The Committee on Constitutional Affairs adopted the\nreport by Rafał TRZASKOWSKI (EPP, PL) on the amendment of Rule 81 of Parliament's Rules of\nProcedure.
\nThe report deals with the way in which Parliament\ngives its consent in procedures where it is required pursuant\nto the Treaties (formerly known as the assent procedure). It\nproposed amending Rule 81 as follows:
\nRecommendation of the committee\nresponsible: where Parliament is asked to give its consent to a\nproposed act, it shall, when adopting its decision, take into\naccount a recommendation from the committee responsible to approve\nor reject the act. The recommendation shall include citations\nbut not recitals. It may include a short justification, which\nshall be the responsibility of the rapporteur and which shall\nnot be put to the vote.
\nAmendments tabled in committee shall be admissible\nonly if they aim to reverse the recommendation as proposed by the\nrapporteur.
\nThe committee responsible may table a motion for a\nnon-legislative resolution. Other committees may be involved in\ndrawing up the resolution.
\nVote: Parliament shall decide on the act requiring its\nconsent by means of a single vote on consent, irrespective of\nwhether the recommendation from the committee responsible is to\napprove or reject the act. No amendments may be tabled.
\nAn act not obtaining the required majority (or the\nmajority of the votes cast where no majority is indicated therein)\nshall be deemed to have been rejected.
\nAt the committee level,\nthe committee responsible shall\ndeal with the request for consent\nwithout undue delay. If the committee\nresponsible decides not to give a\nrecommendation, or has not adopted a\nrecommendation within six months after\nthe request for consent
\nhas been referred to it, the Conference of Presidents\nmay:
\nSuspension clause on the consent of international\nagreements: where Parliament is asked\nto give its consent for the conclusion of an international\nagreement, Parliament may decide, on the basis of a recommendation\nfrom the committee responsible, to suspend the consent procedure\nfor no longer than one year.
\nThe Members considered that this clause is very\nimportant, in particular: (i) to allow a \"cooling off\" period in\norder to avoid the likely rejection of an international agreement;\n(ii) to require the third country to accomplish certain changes or\nobligations that Parliament deems necessary to give\nconsent.
\nThe European Parliament adopted a decision on the\namendment of Rule 81 of Parliament's Rules of Procedure on\nthe consent procedure.
\nThe decision deals with the way in which Parliament\ngives its consent in procedures (formerly known as the assent\nprocedure) where it is required pursuant to the Treaties. It agreed\nto modify Article 81 as follows:
\nRecommendation from the committee\nresponsible: Parliament, when\nadopting its decision, should take into account a recommendation\nfrom the committee responsible to approve or reject the act in\nquestion. The recommendation should include citations but not\nrecitals. It may include a short justification, which shall be\nthe responsibility of the rapporteur and which shall not be put to\nthe vote.
\nAmendments tabled in committee would be admissible\nonly if they aim to reverse the recommendation as proposed by the\nrapporteur.
\nThe committee responsible may table a motion for a\nnon-legislative resolution. Other committees may be involved in\ndrawing up the resolution.
\nVote: Parliament would\ndecide on the act requiring its consent by means of a single\nvote, irrespective of whether the recommendation from the committee\nresponsible is to approve or reject the act. No amendments may\nbe tabled.
\nIf the majority required (or, the majority of the\nvotes cast where no majority is specified), is not obtained, the\nproposed act shall be deemed to have been rejected.
\nAt the committee level,\nthe committee responsible should deal with the request for consent\nwithout undue delay. If the committee responsible decides not to\ngive a recommendation, or has not adopted a recommendation within\nsix months after the request for consent has been referred to it,\nthe Conference of Presidents may:
\n\n· \neither place the matter on the agenda for a\nsubsequent part-session for consideration,
\n\n· \nor decide to extend the six-month period in duly\nsubstantiated cases.
\nSuspension clause relating to the conclusion of\ninternational agreements:\nParliament may decide, on the basis of a\nrecommendation from the committee responsible, to suspend the\nconsent procedure for the conclusion of an international agreement\nfor no longer than one year.
