PURPOSE: to apply, on behalf of the European Union, Regulation\nNo 41 of the United Nations Economic Commission for Europe on\nuniform provisions concerning the approval of motor cycles with\nregard to noise.
\nPROPOSED ACT: Council Decision.
\nROLE OF THE EUROPEAN PARLIAMENT: Council may adopt the act only\nif Parliament has given its consent to the act.
\nBACKGROUND: at international level, the United Nations Economic\nCommission for Europe (UNECE) develops harmonised requirements,\nintended to remove technical barriers to the trade in motor\nvehicles between the Contracting Parties to the Revised 1958\nAgreement and to ensure that such vehicles offer a high level of\nhealth, safety and environmental protection.
\nRegulation No 41 of the United Nations Economic Commission for\nEurope on uniform provisions concerning the approval of motor\ncycles with regard to noise (UNECE Regulation No 41)\nwas recently brought up to the same level of environmental\nprotection as obtained through Union type-approval legislation,\nwhich now allows the Union to start applying this UNECE Regulation.\nThe objective of that Regulation is to establish equivalent\nprovisions for sound control of motorcycles and clarifications to\nthe stationary noise measurement test of such vehicles.
\nAt EU level, Annex I to Directive 2002/24/EC of the European\nParliament and of the Council relating to the type-approval of two\nor three-wheel motor vehicles, referring to Chapter 9 of Annex I to\nDirective 97/24/EC on certain components and characteristics of two\nor threewheel motor vehicles, mandates the type approval for two\nand three-wheel motor vehicles, according to measurement procedures\nand limit values for sound levels as laid down in Annex I.
\nNow that Revision 4 of UNECE Regulation No 41 has been\nestablished, it is appropriate for the Union to apply the said\nRegulation in order to have common harmonised requirements at\ninternational level, which will facilitate international trade and\nwhich will replace the existing approval requirements.
\nIMPACT ASSESSMENT: the application of UNECE Regulation No 41\ndoes not lead to a revision of noise emission limits and/or\nthresholds, as currently set out in Directive 97/24/EC.\nFurthermore, the testing methods set out in UNECE Regulation No 41\nare equivalent in scope and scientific approach to the ones\nprovided for in Directive 97/24/EC.
