\nThe Commission indicated in its Communication on State aid Modernisation of 8\nMay 2012 that State aid enforcement should focus\non cases with the biggest impact on the internal market. This\nimplies:
\nIMPACT ASSESSMENT: no impact assessment was carried\nout.
\nLEGAL BASIS: Article 109 TFEU, which allows the\nCouncil to make any appropriate regulations, in particular to\ndetermine the conditions in which Article 108(3) TFEU shall apply,\nand the categories of aid exempted from that procedure. \nCONTENT: this proposal is a key element in State\nAid Modernisation (SAM), an initiative launched by Commission.\nIt should contribute to the overall objectives of the Union, in\nparticular the objective of focusing State aid enforcement on cases\nhaving the biggest impact on the internal market and to the EU 2020\nstrategy to foster growth in a strengthened, dynamic and\ncompetitive internal market.
\nNew categories proposed for inclusion in the Enabling\nRegulation: the proposal to include\ncertain new categories in the Enabling Regulation entails neither\nthe immediate block exemption of all these categories, nor does it\nmean that all measures within a category would be block-exempted in\ntheir entirety. Rather, it enables the Commission to adopt block\nexemptions gradually, when experience acquired is sufficient to\nallow the Commission to define clear compatibility criteria for\ncertain types of aid measures, ensuring that the effect on\ncompetition and trade between Member States is limited.
\nThe Commission proposes to include new categories in\nthe Enabling Regulation:
\nSpecifying block-exempted aid\ncategories: current rules specify\nthat, for each category of block-exempted aid, the thresholds\nshould be expressed either in terms of aid intensities in relation\nto a set of eligible costs or in terms of maximum aid\namounts.
\nThe Commission proposes to define the thresholds\nnot only in terms of aid intensities or maximum aid amounts, but\nalso in terms of maximum level of State support, whether it\nqualifies as State aid in the meaning of Article 107(1) TFEU or\nnot.
\nProvisions concerning transparency: the current Regulation provides that on\nimplementation of aid systems or individual aids granted outside\nany system, which have been exempted pursuant to such regulations,\nMember States shall forward to the Commission, with a view to\npublication in the Official Journal of the European Communities,\nsummaries of the information regarding such systems of aid or such\nindividual aids as are not covered by exempted aid\nsystems.
\nThe obligation to publish the above summaries in the\nOfficial Journal should therefore be replaced by the obligation\nto publish on the Commissions website.
\nThe Commission states that more frequent revisions\nof the Enabling Regulation may in the future be needed, in\nparticular to have due regard to the investments required by and\ncompatible with the development of the internal market, in the\nlight of the experience gained. \nThese Regulations are part of the broader reform\ninitiated after the presentation of the Commission communication on\nEU state aid modernisation.
\nThe changes made to Council\nRegulation (EC) No 994/98 (Enabling\nRegulation) will allow the Commission to apply a\nsimplified control procedure to certain categories of aid without\nweakening efficient supervision and monitoring.
\nExemptions by category:\nthe scope of the Enabling Regulation has been enlarged to include\nnew types of aid. The Regulation now covers aid in favour\nof:

\nLEGAL BASIS: Article 109 TFEU, which allows the\nCouncil to make any appropriate regulations, in particular to\ndetermine the conditions in which Article 108(3) TFEU shall apply,\nand the categories of aid exempted from that procedure. The Council\nmust decide by a qualified majority on a proposal from the\nCommission and after consulting the European Parliament.
\nCONTENT: this proposal is a key element in State\nAid Modernisation (SAM), an initiative launched by Commission.\nIt should contribute to the overall objectives of the Union, in\nparticular the objective of focusing State aid enforcement on cases\nhaving the biggest impact on the internal market and to the EU 2020\nstrategy to foster growth in a strengthened, dynamic and\ncompetitive internal market.
