The European Parliament adopted a resolution on the\nsituation in Cambodia.
\nThe resolution was tabled by the S&D, EPP, ECR,\nGUE/NGL, Greens/EFA and ALDE groups.
\nIt condemns all politically motivated sentences and\nconvictions against political critics, parliamentary opposition\npoliticians, notably Sam Rainsy (the leader of the Sam Rainsy\nParty, who has been convicted on charges that are allegedly\npolitically motivated), human rights defenders and land activists,\nand deplores the deaths of Chut Wutty and Heng Chantha, both killed\nwhile exercising their right to peaceful protest. It calls for an\nimmediate and unconditional release of Mom Sonando, a human rights\ndefenders accused of anti-state crime and other government\ncritics and land rights activists who are being held for political\nreasons only, and stresses that all those responsible for human\nrights violations should be identified and held accountable for\ntheir actions.
\nMembers underline the importance of the UN Special\nRapporteur's conclusion that the serious and widespread human\nrights violations associated with land concessions need to be\naddressed and remedied. They recall that as of August 2012 the\nCambodian Government has granted at least 2 157 744\nhectares of economic land concessions to over 200 companies, often\nin violation of the provisions of the 2001 Land Law and bypassing\nlegal safeguards such as the obligations to prevent concessions in\nprotected areas, undertake social impact assessment and obtain the\nfree, prior and informed consent of indigenous communities. They\nalso recall that the Prime Minister, Hun Sen, issued in May 2012 a\ndirective establishing a moratorium on new economic land\nconcessions and stipulating a review of the existing concessions.\nHowever, despite the directive at least 12 new concessions were\ngranted, since a loophole in the directive allows conclusion of new\nland concessions already in an advanced stage of negotiations or\nagreed to in principle. Furthermore, there has been no real review\nof existing land concessions and none of the problematic ones have\nbeen cancelled.
\nParliament notes that the EU is Cambodia's single\nlargest donor. It calls on the Commission to investigate the\nescalation of human rights abuses in Cambodia as a result of\neconomic land concessions being granted for agro-industrial\ndevelopment linked to the export of agricultural goods to the\nEuropean Union, and to temporarily suspend EBA preferences on\nagricultural products from Cambodia in cases where human rights\nabuses are identified. It notes the decision of the Prime\nMinister of Cambodia to halt new economic land concessions and his\npledge to review existing concessions.
\nThe Cambodian authorities are to:
\n\n· \ncease all forced evictions, review the May 2012\ndirective and introduce and enforce a moratorium on evictions in\nCambodia until a transparent and accountable legal framework and\nrelevant policies are in place to ensure that future economic land\nconcessions are granted in accordance with international human\nrights law and to ensure that all those forcibly evicted are\nguaranteed adequate compensation and suitable alternative\naccommodation;
\n\n· \nimplement the recent UN recommendations on\nreforming the electoral system to ensure it conforms with\ninternational standards before, during and after the casting of\nvotes. Members calls on the Commission closely to monitor the\nimplementation of the UN recommendations by the Cambodian\nauthorities;
\n\n· \nstrengthen democracy, the rule of law, respect\nfor human rights and fundamental freedoms in particular\nmedia freedom and freedom of expression and assembly as\nthese values constitute an essential element of the EU-Cambodia\nCooperation Agreement, as defined in Article 1 of that\nAgreement.
