PURPOSE: to establish a Union framework for the\ncollection, management and use of data in the fisheries sector and\nsupport for scientific advice regarding the Common Fisheries\nPolicy.

\nROLE OF THE EUROPEAN PARLIAMENT: the European\nParliament decides in accordance with the ordinary legislative\nprocedure and on an equal footing with the Council.
\nBACKGROUND: a number of amendments are to be made to\nCouncil\nRegulation (EC) No 199/2008 concerning the establishment of a\nCommunity framework for the collection, management and use of data\nin the fisheries sector and support for scientific advice regarding\nthe Common Fisheries Policy. In the interests of clarity, that\nRegulation should be recast.
\nData collection is essential for the implementation of\nthe Common Fisheries Policy (CFP), as\na basis for founding it on the best possible scientific\nadvice.
\nData are needed to evaluate the state of fish stocks,\nthe profitability of the different segments of the sector and the\neffects of fisheries and aquaculture on the ecosystem. Data are\nalso needed to evaluate EU policies.
\nFor this reason, an EU framework for the collection\nand management of fisheries data was established in 2000, and then\nreformed in 2008 resulting in the Data Collection Framework\n(DCF).
\nThe 2013 reform of the Common Fisheries Policy (CFP)\nby Regulation\n(EU) No 1380/2013 needs to be matched by adaptations in the\nsupporting scientific advice and therefore the data needed for it.\nThis is particularly relevant in order to achieve maximum\nsustainable yield (MSY) at the latest by 2020, to manage fisheries\ntaking account of their impacts on the ecosystem, and to gradually\nintroduce a landing obligation. The reform of the CFP also requires\nchanges in the way data are obtained, e.g. regionalisation and\ndevolution of tasks from the European Union to Member States in the\ncontext of regional cooperation.
\nThe revision of the DCF is part of the Commission's\nRegulatory Fitness Programme (REFIT) which seeks to cut red tape\nand remove regulatory burden.
\nCONTENT: the changes to be made to the rules laid down\nin Council Regulation (EC) No 199/2008 are essential because of the\nnew needs arising from the CFP reform. The proposal retains the\nkey provisions of the current system: the establishment of an\nEU Multi-annual Programme, to be implemented by national Data\nCollection plans; key obligations in the form of commitments by\nMember States in relation to collection, storage, protection and\nprovision of data; provisions on rights and obligations of\nend-users of data; and provisions on cooperation within and between\nMember States, as well as with and between scientific and\nmanagement bodies.
\nThe proposed modifications compared to the current DCF Regulation are presented\nas follows:
\nBUDGETARY IMPLICATIONS: none which are not\nalready foreseen in the European Maritime and Fisheries Fund (EMFF).
\nDELEGATED ACTS: the proposal contains provisions\nempowering the Commission to adopt delegated acts in accordance\nwith Article 290 of the Treaty on the Functioning of the European\nUnion.
\nThe Committee on Fisheries adopted the report by Marco\nAFFRONTE (EFDD, IT) on the proposal for a regulation of the\nEuropean Parliament and of the Council concerning the establishment\nof a Union framework for the collection, management and use of data\nin the fisheries sector and support for scientific advice regarding\nthe Common Fisheries Policy (recast).
\nThe committee recommended that Parliaments\nposition adopted in first reading following the ordinary\nlegislative procedure should amend the Commission proposal as\nfollows:
\nObjectives: Members\nspecified that the regulation should establish rules on the\ncollection, management, and use of biological, technical,\nenvironmental, social and economic data concerning the fisheries\nsector with a view to contributing to the objectives of the\nCommon Fisheries Policy set out in Regulation\n(EU) No 1380/2013.
\nEstablishment of an EU multiannual\nprogramme: only one programme will be\nin force for the Union. This does not affect the ability of the\nCommission to amend the programme. When setting out the multiannual\nprogramme, the Commission should bear in mind:

\nNational correspondents:\nMember States shall ensure that their national correspondent is\nsufficiently trained and experienced, has a sufficient mandate to\nrepresent its Member State in the expert group meetings, and can\nnegotiate on task sharing with regard to sampling, analysis and\nscientific surveys.
\nCoordination and cooperation: Member States shall make every effort to coordinate\ntheir actions with third countries which have sovereignty or\njurisdiction over waters in the same marine region.
\nMembers introduced an amendment defining the tasks of\nthe Regional Co-ordination Groups so that they might plan their\nactivities.
\nApproval of work plans: the Commission shall adopt implementing acts\napproving the work plans by 31 December of the year preceding the\nyear from which the work plan is to apply.

\nFor this reason, an EU framework for the collection\nand management of fisheries data was established in 2000, and then\nreformed in 2008 resulting in the Data Collection Framework\n(DCF).
\nThe 2013 reform of the Common Fisheries Policy (CFP)\nby Regulation\n(EU) No 1380/2013 needs to be matched by adaptations in the\nsupporting scientific advice and therefore the data needed for it.\nThis is particularly relevant in order to achieve maximum\nsustainable yield (MSY) at the latest by 2020, to manage fisheries\ntaking account of their impacts on the ecosystem, and to gradually\nintroduce a landing obligation. The reform of the CFP also requires\nchanges in the way data are obtained, e.g. regionalisation and\ndevolution of tasks from the European Union to Member States in the\ncontext of regional cooperation.
\nThe revision of the DCF is part of the Commission's\nRegulatory Fitness Programme (REFIT) which seeks to cut red tape\nand remove regulatory burden.
\nCONTENT: the changes to be made to the rules laid down\nin Council Regulation (EC) No 199/2008 are essential because of the\nnew needs arising from the CFP reform. \nCoordination and cooperation: Member States shall make every effort to coordinate\ntheir actions with third countries which have sovereignty or\njurisdiction over waters in the same marine region.
\nMembers introduced an amendment defining the tasks of\nthe Regional Co-ordination Groups so that they might plan their\nactivities.
\nApproval of work plans: the Commission shall adopt implementing acts\napproving the work plans by 31 December of the year preceding the\nyear from which the work plan is to apply.
\nAccess to the sampling sites and data\nsources: with regard to data\ncollection, the Commission shall, five years from the entry into\nforce of the Regulation, set up a single European database\nin order to simplify and facilitate data analysis at European\nlevel.

\nRegional coordination groups shall aim at developing\nand implementing procedures, methods, quality assurance and quality\ncontrol for collecting and processing data with a view to enabling\nthe reliability of scientific advice to be further improved. \nAccess to the sampling sites: the masters of Union fishing vessels may refuse to\naccept on board the scientific observers operating under the at-sea\nmonitoring scheme only on the basis of an obvious lack of space on\nthe vessel or for safety reasons in accordance with national\nlaw. In such cases, data shall be collected through alternative\ndata collection methods which are set out in the national work\nplan.
\nAvailability of data:\nMember States shall refrain from any unnecessary restrictions to\nthe dissemination of detailed and aggregated data to end-users of\nscientific data and other interested parties.
\nA Member State may refuse to transmit the\nrelevant detailed and aggregated data if there is a risk of natural\npersons or legal entities being identified, in which case the\nMember State concerned shall propose alternative means to meet the\nneeds identified by the end-users of scientific data which ensure\nanonymity.
