PURPOSE: to conclude, on behalf of the European Union,\nof the Council of Europe Convention on the manipulation of sports\ncompetitions with regard to matters not related to substantive\ncriminal law and judicial cooperation in criminal\nmatters.
\nPROPOSED ACT: Council Decision.
\nROLE OF THE EUROPEAN PARLIAMENT: Council may adopt the\nact only if Parliament has given its consent to the act.
\nBACKGROUND: in order to respond to the challenge of\nmatch-fixing, a practice often linked to organised criminal\nnetworks operating on a global scale, the Council of Europe invited\nthe parties to the European Cultural Convention in 2012 to begin\n negotiations for a Convention of the Council of Europe\nagainst the manipulation of sports results.
\nOn 9 July 2014, the Ministers Deputies of the\nCouncil of Europe adopted the Convention on the Manipulation of\nSports Competitions. The Convention was opened for signature by\nthe European Union and several Member States have signed\nit.
\nIn March 2015, the Commission presented to the Council\ntwo proposals for the Council's decisions on the signing of\nthe Convention on behalf of the Union:
\nThe Commissions proposals were last discussed in\nCoreper in November 2015. At this occasion the Presidency concluded\nthat it would not proceed with the file until it had\nobtained the consent of all delegations.
\nAgainst this background, the Union has not yet\nsigned the Convention.
\nThe Commission considers that the signature of the\nConvention should be part of the Union's efforts to participate in\nthe fight against match fixing in conjunction with other tools such\nas the forthcoming Commission initiative on betting-related\nmatch-fixing in line with the 2012\nCommission Communication on online gambling.
\nThe present proposal concerns the legal instrument\nconcluding the agreement.
\nCONTENT: the Commission proposes that the Council\napproves, on behalf of the Union, the conclusion of the Council\nof Europe Convention on the manipulation of sports\ncompetitions.
\nThe purpose of the Convention to combat the\nmanipulation of sports competitions in order to protect the\nintegrity of sport and sports ethics in accordance with the\nprinciple of the autonomy of sport. It does so by taking a\nnumber of measures that aim at preventing, detecting and\nsanctioning the manipulation of sports competitions.
\nIn view of that purpose, the Convention also promotes\ninternational cooperation and sets-up a monitoring mechanism to\nensure that the provisions laid down in the Convention are followed\nup.
\nThe legal bases for this proposal for a\ndecision should be Articles 114 TFEU (establishment and functioning\nof the internal market), Article 165 TFEU (sports) and in\nconjunction with the Article 218(6) (a) of the TFEU.
\nSome of the provisions of\nthe Convention concern substantive criminal law and judicial\ncooperation in criminal matters fall within the scope of Part 3,\nTitle V, of the TFEU. A separate proposal for a decision on these provisions is therefore proposed alongside\nthis proposal.
