PURPOSE: to open the\naviation market to the civil use of remotely piloted aircraft\nsystems.
\nBACKGROUND: the Commission considers that opening the European market for remotely piloted\naircraft systems (RPAS) - or the civilian use of drones - is an\nimportant step towards the aviation market of the future. The\nEuropean Summit of 19 December 2013 called for action to enable\nthe progressive integration of RPAS into civil airspace from 2016\nonwards.
\nRPAS technology has matured rapidly in past years and\nis ready to make the shift from being purely military equipment to\nbecoming a reliable new technology for civil use.
\nMember States are beginning to authorise RPAS\noperations in non-segregated airspace to respond to market demand.\nIn the short term, the most promising market lies in areas such as\ninfrastructure monitoring or photography; in a longer term future,\nit may be the transport of goods and eventually people.
\nAccording to an industry source, the global budget\nforecast in terms of research and development (R&D) and\nprocurement, including military and governmental, is expected to\ngrow from currently $5.2 bn to about $11.6 bn per year in 2023.\nThe number of jobs created through new RPAS activities in the US is\nestimated to exceed 100,000 by 2025. For Europe, about\n150,000 jobs by 2050 are forecast.
\nCurrently, the US and Israel dominate the global RPAS\nmanufacturing sector. Other non-EU countries, such as Brazil,\nChina, India and Russia, also show potential to become strong\ncompetitors. A strong common EU market should offer a solid\nbasis to compete at the global level.
\nCONTENT: the Communication responds to the call of the European manufacturing and\nservice industry to remove barriers to the introduction of RPAS in\nthe European single market. It sets out the Commission's views on\nhow to address RPAS operations in a European level policy framework\nwhich will enable the progressive development of the commercial\nRPAS market while safeguarding the public interest.
\nThe European strategy aims at establishing a single\nRPAS market to reap the societal benefits of this innovative\ntechnology and at dealing with citizens' concerns through public\ndebate and protective action wherever needed.
\nThe Commission recalls that RPAS applications can only\ndevelop if the aircraft can fly in non-segregated airspace\nwithout affecting the safety and the operation of the wider\ncivil aviation system. To this end, the EU should:
\n· \nput in place an enabling regulatory\nstructure to which the major players\nat the European and national levels can contribute. The European\nAviation Safety Agency (EASA) is best placed to develop common\nrules, using the proven EASA consultation process;
\n· \nincrease and coordinate R&D\nefforts in order to keep lead times\nfor promising technologies as short as possible (e.g. command and\ncontrol; detect and avoid technologies; security protection against\nattacks; contingency procedures; human factor issues such as\npiloting). The SESAR Joint Undertaking (SJU) (CE SESAR) is the R&D platform building the future air\ntraffic management system of the Single European Sky. So it is\nuniquely placed to coordinate this R&D);
\n· \nensure that RPAS operations do not lead to\nfundamental rights being infringed:\nthe progressive integration of RPAS into the airspace from 2016\nonwards must be accompanied by adequate public debate on the\ndevelopment of measures which address societal concerns including\nsafety, privacy and data protection, third-party liability and\ninsurance or security;
\n· \nsupport market development and European\nindustries by recourse to existing EU\ninstruments such as the Horizon 2020 and COSME programmes.
\nThis strategy should provide adequate legal\ncertainty and offer a reliable timing, so that industry can\ntake investment decisions and create employment. As the RPAS market\nis global by its very nature, the EU will also coordinate with\ninternational partners.
\nThe European Commission also intends to bring forward,\nwhere appropriate, legislative proposals to remove legal\nuncertainties that hinder the development of the European\nmarket.
\nThe Committee on Transport and Tourism adopted an\nown-initiative report by Jacqueline FOSTER (ECR, UK) on the safe\nuse of remotely piloted aircraft systems (RPAS), commonly known as\nunmanned aerial vehicles (UAVs), in the field of civil\naviation.
\nStressing the global dimension of piloted aircraft\nsystems and that all the Member States have some RPAS activities,\neither in manufacturing and/or operationally, Members considered\nthat the RPAS sector urgently requires European and global\nrules in order to ensure cross-border RPAS\ndevelopment.
\nA clear European legal framework is needed to\nensure investment and development of a competitive European RPAS\nsector. Moreover, Members believed that this framework might assist\nthe discussions on global rule making for the use of\ndrones.
\nKey issues: recalling\nthe economic importance of this sector, Members stressed that all\nEU policies should take account of the following\naspects:
\nthe need to put in place suitable policies to\nprotect privacy and ensure data protection, safety and\nsecurity, which are proportionate to their aim while not\nimposing an unnecessary burden on SMEs;
\nthe establishment of a clear distinction between\nprofessional and recreational use of remotely piloted\naircraft;
\nthe fact that safety and security are paramount\nfor any RPAS operations and rules and that they must be\ncommensurate with the risks.
\nIn this regard, the report supports the five\nessential principles for future RPAS development set out in the\nRiga Declaration:
\nStressing the importance of\nout-of-sight flights for the development of the\nsector, Members considered that European legislation should favour\nthis modus operandi.
\nIn the long term, technical and regulatory solutions\nshould preferably enable RPAS to use the airspace alongside any\nother airspace user without imposing on the latter new equipment\nrequirements.
\nFuture solutions:\nMembers considered that future European and global rules on RPAS\nshould address issues relating to:
\nFurthermore, the report concentrated on the following\npoints:
\nIn addition, the Joint Authorities for Rulemaking\non Unmanned Systems (JARUS) which is an international voluntary\nmembership body comprising national civil aviation authorities from\n22 EU and non-EU countries and regulatory agencies/bodies could\nensure that any future EU rules will be coordinated with\ninternational arrangements in other countries, through a\nprocess of mutual recognition.
\nMembers took the view that the Parliament must\nestablish its position prior to the Commissions adoption of\nits aviation package, thereby responding to the industry call for\nclear guidance. They called on the TRAN and LIBE committees to\narrange a joint hearing with representatives of industry,\nnational privacy protection organisations, the European Data\nProtection Supervisor, the Commission, and NGOs working in the area\nof fundamental rights.
