The Committee on Industry, Research and Energy adopted\nthe own-initiative report by Salvador SEDO i ALABART (EPP, ES)\ncontaining its opinion on the evaluation report regarding BEREC and\nthe Office.
\nMembers recall that the Body of European Regulators\nfor Electronic Communications (BEREC) was created to contribute\nto shaping technical and policy orientations for the completion of\nthe internal market, with the twin aims of:
\n\n· \ngiving regulators the utmost possible\nindependence and
\n\n· \nmaking their implementation of the regulatory\nframework more consistent throughout the EU.
\nThey indicated that BEREC could only be effective if\nits independence from the Member States and the EU institutions was\nguaranteed. However, optimal use was not currently being made of\nthe BEREC Office in its daily tasks.
\nWhilst Members considered that the evaluation report\nwas, overall, relevant and balanced, they felt that there was still\nroom for improvement in the functioning of BEREC and the\nBEREC Office, while acknowledging the limited resources available.\nThey stressed, however, that the use of the new procedure under\nArticle 7/7a of Directive 2009/140/EC on a\ncommon regulatory framework for electronic communications networks\nand services had worked effectively, justifying the two-tier\nset-up.

Members considered that BEREC played\na crucial role within the regulatory system as the entity tasked\nwith aligning national factual and regulatory differences with a\nview to completing the internal market in electronic\ncommunications.
\nThey recommended that BERECs role be better\ndefined, in particular its relationship with national\nregulatory authorities (NRAs), and strengthened by\nbroadening its responsibilities so as to facilitate the\ndefinition of common positions with a view to enhancing the\ninternal market approach.
\nImprove the functioning of BEREC: Members felt that it should be possible to improve\nthe functioning of BEREC and greater predictability for market\nactors, by:

\nThey called on Member States and the Commission to\nensure that the independence of NRAs at national and European level\nis strengthened. In the same way, they called on the Commission to\nguarantee BERECs independence from the EU institutions\nin future proposals relating to the scope and mission of\nBEREC.
\nMembers recommended that BEREC strengthen its internal\naccountability by clearly defining its objectives in its annual\nwork programme and presenting in its annual report its achievements\nand progress on the basis of those objectives.
\nThey also called for:
\n\n· \ngreater coherence and consistency of BEREC's\nwork to better prioritise its tasks;
\n\n· \nmore room to take strategic decisions, producing\nits own analysis and studies;
\n\n· \nbetter external communication in order to\nencourage stakeholder involvement;
\n\n· \ngreater use of teleworking, and\nvideoconferencing to cut costs and reduce the carbon\nfootprint;
