PURPOSE: to approve the conclusion, by Eurojust, of\nthe Agreement on Cooperation between Eurojust and\nMontenegro.
\nPROPOSED ACT: Council Implementing\nDecision.
\nROLE OF THE EUROPEAN PARLIAMENT: the Council adopts\nthe act after consulting the European Parliament but without being\nobliged to follow its opinion.
\nBACKGROUND: Decision\n2002/187/JHA stipulates that Eurojust may conclude agreements\nwith third States and organisations. Such agreements may, in\nparticular, concern the exchange of information, including personal\ndata, and the secondment of liaison officers or liaison magistrates\nto Eurojust. Such agreements may only be concluded after\nconsultation by Eurojust with the Joint Supervisory Body concerning\nthe provisions on data protection and after the approval by the\nCouncil.
\nIn order to strengthen its capacity to work with\nMontenegro, Eurojust has negotiated an Agreement on Cooperation\nbetween Eurojust and Montenegro.
\nMontenegro has ratified the Council of Europe\nConvention and its Additional Protocol regarding supervisory\nauthorities and transborder data. The Joint Supervisory Body of\nEurojust gave a positive opinion on the provisions of the Agreement\nconcerning data protection. The Agreement was approved by the\nCollege of Eurojust on 9 June 2015.
\nCONTENT: in accordance with the draft implementing\nDecision, Eurojust is hereby authorised to conclude the\nAgreement on Cooperation between Eurojust and\nMontenegro.
\nThe Agreement contains provisions on the exchange of\npersonal data.
\nDenmark, the United Kingdom and Ireland shall take\npart in the adoption and application of this Decision.
\nThe Committee on Civil Liberties, Justice and Home\nAffairs adopted, in the framework of a special legislative\nprocedure (consultation of Parliament), the report by Nathalie\nGRIESBECK (ALDE, FR) on the draft Council implementing decision\napproving the conclusion by Eurojust of the Agreement on\nCooperation between Eurojust and Montenegro.
\nThe committee recommended that Parliament approve\nthe Council draft agreement on cooperation between Eurojust and\nMontenegro with the aim of enhancing judicial cooperation in the\nfight against serious crime in particular organised crime and\nterrorism. The draft agreement contains provisions concerning the\noperational cooperation between Eurojust and Montenegro, such as\nthe secondment of a liaison Prosecutor by Montenegro to Eurojust\nand the exchange of information including personal data.
\nThe explanatory statement accompanying the report\nrecalled that the Joint Supervisory Body of Eurojust (JSB) has\napproved the draft agreement and that all Eurojust amendments to\nthe draft agreement have been taking into account (particularly on\ndata protection).
\nAccordingly, the committee supports the conclusion of\nthis cooperation agreement with Montenegro, since it would aid and\nreinforce the fight against serious crime and would contribute to\nenhancing judicial co-operation, in particular in the field of\norganised crime and terrorism.
\nThe European Parliament adopted by 567 votes to 58,\nwith 63 abstentions, a legislative resolution on the draft Council\nimplementing decision approving the conclusion by Eurojust of the\nAgreement on Cooperation between Eurojust and\nMontenegro.
