PURPOSE: to conclude the Framework Agreement between\nthe European Union and its Member States, of the one part, and New\nZealand, of the other part.
\nPROPOSED ACT: Council Decision.
\nROLE OF THE EUROPEAN PARLIAMENT: Council may adopt the\nact only if Parliament has approved the latter.
\nBACKGROUND: on 25 June 2012, the Council adopted a\ndecision authorising the Commission and the High Representative of\nthe Union for Foreign Affairs and Security Policy to negotiate a\nFramework Agreement between the European Union and its Member\nStates, of the one part, and New Zealand, of the other part.\nNegotiations began in July 2012 and the Agreement was signed on 5\nOctober 2016. Pending its entry into force, certain parts of the\nAgreement, as mutually determined by the EU and New Zealand, are\nprovisionally applied.
\nThe Agreement will contribute significantly to the\nimprovement of the partnership between the EU and New Zealand, a\npartnership which is based on common values and principles,\nincluding respect for democratic principles, human rights and\nfundamental freedoms, the rule of law, international peace and\nsecurity. The Agreement is premised on respect for human rights and\ndemocratic principles, and for international law and the principles\nset out in the Charter of the United Nations, which constitute the\nbasis for cooperation between the Parties.
\nNote on legal basis: the\nAgreement pursues objectives and has components in the areas of the\ncommon foreign and security policy, the common commercial policy\nand development cooperation. These aspects of the agreement are\ninseparably linked without one being incidental to the\nother.
\nArticle 218(6)(a)(iii) of the Treaty on the\nFunctioning of the European Union (TFEU) provides that, where an\nagreement establishes a specific institutional framework by\norganising cooperation procedures, the Council must adopt a\ndecision concluding the agreement after obtaining the consent of\nthe European Parliament. Moreover, the second subparagraph of\nArticle 218(8) of the TFEU provides that the Council must act\nunanimously when the agreement covers a field for which unanimity\nis required for the adoption of a Union act. The common foreign and\nsecurity policy is a field for which unanimity is required for the\nadoption of a Union act. Equally, the Agreement establishes an\ninstitutional framework by organising cooperation procedures\nbetween the EU and its Member States, of the one part, and New\nZealand, of the other part.

\nThe content of the Agreement covers three\npillars:
\n-political cooperation on foreign policy and security\nissues of common interest, including\nweapons of mass destruction (WMD), small arms and light weapons\n(SALW), counter-terrorism, promoting international peace and\nsecurity and cooperation in multilateral fora. \nThe objective of the Agreement is to strengthen the\ncooperation across a wide spectrum of policy fields,\nincluding:

\nThe committee recommended the European Parliament to\ngive its consent to the conclusion of the\nagreement.
\nThe European Parliament adopted by 511 votes to 57,\nwith 40 abstentions, a legislative resolution on the draft Council\ndecision on the conclusion on behalf of the Union of the\nPartnership Agreement on Relations and Cooperation between the\nEuropean Union and its Member States, of the one part, and New\nZealand, of the other part.
\nIn line with the recommendation of its Committee on\nForeign Affairs, Parliament gave its consent to conclusion of the\nagreement.
\nParliament also adopted a non-legislative\nresolution on the draft decision.
