\nMembers pledged to make the petition procedure\nmore efficient, transparent, and impartial so that the handling of\npetitions stands up to judicial review even at a procedural level.\nThey called for the need for more precise, written, procedural\nrules in relation to the preparation, implementation and\nevaluation of visits, ensuring on the one hand that all members\nof a fact-finding visit have the right to present the facts from\ntheir point of view while, on the other hand, guaranteeing all\nCommittee Members the opportunity to participate in the\ndecision-making process concerning the conclusions and\nrecommendations to be drawn by the Committee on\nPetitions.
\nLastly, Members believed that the role and\nresponsibilities of the Petitions Committee would be best\nperformed, and its visibility, efficiency, accountability and\ntransparency best enhanced, by improving its means for bringing\nissues of importance to European citizens to plenary, and upgrading\nits abilities to call witnesses, conduct investigations and\norganise hearings.
\nThe European Parliament adopted by 446 votes to 35\nwith 43 abstentions, a resolution on the activities of the\nCommittee on Petitions 2012.
\nIn 2012 the Committee on Petitions registered 1 986\npetitions, mostly referring to the themes of fundamental rights,\nthe environment the internal market, and economic and social\ncrisis.
\n1 406 petitions were declared admissible, and of\nthose 853 were forwarded to the Commission for further\ninvestigation and 580 petitions were declared\ninadmissible.
\nThe highest number of petitions referred to the EU as\na whole (27.3 %), followed by Spanish (15.0 %), German (12.5 %) and\nItalian (8.6 %) cases.
\nFundamental rights:\nfundamental rights remained a key subject of the petitions\nsubmitted, notably raising issues related to the rights of persons\nwith disabilities, childrens rights, property rights, the\nright of free movement, including the portability of social\nsecurity entitlements, without encountering any form of\ndiscrimination on any grounds, the protection of freedom of\nexpression and privacy, freedom of association, and the right of\naccess to documents and information.
\nParliament called on Member States to apply\ncorrectly and respect those rights as set out in\nthe Treaty and called on the Commission to take the necessary\nmeasures to oblige non-compliant Member States to close the gap\nbetween national laws and the fundamental rights of EU\ncitizens.
\nAn amendment adopted in plenary underlined the need to\ngive special attention to the right to historical memory and\nthe rights to truth, justice and redress for families which\nsuffered under Franco's dictatorship, as well as to the right of\nSpain's abducted children to know the identity of their biological\nparents.
\nDiscrimination: the\nresolution drew attention to persisting discrimination against\ncitizens on the grounds of religion or belief, disability,\nbelonging to a minority group, age or sexual orientation. It\nwarned, in particular, that the Roma population across the EU\ncontinues to face obstacles to inclusion and called on the\nCommission to facilitate intergovernmental cooperation in this\narea, to provide adequate funding for the implementation of\nnational strategies for Roma inclusion.
\nCitizens rights:\nMembers noted that citizens in the European Union continue to face\nbarriers within the internal market, notably while exercising their\nfreedom of movement as individuals, as providers and consumers of\ngoods and services and as workers, such as, for instance, in the\ncase of Romanian and Bulgarian workers who continue to face\nrestrictions on the labour market in some Member States.
\nParliament called on Member States to ensure\nfreedom of movement for all EU citizens and their families, on\nthe basis of the principles of mutual recognition, equality,\nnon-discrimination, dignity and respect for private and family\nlife.
\nMembers also welcomed the Petitions Committee's\nconclusions from the fact-finding visit to Berlin on youth and\nfamily welfare matters, particularly in cross-border custody\ncases. They noted, however, based on the continuing inflow of\npetitions of this nature, that it is clear the issue of\ncross-border custody cases is ongoing.
\nEnvironment: Members\npointed to the numerous petitions submitted on waste management, on\nwater, on the possible dangers of nuclear energy and genetic\nengineering, on protected species, and on the assessment of the\nimpact of projects and activities on the environment and on public\nhealth, such as shale gas extraction by means\nof fracking.
\nThe Commission is called upon to:
\n· \nadopt a precautionary and preventive\napproach when assessing projects with a potential negative\nenvironmental or public health impact;
\n· \nstrengthen the environmental legislative\nframework on the environment and combating climate\nchange;
\n· \ntake action to ensure that the Member States\nunderstand that water is a public good;
\n· \n(stringently apply precautionary principle in\nrespect of the use of biotechnology and nanotechnology in\nproducts that could seriously affect the health of\nconsumers.
\nParliament also stressed the need to regulate\ncoastal protection effectively, but noted that the costal law\nis not consistent with the objectives sought, since the former is\naffecting historic heritage and traditional communities.
\nInformation and citizen participation: the Eurobarometer of public opinion indicated\nthat only 36 % of EU citizens consider themselves well informed\nabout their rights and only 24 % felt well informed about what they\ncan do if their rights are not respected. The resolution stressed the need for:
\n· \nimproved access to information and the need to\nput in place a more practical and visible petitions web\nportal by the end of 2013;
\n· \nmaking the petition\nprocedure more efficient, transparent, and impartial so\nthat the handling of petitions stands up to judicial review even at\na procedural level;
\n· \nmore precise, written, procedural rules in\nrelation to the preparation, implementation and evaluation\nof visits, ensuring on the one hand that all members of a\nfact-finding visit have the right to present the facts from their\npoint of view while, on the other hand, guaranteeing all Committee\nMembers the opportunity to participate in the decision-making\nprocess concerning the conclusions and recommendations to be drawn\nby the Committee on Petitions.
\nMembers believed that the role and responsibilities\nof the Petitions Committee would be best performed, and its\nvisibility, efficiency, accountability and transparency best\nenhanced, by improving its means for bringing issues of importance\nto European citizens to plenary, and upgrading its abilities\nto call witnesses, conduct investigations and organise\nhearings.
\nLastly, Parliament stated its concern about the\nobstacles that have emerged during the first months of the\npractical application of the European Citizens' Initiative.\nIt called on the Commission to consider seriously bringing forward\nthe date of the review prescribed in Article 22 of Regulation (EU)\nNo 211/2011.
\n
