PURPOSE: to approve the conclusion by the European\nPolice Office (Europol) of the Agreement on operational and\nstrategic cooperation between Denmark and Europol.
\nPROPOSED ACT: Council Implementing\nDecision.
\nROLE OF THE EUROPEAN PARLIAMENT: the Council adopts\nthe act after consulting the European Parliament but without being\nobliged to follow its opinion.
\nBACKGROUND: further to Decision 2009/371/JHA\nestablishing the European Police Office\n(Europol) and Decision 2009/934/JHA adopting\nthe implementing rules governing Europol's relations with its\npartners, Europol shall conclude agreements with third countries\nwhich have been included in the list established by Decision\n2009/935/JHA determining the list of third States and organisations\nwith which EUROPOL shall conclude agreements.
\nThe aim of these agreements is to support the action\nof the competent authorities of the Member States and their mutual\ncooperation in preventing and combating organised crime and\nterrorism and may concern the exchange of operational,\nstrategic or technical information, Including personal data and\nclassified information.
\nAccording to Council Implementing Decision (EU) 2017/290, Denmark is included in the list of countries annexed\nto Decision 2009/935/JHA with which Europol will conclude\nagreements. The reason for Denmark's inclusion is that the new\nEuropol Regulation (Regulation (EU) 2016/794), by which Denmark is not bound, will apply from 1\nMay 2017. Consequently, Denmark will be considered as a third\ncountry vis-à-vis Europol as of that date.
\nIn view of the need to ensure that Europol and\nDenmark cooperate on key issues relating to security threats,\nEuropol has started the procedure for concluding an agreement on\noperational and strategic cooperation between Denmark and\nEuropol.
\nThe Europol Management Board approved the Operational\nand Strategic Agreement on 11 and 12 May 2016.
\nCONTENT: Under the draft Council Implementing\nDecision, Europol would be authorised to conclude the Agreement\non operational and strategic cooperation in the fight against\nserious crime and terrorism between Denmark and Europol.
\nThe terms of cooperation covered by the\nAgreement provide for the exchange of information, which may\ninclude expertise, results of strategic analysis, information on\ncriminal investigation procedures and information on crime\nprevention methods, as well as participation in training activities\nand the provision of advice and support in certain criminal\ninvestigations.
\nThe agreement also contains provisions on the\nexchange of personal data.
\nIn view of the fact that Denmark is both an EU Member\nState and a Member State of the Schengen Area, a number of specific\nprovisions have been incorporated into the Agreement concerning,\nfor example:
\nDenmark, the United Kingdom and Ireland shall\nparticipate in the adoption and application of the implementing\ndecision.
\nThe European Parliament adopted by 569 votes to 8,\nwith 62 abstentions, following the consultation procedure, a\nlegislative resolution on the draft Council implementing decision\napproving the conclusion by the European Police Office (Europol) of\nthe Agreement on Operational and Strategic Cooperation between the\nKingdom of Denmark and Europol.
\nIn line with its Committee on Civil Liberties, Justice\nand Home Affairs, Parliament approved the Council\ndraft.
\nMembers called for the Parliament to be kept\nregularly informed and consulted, pursuant to Article 25 of the\nAgreement on Operational and Strategic Cooperation between the\nKingdom of Denmark and Europol, in particular through the Europol\nJoint Parliamentary Scrutiny Group to be established pursuant to\nthe Europol Regulation (Regulation\n(EU) 2016/794).

\nIn order to minimise the negative effects of the\nDanish departure from Europol, it is proposed in a joint statement\nby the European Council, the President of the European Commission\nand the Prime Minister of Denmark (15 December 2016), that Denmark\nbe associated to Europol in the form of an operational cooperation\nagreement.
\nOn 14 February 2017, the European Parliament adopted\nwith an overwhelming majority the recommendation\nto amend Decision 2009/935/JHA in order to place Denmark on the\nlist of third States and organisations with which Europol shall\nconclude international cooperation agreements.
\nThis report concerns Parliaments consultation on\nthe draft operational cooperation agreement between Europol and\nDenmark,
