PURPOSE: the launch of an automated data exchange with\nregard to DNA in Greece.
\nPROPOSED ACT: Council Implementing\nDecision.
\nROLE OF THE EUROPEAN PARLIAMENT: the Council adopts\nthe act after consulting the European Parliament but without being\nobliged to follow its opinion.
\nBACKGROUND: according to Decision\n2008/615/JHA on the stepping up of cross-border cooperation,\nparticularly in combating terrorism and cross-border crime, the\nsupply of personal data provided for under that Decision may not\ntake place until the general provisions on data protection set out\nin that Decision have been implemented in the national law of the\nterritories of the Member States involved in such\nsupply.
\nCouncil\nDecision 2008/616/JHA on the\nimplementation of Decision 2008/615/JHA provides that the\nverification that the above condition has been met with respect to\nautomated data exchange and is to be done on the basis of an\nevaluation report based on: (i) a questionnaire drawn up by the\nrelevant Council Working Group concerns each of the automated data\nexchanges; (ii) an evaluation visit and (iii) a pilot\nrun.
\nGreece has completed the questionnaire on data\nprotection and the questionnaire on DNA data exchange. A successful\npilot run has been carried out by Greece with the\nNetherlands.
\nAn evaluation visit has taken place in Greece and a\nreport on the evaluation visit has been produced by the Dutch\nevaluation team.
\nOn 13 October 2016, the Council, having noted the\nagreement of all Member States bound by Decision 2008/615/JHA,\nconcluded that Greece had fully implemented the general provisions\non data protection set out in Chapter 6 of Decision\n2008/615/JHA.
\nCONTENT: the proposed implementing Council Decision\nseeks to authorise Greece to receive and supply personal\ndata pursuant to Decision 2008/615/JHA as from the date of the\nentry into force of this Decision for the purposes of automated\nsearching and comparison of DNA data.
\nAs the conditions for triggering the exercise of such\nimplementing powers have been met and the procedure in this regard\nhas been followed, an Implementing Decision on the launch of\nautomated data exchange with regard to DNA data in Greece should be\nadopted in order to allow that Member State to receive and supply\npersonal data pursuant to Articles 3 and 4 of Decision\n2008/615/JHA.
\nThe United Kingdom and Ireland shall participate in\nthe proposed Decision.
\nThe Committee on Civil Liberties, Justice and Home\nAffairs adopted, following Parliaments consultation\nprocedure, the report by Claude MORAES (S&D, UK) on the draft\nCouncil implementing decision on the launch of automated data\nexchange with regard to DNA data in Greece.
\nThe committee recommended the European Parliament to\napprove the Council draft which seeks to authorise Greece to\nreceive and supply personal data pursuant to Decision 2008/615/JHA\nas from the date of the entry into force of this Decision for the\npurposes of automated searching and comparison of DNA\ndata.
\nThe European Parliament adopted by 597 votes to 61,\nwith 30 abstentions, following the consultation procedure, a\nlegislative resolution on the draft Council implementing decision\non the launch of automated data exchange with regard to DNA data in\nGreece.
\nParliament approved, without amendment, the\nCouncil draft which seeks to authorise Greece to receive and supply\npersonal data pursuant to Decision 2008/615/JHA as from the date of\nthe entry into force of this Decision for the purposes of automated\nsearching and comparison of DNA data.
\nPURPOSE: to authorise Greece to receive and supply\npersonal data with regard to DNA data in Greece.
\nNON-LEGISLATIVE ACT: Council Implementing Decision\n(EU) 2017/617 on the launch of automated data exchange with regard\nto DNA data in Greece.
\nCONTENT: this Council Implementing Decision authorises\nGreece to receive and supply personal data in accordance\nwith Decision 2008/615/JHA for the purpose of automated searching\nand comparison of DNA data, as from 2 April 2017.
\nAs a reminder, Council\nDecision 2008/615/JHA on the stepping up of cross-border\ncooperation, in particular with a view to combating terrorism and\ncross-border crime, provides that the supply of personal data may\nnot take place until the general provisions on data protection have\nbeen implemented in the national law of the territories of the\nMember States involved in such supply.
\nAn overall evaluation report, including a summary of\nthe results of the data protection questionnaire sent to Greece,\nthe evaluation visit to Greece and the pilot test with the\nNetherlands was presented to the Council.
\nOn 13 October 2016, the Council concluded that Denmark\nhad fully implemented the general provisions on data protection set\nout in Decision 2008/615/JHA.
