PURPOSE: to repeal Regulation (EU) No 256/2014 of the\nEuropean Parliament and of the Council concerning the notification\nto the Commission of investment projects in energy infrastructure\nwithin the European Union.
\nPROPOSED ACT: Regulation of the European Parliament\nand of the Council.
\nROLE OF THE EUROPEAN PARLIAMENT: the European\nParliament decides in accordance with the ordinary legislative\nprocedure on an equal footing with the Council.
\nBACKGROUND: this proposal to repeal Regulation\n(EU) No 256/2014 is put forward in the context of the\nCommissions REFIT programme and commitment on better\nregulation.
\nThe European Parliament, the Council of the European\nUnion and the European Commission confirmed their joint commitment\nto updating and simplifying legislation in the Interinstitutional\nAgreement on Better Law-Making of 13 April 2016.
\nRepealing such legislation keeps the legislative\nframework transparent, clear and easy to use.
\nRegulation (EU) No 256/2014 was adopted to ensure that\nthe EUs energy policy develops in an effective way and\nresponds to the EUs real needs. This Regulation was supported\nby Commission implementing Regulation (EU) No 1113/2014. Together,\nthese regulations required the Member States to notify the\nCommission of investment projects for which construction or\ndecommissioning work has started or for which a final investment\ndecision has been taken.
\nMember States have gone through three reporting\nexercises (2011, 2013 and 2015) since the obligations under\nthis Regulation and its predecessor, Council Regulation No\n617/2010, have been in place.
\nIn 2016, the Commission carried out the review of\nRegulation (EU) No 256/2014, including a stakeholder\nconsultation covering all planning and reporting obligations in\nthe energy sector. It concluded that:
\nFurthermore, it was noted that the Commission had\ndirect access to market data via its Energy Market Observation\nSystem (EMOS).
\nConsidering that Regulation (EU) No 256/2014 has\ntherefore not delivered the expected results, the Commission\nproposes to repeal Regulation (EU) No 256/2014.
\nCONTENT: the proposal seeks to repeal Regulation\n(EU) No 256/2014 of the European Parliament and of the Council\nof 26 February 2014 concerning the notification to the Commission\nof investment projects in energy infrastructure within the European\nUnion, replacing Council Regulation (EU, Euratom) No 617/2010 and\nrepealing Council Regulation (EC) Nº 736/96.
\nThe Committee on Industry, Research and Energy adopted\nthe report by Barbara KAPPEL (ENF, AT) on the proposal for a\nregulation of the European Parliament and of the Council repealing\nRegulation (EU) No 256/2014 of the European Parliament and of the\nCouncil concerning the notification to the Commission of investment\nprojects in energy infrastructure within the European\nUnion.
\nThe committee recommended that the European Parliament\nadopt its position at first reading, taking over the\nCommission proposal.
\nThe European Parliament adopted by 417 votes to 230,\nwith 33 abstentions, a legislative resolution on the proposal for a\nregulation of the European Parliament and of the Council repealing\nRegulation (EU) No 256/2014 of the European Parliament and of the\nCouncil concerning the notification to the Commission of investment\nprojects in energy infrastructure within the European\nUnion.
\nThe European Parliament adopted its position at first\nreading taking over the Commission proposal.
\nAs a reminder, Regulation (EU) No 256/2014 of the\nEuropean Parliament and of the Council required Member States to\nnotify the Commission of investment projects on which construction\nor decommissioning work has started or on which a final investment\ndecision has been taken.
\nThe review of Regulation (EU) No 256/2014 concluded\nthat there were significant overlaps between reporting obligations\nunder Regulation (EU) No 256/2014 and the reporting obligations to\nthe Energy Transmission System Operators ENTSO-E and ENTSO-G.
