PURPOSE: to authorise EUROJUST to approve a Memorandum\nof Understanding between the eu-LISA Agency and\nEurojust.
\nPROPOSED ACT: Council Implementing\nDecision.
\nROLE OF THE EUROPEAN PARLIAMENT: the Council adopts\nthe act after consulting the European Parliament but without being\nobliged to follow its opinion.
\nBACKGROUND: in accordance with Council Decision\n2002/187/JHA, Eurojust may conclude agreements or working\narrangements with the institutions, bodies and agencies set up by,\nor on the basis of, the Treaties. These agreements may, in\nparticular, concern the exchange of information, including\npersonal data, and the secondment of liaison officers to\nEurojust.
\nIn order to strengthen its capacity to work with the\nEuropean Agency for the operational management of large-scale IT\nsystems in the area of freedom, security and justice ('eu-LISA'),\nEurojust has negotiated a Memorandum of Understanding between\neu-LISA and Eurojust.
\nIt is now necessary to approve the conclusion by\nEurojust of the Memorandum.
\nCONTENT: the draft Council Implementing Decision seeks\nto authorise Eurojust to conclude the Memorandum of Understanding\nbetween the eu-LISA Agency and Eurojust.
\nPurpose of the agreement: the purpose of this Memorandum of Understanding is\nto establish a cooperation framework between the Parties by\nidentifying the areas of cooperation based on common\ninterest.
\nAreas of cooperation:\nthe Parties agree to cooperate by exchanging expertise and best\npractices in the following areas:
\nPersonal data: it is\nprovided that the exchange of information shall not include the\ntransmission of operational information including data relating\nto an identified or identifiable person.
\nThe Memorandum of Understanding sets out the content\n(non-exhaustive) of the information that may be\nexchanged.
\nEach Party shall ensure that information, including EU\nclassified information (EUCI) and non-classified sensitive\ninformation provided or exchanged under this Memorandum of\nUnderstanding is protected according to their respective security\nrules and principles as referred to in their respective\nestablishing acts. Confidentiality rules are thus provided for this\npurpose.
\nThe Committee on Civil Liberties, Justice and Home\nAffairs adopted, following a special legislative procedure\n(Parliaments consultation), the report by Claude MORAES\n(S&D, UK) on the draft Council implementing decision approving\nthe conclusion by Eurojust of the Memorandum of Understanding\nbetween the European Agency for the operational management of\nlarge-scale IT systems in the area of freedom, security and justice\n(eu-LISA) and Eurojust.
\nThe committee called on the European Parliament to\napprove the Council draft.
\nThe aim of this Memorandum of Understanding is to\nestablish a cooperation framework between the two Parties by\nidentifying the areas of cooperation based on common\ninterest.
\nThe European Parliament adopted by 597 votes, to 64\nwith 6 abstentions, following the consultation procedure, a\nlegislative resolution on the draft Council implementing decision\napproving the conclusion by Eurojust of the Memorandum of\nUnderstanding between the European Agency for the operational\nmanagement of large-scale IT systems in the area of freedom,\nsecurity and justice and Eurojust.
\nParliament approved the Council\ndraft.
