\nThe Council reached a general approach on a\ndecision on enhanced cooperation between public employment services\n(PES). The present agreement will allow for the trilogue\nnegotiations to begin early 2014.
\nA broad agreement was found on the main objectives of\nthe proposal and on all the elements, except one: the voluntary or\nmandatory nature of the participation in the PES\nNetwork.
\nThe Presidency concluded that the solution to this\nopen issue would be the expression of the political will of the\nMember States. A written procedure was initiated to reach an\nagreement on this outstanding issue.
\nTaking into account the result of the written\nprocedure, the Presidency proposed a new compromise text for\nCoreper. Coreper, confirming an agreement on this compromise text,\nagreed to forward it to the Council with a view to reaching a\ngeneral approach.
\nIn terms of the general approach, this Decision should\naim to encourage cooperation between Member States within the areas\nof PES responsibility. Member States are competent to decide\nwhether to participate in the Network.

\nThe European Parliament adopted by 509 votes to 21\nwith 43 abstentions, a legislative resolution on the proposal for a\ndecision of the European Parliament and of the Council on enhanced\nco-operation between Public Employment Services\n(PES).
\nParliament adopted its position at first reading under\nthe ordinary legislative procedure. The amendments adopted in\nplenary were the result of a compromise between Parliament and\nCouncil. They amend the Commissions proposal as\nfollows:
\nFormalise and strengthen existing informal\ncooperation: the Decision should aim\nto encourage cooperation between Member States within the areas of\nPES responsibility. It formalised and strengthened the informal\ncooperation between the PES via the current European Network of\nHeads of PES, in which all Member States had agreed to participate.\nThe full potential value of the Network resided in the continued\nparticipation of all Member States.
\nEstablishment of the Network : the decision established a Union-wide network of\nPublic Employment Services (PES) to 31 December 2020 composed\nof:
\nEMCO should have an observer status.
\nMember States with sub-national autonomous PES should\nensure their adequate representation in the specific initiatives of\nthe Network.
\nBench learning: for the\npurposes of the activities of the Network, bench\nlearning meant the process of creating a systematic and\nintegrated link between benchmarking and mutual learning\nactivities, that consisted of identifying good performances\nthrough indicator-based benchmarking systems, including data\ncollection, data validation, data consolidation and assessments,\nwith appropriate methodology, and of using findings for tangible\nand evidence-informed mutual learning activities, including\ngood or best practice models.
\nObjectives of cooperation between Member\nStates: through the Network in the\nfield of employment, Member States should cooperated in the\nfollowing areas:
\nCooperation with social partners: the Network should\ninitiate cooperation with\nrelevant labour market stakeholders including other\nproviders of employment services,\nand, where appropriate, social partners, organisations representing\nunemployed persons or vulnerable groups, NGOs working in the field\nof employment, regional and local authorities, the European\nLifelong Guidance Policy Network and private employment\nservices, by involving\nthem in relevant activities and meetings of the Network.
\nInitiatives of the Network: the Network shall, in\nparticular, carry out the\nfollowing initiatives:
\nMember States shall remain competent to decide whether\nto engage on a voluntary basis in additional bench learning\nexercises in areas other than those listed
\nFunctioning of the Network: the Network should be governed by a Board. The\ntext made provision for the management and composition of the\nNetwork
\nFinancing: the global\nresources for the implementation of this Decision should be\nestablished within the PROGRESS/employment section of EaSI, the annual appropriations of which should be\nauthorised by the European Parliament and by the Council within the\nlimits of the financial framework.
\nAnnual report: the\nNetwork should set out the technical framework for the delivery\nof the benchmarking and mutual learning activities, as part of\nthe annual work programme of the Network, including the bench\nlearning methodology on the basis of the benchmarking indicators as\nset out in the Annex to this Decision to compare PES performance,\nthe context variables, the data delivery requirements, and the\nlearning instruments of the integrated mutual learning\nprogramme.
\nReview: three years\nafter entry into force of the Decision, the Commission should\nsubmit a report on the application of the Decision to assess to\nwhat extent the Network had contributed to the\nachievement of the objectives and whether it has fulfilled its\ntasks.
\nAnnex: an Annex set out the indicators for evaluating bench\nlearning.
\nDelegated acts: the\nCommission should be empowered to adopt delegated acts regarding\nthe amendment of the Annex on indicators for bench\nlearning.
\nUnilateral declaration by the European\nParliament: whilst welcoming the\ncreation of the Network, Members recalled that Article 149 TFEU\nprovided that the European Parliament and the Council may adopt\nincentive measures designed to encourage cooperation between Member\nStates in the field of employment. Such acts were legislative\nacts and may provide for legally binding obligations, however,\nwithout harmonising laws and regulations of Member States.\nParliament considered that that setting up the network of\ncooperation between PES was an incentive measure falling within the\nscope of Article 149 TFEU. Therefore, all Member States should\nparticipate in the Network, as the non-participation of a\nMember State in a Union policy could not be justified by the mere\nwish of Member States.

\nInitiatives of the Network: the Network shall, in particular, carry out the\nfollowing initiatives:
\nMember States shall remain competent to decide whether\nto engage on a voluntary basis in additional bench learning\nexercises in areas other than those listed.
\nFunctioning of the Network: the Network should be governed by a Board. The text\nmade provision for the management and composition of the\nNetwork.
\nFinancing: the global\nresources for the implementation of this Decision should be\nestablished within the PROGRESS/employment section of EaSI, the\nannual appropriations of which should be authorised by the European\nParliament and by the Council within the limits of the financial\nframework.

\nDelegated acts: the\nCommission should be empowered to adopt delegated acts regarding\nthe amendment of the Annex on indicators for bench\nlearning.
\nUnilateral declaration by the European\nParliament: whilst welcoming the\ncreation of the Network, Members recalled that Article 149 TFEU\nprovided that the European Parliament and the Council may adopt\nincentive measures designed to encourage cooperation between Member\nStates in the field of employment. Such acts were legislative\nacts and may provide for legally binding obligations, however,\nwithout harmonising laws and regulations of Member States.\nParliament considered that that setting up the network of\ncooperation between PES was an incentive measure falling within the\nscope of Article 149 TFEU. Therefore, all Member States should\nparticipate in the Network, as the non-participation of a\nMember State in a Union policy could not be justified by the mere\nwish of Member States.

\nThe Council reached a general approach on a\ndecision on enhanced cooperation between public employment services\n(PES). The present agreement will allow for the trilogue\nnegotiations to begin early 2014.
\nA broad agreement was found on the main objectives of\nthe proposal and on all the elements, except one: the voluntary or\nmandatory nature of the participation in the PES\nNetwork.
\nThe Presidency concluded that the solution to this\nopen issue would be the expression of the political will of the\nMember States. A written procedure was initiated to reach an\nagreement on this outstanding issue.
\nTaking into account the result of the written\nprocedure, the Presidency proposed a new compromise text for\nCoreper. Coreper, confirming an agreement on this compromise text,\nagreed to forward it to the Council with a view to reaching a\ngeneral approach.
\nIn terms of the general approach, this Decision should\naim to encourage cooperation between Member States within the areas\nof PES responsibility. Member States are competent to decide\nwhether to participate in the Network.
\nThe Committee on Employment and Social Affairs adopted\nthe report by Frédéric DAERDEN (S&D, BE) on the\nproposal for a decision of the European Parliament and of the\nCouncil on enhanced co-operation between Public Employment Services\n(PES).
\nThe committee recommended that Parliaments\nposition adopted at first reading following the ordinary\nlegislative procedure should amend the Commission proposal as\nfollows:
\nLegal base: Members\nproposed adding a second legal basis, Article 14 TFEU to\nArticle 149 of the TFEU, to the proposal.
\nObjectives and initiatives of the PES: Members suggested adding a number of objectives\naiming to: (i) modernise the Public Employment Service; (ii)\nsupport the most vulnerable social groups with high unemployment\nrates, especially older workers and young NEETs ; (iii)\npromote decent and sustainable work; (iv) promote the link between\nabilities and the needs of employees and employers; (v)\nidentify best practices and the better\nintegration of labour markets; (vi) increase voluntary\ngeographical and occupational mobility, without social dumping,\nin compliance with the relevant Union law; (vii) identify skill\ngaps; (viii) development of initiatives to ensure that\nthese young people gain the skills necessary to enter and remain in\nthe labour market.
\nAmongst the other issues to be dealt with by the\nNetwork, Members noted the following:
\nNetwork actors: Members\nstated that the Network should cooperate,\nexclusively on its initiative, with labour market\nstakeholders including other providers of employment services,\nsuch as, where appropriate, social partners, organisations\nrepresenting unemployed persons or\nvulnerable groups, NGOs working in the field of employment, and\nnational labour inspectorates by\ninvolving them in relevant activities and meetings of the Network\nand by exchanging information and data.
\nReport: Members\nstipulated that two years after its entry into force, the\nCommission should submit a report on the application of this\nDecision to the European Parliament, the Council, the European\nEconomic and Social Committee and the Committee of Regions. Where\nnecessary, the Commission should submit a proposal for a review of\nthis Decision.
\nEntry into force:\nlastly, Members amended the date of entry into force of the\ninitiative as adoption will not be possible in time for the\ninstrument to be implemented properly by 1 January 2014 but they\nare committed to its adoption as soon as possible.
\nThe European Parliament adopted by 509 votes to 21\nwith 43 abstentions, a legislative resolution on the proposal for a\ndecision of the European Parliament and of the Council on enhanced\nco-operation between Public Employment Services (PES).
\nParliament adopted its position at first reading under\nthe ordinary legislative procedure. The amendments adopted in\nplenary were the result of a compromise between Parliament and\nCouncil. They amend the Commissions proposal as\nfollows:
\nFormalise and strengthen existing informal\ncooperation: the Decision should aim\nto encourage cooperation between Member States within the areas of\nPES responsibility. It formalised and strengthened the informal\ncooperation between the PES via the current European Network of\nHeads of PES, in which all Member States had agreed to participate.\nThe full potential value of the Network resided in the continued\nparticipation of all Member States.
\nEstablishment of the Network : the decision established a Union-wide network of\nPublic Employment Services (PES) to 31 December 2020 composed\nof:
\nEMCO should have an observer status.
\nMember States with sub-national autonomous PES should\nensure their adequate representation in the specific initiatives of\nthe Network.
\nBench learning: for the\npurposes of the activities of the Network, bench\nlearning meant the process of creating a systematic and\nintegrated link between benchmarking and mutual learning\nactivities, that consisted of identifying good performances\nthrough indicator-based benchmarking systems, including data\ncollection, data validation, data consolidation and assessments,\nwith appropriate methodology, and of using findings for tangible\nand evidence-informed mutual learning activities, including\ngood or best practice models.

\nDELEGATED ACTS: the Commission shall be empowered to\nadopt delegated acts in accordance with Article 9 to amend the\nAnnex laying down the benchmarking indicators. The delegation of\npower shall be conferred on the Commission from 17 June 2014\nuntil 31 December 2020.
\nThe European Parliament or the Council may raise\nobjections with regard to a delegated act within two months of the\ndate of notification (which may be extended by two months). If\nParliament or Council raise objections, the delegated act will not\nenter into force.
