-limit for\ndelivery of the opinion, the chair of the committee so decides or\nat least a quarter of committee members so request.
\nPURPOSE: to align the provisions of Regulation (EC) No\n774/94 with the new rules of the Treaty on the Functioning of the\nEuropean Union (TFEU) (Commission delegated and implementing\npowers).
\nLEGISLATIVE ACT: Regulation (EU) No 252/2014 of the\nEuropean Parliament and the Council amending Regulation (EU)\nNo 774/94 as regards the implementing and delegated powers to be\nconferred on the Commission.
\nCONTENT: this amendment aims to align the powers\nconferred on the Commission under Regulation (EC) No 774/94 on the\nnew rules of the TFEU which introduced a distinction between the\ndelegated powers (Article 290) and the implementing powers of the\nCommission (Article 291).
\nCouncil Regulation (EC) No 774/94 provides for the\nadministration of certain Community tariff quotas for high-quality\nbeef, and for pigmeat, poultrymeat, wheat and meslin, and brans,\nsharps and other residues.
\nThe amending Regulation delegates to the Commission\nthe power to adopt acts in respect of the adoption of\namendments to that Regulation, should the volumes and other\nconditions of quota arrangements be adjusted, in particular by a\nCouncil decision to conclude an agreement with one or more third\ncountries.
\nThe power to adopt delegated acts shall be conferred\non the Commission for a period of five years (renewable) from 9\nApril 2014. The European Parliament or the Council may raise\nobjections in regard to a delegated act within two months of\nnotification of that act (this period may be extended by two\nmonths).
\nThe Regulation also confers implementing powers\non the Commission in order to ensure uniform conditions for the\nimplementation of Regulation (EC) No 774/94 in respect of the rules\nnecessary for the quota arrangements referred to in that\nRegulation. In this context, the Commission shall be assisted by\nthe Committee for the Common Organisation of the Agricultural\nMarkets established by Article 229 of Regulation (EU) No 1308/2013\nof the European Parliament and of the Council.
