PURPOSE: to modify\nRegulation (EC) No 91/2003 in order to update, simplify and\noptimise the existing legal framework for European statistics on\nrail transport and to align it with the new institutional\ncontext.
\nPROPOSED ACT: Regulation of the European Parliament\nand of the Council.
\nROLE OF THE EUROPEAN PARLIAMENT: the European\nParliament decides in accordance with the ordinary legislative\nprocedure and on an equal footing with the Council.
\nBACKGROUND: Eurostats\nrail transport statistics are predominantly based on Regulation\n(EC) No 91/2003 of the European Parliament and of the Council,\nCommission Regulation (EC) No 1192/2003 and Commission Regulation\n(EC) No 332/2007. These Regulations cover passenger and freight\ntransport by rail, as well as rail safety.
\nThe Commission needs statistics on the transport of\ngoods and passengers by rail in order to monitor and develop the\ncommon transport policy. Detailed rail transport statistics for\ngoods and passengers and information on intermodality are necessary\nto monitor the targets set in the 2011 Commissions White\nPaper.
\nEurostat has conducted a technical analysis of the\nexisting data on rail statistics collected under the Union\nlegislation and of the dissemination policy, within its Working\nGroup and Task Force on rail transport statistics.
\nIn its report to the European Parliament and the\nCouncil on the experience acquired in the application of the\nRegulation (EC) No 91/2003, the Commission mentions that long term\ndevelopments will probably mean the suppression or simplification\nof the data already collected under the Regulation, and that the\nintention is to reduce the data transmission period for annual data\non rail passengers.
\nIMPACT ASSESSMENT: no impact assessment was\nundertaken. The proposal is the result of in-depth negotiations\nbetween all interested parties.
\nLEGAL BASIS: Article 338(1) of the Treaty on the\nFunctioning of the European Union (TFEU).
\nCONTENT: the aim of this proposal is thus to modify\nRegulation (EC) No 91/2003 in order to update, simplify and\noptimise the existing legal framework for European statistics on\nrail transport and to align it with the new institutional\ncontext.
\nData on transport of passengers: in line with Annexes C and D to Regulation (EC)\n91/2003 on rail transport statistics, countries are currently\nrequired to provide annual statistics on passenger transport, under\ndetailed and/or simplified reporting. The Commission proposed to\ndelete Annex D (simplified reporting) and the provisional Tables C1\nand C2 in Annex C, while shortening the deadline for providing the\nfinal passenger data from 14 months to eight months after the end\nof the reference period.
\nData on transport of goods: in the interests of consistency, it is also proposed\nto delete Annex B (simplified reporting).
\nNew Annex: as it is\nproposed to abandon the current concept of simplified\nreporting, for the smallest undertakings below the specified\nthresholds, Member States would have to report a total\nfigure for aggregated indicators in Annex L.
\nData on accidents: as\ndata on accidents are also collected by the European Rail Agency,\nit is proposed to delete Annex H (statistics on\naccidents).
\nAnnex I: as the concept\nof simplified reporting will disappear, it is proposed\nto delete this Annex as it is currently used only to validate\ncoverage between simplified and detailed reporting in relation to\nthe total rail activity of undertakings.
\nThresholds: the present\nthresholds are established for tonne-km and passenger-km, i.e.\nmultiplication of tonnes/passengers transported and the distance\ncovered in kilometres.
\nAs significant rail activity involves only small\ndistances in some Member States, it is proposed to decrease the\nthresholds both for goods and passengers, in order to minimise the\nloss of important data. For the same reason, a double threshold in\ntonnes transported and in tonne-km is proposed for\ngoods.
\nTransit data: it is\nproposed that Rail Waybill information (if available)\nbe used when administrative data are used as the data\nsource.
\nLastly, the proposed amendment of Regulation (EC) No\n91/2003 takes into account the necessary adjustments to the Treaty\non the Functioning of the European Union as regards granting the\nCommission delegated and implementing powers.
\nBUDGETARY IMPLICATION: this proposal has no\nimplications for the EU budget.
\nDELEGATED ACTS: the proposal contains provisions\nempowering the Commission to adopt delegated acts in accordance\nwith Article 290 of the Treaty on the Functioning of the European\nUnion (TFEU).

\nThe main elements of the Council position are as\nfollows:
\nStatistics on the transport of goods and passengers by\nrail: according to the draft\nRegulation, these statistics are necessary to enable the Commission\nto monitor and develop the common transport policy, as well as the\ntransport elements of policies relating to the regions and to\ntrans-European networks.
\nStatistics on rail safety are also necessary to enable\nthe Commission to prepare and monitor Union action in the field of\ntransport safety.
\nA new recital highlights that it is necessary to\nestablish appropriate cooperation agreements between the\nCommissions services and relevant entities with a view to\nproviding easily accessible and useful information to Union\ncitizens and other stakeholders on rail transport safety and\ninteroperability of the rail system.
\nData collection: Member\nStates shall report under Annexes A and C data for undertakings\nthat have:
\nReporting under Annexes A and C shall be optional in\nrespect of undertakings falling below the thresholds referred to\nabove.
\nQuality of data: Member\nStates shall take all measures necessary to ensure the quality of\nthe data transmitted. The Commission shall adopt implementing acts\nspecifying the detailed arrangements, structure, periodicity and\ncomparability elements for the standard quality reports.
\nDelegated powers: the\nCommission shall be empowered to adopt delegated acts to adapt\nthe technical definitions and to provide for additional technical\ndefinitions, when needed to take into account new developments\nwhich require a certain level of technical detail to be defined in\norder to ensure the harmonisation of statistics.
\nReports on implementation: by 31 December 2020 and every four years thereafter,\nthe Commission, after consulting the European Statistical System\nCommittee, shall submit a report to the European Parliament and to\nthe Council on the implementation of this Regulation and on future\ndevelopments.
\nThe European Parliament adopted a legislative\nresolution on the Council position at first reading with a view to\nthe adoption of a regulation of the European Parliament and of the\nCouncil amending Regulation (EC) No 91/2003 on rail transport\nstatistics, as regards the collection of data on goods, passengers\nand accidents.
\nA motion to reject the Council position, tabled by the\nEFDD group, was rejected in plenary.
\nIn line with the recommendation for second reading by\nthe Committee on Transport and Tourism, Parliament approved the\nCouncil position at first reading without amendment.
\nThe Committee on Transport and Tourism adopted the\nrecommendation for second reading contained in the report by\nMichael CRAMER (Greens/EFA, DE) on the Council position at first\nreading with a view to the adoption of a regulation of the European\nParliament and of the Council amending Regulation (EC) No 91/2003\non rail transport statistics, as regards the collection of data on\ngoods, passengers and accidents.
\nThe committee recommended the European Parliament to\napprove the Council position at first reading without\namendment.
\nThe explanatory statement accompanying the\nrecommendation recalled the Parliaments\npriorities:
\nThe Council and Parliament agreed that the most\nefficient and cost-effective way to avoid duplication of work\nbetween Eurostat, the Commission and the European Railway Agency\n(ERA) was to reinforce cooperation between these institutions\nand ensure that statistical data related to EU policies are easily\naccessible to EU citizens and stakeholders.

\nThe Council adopted its position at first reading with\na view to the adoption of a Regulation and of the European\nParliament amending Regulation (EC) No 91/2003 on rail transport\nstatistics, as regards the collection of data on goods, passengers\nand accidents.
\nThe aim of the Commissions proposal is to modify\nRegulation (EC) No 91/20031 in order to update, simplify and\noptimise the existing legal framework for European statistics on\nrail transport and to align it with the Treaty on the Functioning\nof the European Union (TFEU), as far as delegated and implementing\npowers is concerned.
\nThe main elements of the Council position are as\nfollows:
\nStatistics on the transport of goods and passengers by\nrail: according to the draft\nRegulation, these statistics are necessary to enable the Commission\nto monitor and develop the common transport policy, as well as the\ntransport elements of policies relating to the regions and to\ntrans-European networks.
\nStatistics on rail safety are also necessary to enable\nthe Commission to prepare and monitor Union action in the field of\ntransport safety.
\nA new recital highlights that it is necessary to\nestablish appropriate cooperation agreements between the\nCommissions services and relevant entities with a view to\nproviding easily accessible and useful information to Union\ncitizens and other stakeholders on rail transport safety and\ninteroperability of the rail system.
\nData collection: Member\nStates shall report under Annexes A and C data for undertakings\nthat have:
\nReporting under Annexes A and C shall be optional in\nrespect of undertakings falling below the thresholds referred to\nabove.
\nQuality of data: Member\nStates shall take all measures necessary to ensure the quality of\nthe data transmitted. The Commission shall adopt implementing acts\nspecifying the detailed arrangements, structure, periodicity and\ncomparability elements for the standard quality reports.
\nDelegated powers: the\nCommission shall be empowered to adopt delegated acts to adapt\nthe technical definitions and to provide for additional technical\ndefinitions, when needed to take into account new developments\nwhich require a certain level of technical detail to be defined in\norder to ensure the harmonisation of statistics.
\nReports on implementation: by 31 December 2020 and every four years thereafter,\nthe Commission, after consulting the European Statistical System\nCommittee, shall submit a report to the European Parliament and to\nthe Council on the implementation of this Regulation and on future\ndevelopments.
\nThe Committee on Transport and Tourism adopted the\nrecommendation for second reading contained in the report by\nMichael CRAMER (Greens/EFA, DE) on the Council position at first\nreading with a view to the adoption of a regulation of the European\nParliament and of the Council amending Regulation (EC) No 91/2003\non rail transport statistics, as regards the collection of data on\ngoods, passengers and accidents.
\nThe committee recommended the European Parliament to\napprove the Council position at first reading without\namendment.
\nThe explanatory statement accompanying the\nrecommendation recalled the Parliaments\npriorities:
\nThe Council and Parliament agreed that the most\nefficient and cost-effective way to avoid duplication of work\nbetween Eurostat, the Commission and the European Railway Agency\n(ERA) was to reinforce cooperation between these institutions\nand ensure that statistical data related to EU policies are easily\naccessible to EU citizens and stakeholders.
\nAn agreement on a simplification of the Regulation on\nrail transport statistics was only possible after the signature\nof two Memoranda of Understanding (MoUs) between Eurostat and\nthe Commission (27/04/2016) and between Eurostat and ERA\n(12/05/2016).
\nThese MoUs are not only important instruments towards\noptimisation of the use of existing information and reduction of\nadministrative burden, but would also satisfy requirements raised\nby the co-legislators as regards the better use of rail transport\nstatistics. They would provide all categories of users with easily\naccessible data and reliable information on the progress of\nEuropean policies in the rail sector.
\nThe European Parliament adopted a legislative\nresolution on the Council position at first reading with a view to\nthe adoption of a regulation of the European Parliament and of the\nCouncil amending Regulation (EC) No 91/2003 on rail transport\nstatistics, as regards the collection of data on goods, passengers\nand accidents.
\nA motion to reject the Council position, tabled by the\nEFDD group, was rejected in plenary.
\nIn line with the recommendation for second reading by\nthe Committee on Transport and Tourism, Parliament approved the\nCouncil position at first reading without amendment.
\n
