PURPOSE: to extend the period for the adoption of delegated acts set out in Directive 2010/40/EU.

LEGISLATIVE ACT: Decision (EU) 2017/2380 of the European Parliament and of the Council amending Directive 2010/40/EU as regards the period for adopting delegated acts.

CONTENT: Directive 2010/40/EU of the European Parliament and the Council on the framework for the deployment of Intelligent Transport Systems in the field of road transport and for interfaces with other modes of transport requires that specifications be adopted, through delegated acts, for actions in four priority areas.

Since the entry into force of Directive 2010/40/EU, four delegated acts relating to priority actions of that Directive have been adopted by the Commission. They address in particular eCall and data sharing mechanisms facilitating the electronic data exchange between the relevant public authorities and stakeholders and the relevant ITS service providers.

There is a need for further delegated acts regarding actions still to be addressed and belonging to the scope of Directive 2010/40/EU.

This Decision extends the Commission’s power to adopt delegated acts with regard to the specifications necessary to ensure compatibility, interoperability and continuity for the deployment and operational use of Intelligent Transport Systems (ITS) for the priority actions.

The Commission shall adopt such acts for an additional period of five years from 27 August 2017 . This period may be tacitly extended for periods of an identical duration.

Before adopting a delegated act, the Commission must consult the experts designated by each Member State.

The Parliament and the Council shall have two months to express objections to a delegated act as from the notification of the act. This period shall be extended by two months at the initiative of the European Parliament or the Council.

Details

The European Parliament adopted by 615 votes to 36, with 18 abstentions, a legislative resolution on the proposal for a decision of the European Parliament and of the Council amending Directive 2010/40/EU as regards the period for adopting delegated acts.

The European Parliament’s position, adopted at first reading under the ordinary legislative procedure, amended the Commission proposal as follows:

Parliament clarified that the Commission shall have the power to adopt delegated acts with regard to the specifications necessary to ensure compatibility, interoperability and continuity for the deployment and operational use of Intelligent Transport Systems (ITS) for the priority actions.

The Commission shall adopt such acts for a period of five years from 27 August 2017. This period may be tacitly extended for periods of an identical duration, unless the European Parliament or the Council opposes this extension.

The delegation of power may be revoked at any time by the European Parliament or the Council.

Before adopting a delegated act, the Commission shall consult the experts designated by each Member State in accordance with the principles laid down in the Interinstitutional Agreement of 13 April 2016 on Better Lawmaking.

The Parliament and the Council shall have two months to express objections to a delegated act as from the notification of the act. This period shall be extended by two months at the initiative of the European Parliament or the Council.

ROLE OF THE EUROPEAN PARLIAMENT: the European Parliament decides in accordance with the ordinary legislative procedure and on an equal footing with the Council.

BACKGROUND: Directive 2010/40/EU of the European Parliament and the Council on the framework for the deployment of Intelligent Transport Systems in the field of road transport and for interfaces with other modes of transport (the ITS Directive) requires that specifications be adopted, through delegated acts, for actions in four priority areas .

Since the entry into force of Directive 2010/40/EU, four delegated acts relating to priority actions of that Directive have been adopted by the Commission. They address in particular eCall and data sharing mechanisms facilitating the electronic data exchange between the relevant public authorities and stakeholders and the relevant ITS service providers.

Not extending the delegation of power to the Commission would endanger the EU-wide integrated and coordinated deployment of interoperable ITS in road transport and their interfaces with other transport modes.

PURPOSE: to extend the period for the adoption of delegated acts set out in Directive 2010/40/EU.

LEGISLATIVE ACT: Decision (EU) 2017/2380 of the European Parliament and of the Council amending Directive 2010/40/EU as regards the period for adopting delegated acts.

CONTENT: Directive 2010/40/EU of the European Parliament and the Council on the framework for the deployment of Intelligent Transport Systems in the field of road transport and for interfaces with other modes of transport requires that specifications be adopted, through delegated acts, for actions in four priority areas.

Since the entry into force of Directive 2010/40/EU, four delegated acts relating to priority actions of that Directive have been adopted by the Commission. They address in particular eCall and data sharing mechanisms facilitating the electronic data exchange between the relevant public authorities and stakeholders and the relevant ITS service providers.

There is a need for further delegated acts regarding actions still to be addressed and belonging to the scope of Directive 2010/40/EU.

This Decision extends the Commission’s power to adopt delegated acts with regard to the specifications necessary to ensure compatibility, interoperability and continuity for the deployment and operational use of Intelligent Transport Systems (ITS) for the priority actions.

The Commission shall adopt such acts for an additional period of five years from 27 August 2017. This period may be tacitly extended for periods of an identical duration.

Before adopting a delegated act, the Commission must consult the experts designated by each Member State.

The Parliament and the Council shall have two months to express objections to a delegated act as from the notification of the act. This period shall be extended by two months at the initiative of the European Parliament or the Council.

  • The European Parliament adopted by 615 votes to 36, with 18 abstentions, a legislative resolution on the proposal for a decision of the European Parliament and of the Council amending Directive 2010/40/EU as regards the period for adopting delegated acts.

    The European Parliament’s position, adopted at first reading under the ordinary legislative procedure, amended the Commission proposal as follows:

    Parliament clarified that the Commission shall have the power to adopt delegated acts with regard to the specifications necessary to ensure compatibility, interoperability and continuity for the deployment and operational use of Intelligent Transport Systems (ITS) for the priority actions.

    The Commission shall adopt such acts for a period of five years from 27 August 2017. This period may be tacitly extended for periods of an identical duration, unless the European Parliament or the Council opposes this extension.

    The delegation of power may be revoked at any time by the European Parliament or the Council.

    Before adopting a delegated act, the Commission shall consult the experts designated by each Member State in accordance with the principles laid down in the Interinstitutional Agreement of 13 April 2016 on Better Lawmaking.

  • The Committee on Transport and Tourism adopted the report by Gesine MEISSNER (ALDE, DE) on the proposal for a decision of the European Parliament and of the Council amending Directive 2010/40/EU as regards the period for adopting delegated acts.

    The committee recommended that the European Parliament’s position, adopted at first reading under the ordinary legislative procedure, should amend the Commission proposal as follows:

    ROLE OF THE EUROPEAN PARLIAMENT: the European Parliament decides in accordance with the ordinary legislative procedure and on an equal footing with the Council.

    BACKGROUND: Directive 2010/40/EU of the European Parliament and the Council on the framework for the deployment of Intelligent Transport Systems in the field of road transport and for interfaces with other modes of transport (the ITS Directive) requires that specifications be adopted, through delegated acts, for actions in four priority areas.

    Since the entry into force of Directive 2010/40/EU, four delegated acts relating to priority actions of that Directive have been adopted by the Commission. They address in particular eCall and data sharing mechanisms facilitating the electronic data exchange between the relevant public authorities and stakeholders and the relevant ITS service providers.

    There is a need for further delegated acts regarding actions still to be addressed and belonging to the scope of Directive 2010/40/EU.

    Not extending the delegation of power to the Commission would endanger the EU-wide integrated and coordinated deployment of interoperable ITS in road transport and their interfaces with other transport modes.

    CONTENT: the proposal seeks to extend the delegation of power for an additional period of five years starting from 27 August 2017. This period should be tacitly extended for periods of the same duration, unless the European Parliament or the Council oppose such an extension.
