The European Parliament adopted by 490 votes to 54,\nwith 38 abstentions, a resolution on the implementation of\nDirective 2005/36/EC on the implementation of Directive 2005/36/EC\nas regards regulation and the need for reform in professional\nservices.
\nBackground: Directive\n2005/36/EC of the European Parliament and of the Council on the\nrecognition of professional qualifications provides for\nautomatic recognition for a number of professions on the basis of\nharmonised minimum training requirements, a general system for the\nrecognition of professional qualifications, an automatic\nrecognition system for professional experience, and a new system of\ncross border provision of services in the context of regulated\nprofessions.
\nIn 2013, Directive 2013/55/EU, amending Directive\n2005/36/EC introduced in its Article 59 a transparency and\nmutual evaluation exercise for all regulated professions in the\nMember States, whether they are regulated on the basis of national\nrules or on the basis of rules harmonised at EU level.
\nAccording to Article 59 of Directive 2005/36/EC the\nCommission was expected to present by 18 January 2017 its\nconclusions on the mutual evaluation exercise, together with\nproposals for further initiatives where necessary.
\nOn 10 January 2017, the Commission presented a communication\non reform needs in professional services, analysing professional\nregulation in seven sectors of activity and addressing\nrecommendations to Member States in this regard.
\nReview of the implementation of Article 59 of\nDirective 2005/36/EC: there are more\nthan 5 500 regulated professions across the EU, representing 22% of\nthe workforce in all sectors.
\nParliament stressed that regulated professions play a\nfundamental role in the EU economy, making a major contribution to\nthe employment rate, as well as to labour mobility and added value\nin the Union. It stressed the paramount importance of high-quality\nprofessional services and an effective regulatory environment in\npreserving the EU economic, social and cultural model and in\nsafeguarding legitimate public interest\nobjectives.
\nMembers stressed in particular the need to improve\nthe transparency and comparability of the national requirements\ngoverning access to or pursuit of regulated professions could\nenable greater professional mobility. Also, all national\nrequirements should be made available to the public in the\nRegulated Professions Database in a clear and intelligible\nmanner.

\nThe Commission, as guardian of the Treaties, should\ntake measures and initiate infringement procedures where it\nidentifies discriminatory, unjustified or disproportionate\nlegislation.
\nRestrictiveness indicator: the Commission has issued a new indicator on the\nrestrictiveness of professional regulation. The resolution analysed\nthe usefulness of this indicator and the need to promote high\nquality services in Europe. It emphasised that this indicator\nshould be used as a purely indicative tool, and not as one\npermitting the drawing of conclusions as to whether what may be\nstricter regulation in some Member States is\ndisproportionate.
\nIn addition, Members recalled that the overall\nanalysis of the impact of the regulations in Member States\nshould be subject not only to a quantitative but also to a\nqualitative assessment encompassing the general interest\nobjectives and the quality of the service provided, including the\npossible indirect benefits for citizens and the labour\nmarket.
\nFuture of regulated professions: Parliament stressed the need for an effective\nregulatory framework in the Union and the Member States, but\nalso for effective and coordinated policies aimed at supporting\nprofessionals in the EU and strengthening competitiveness,\ninnovation capacity and the quality of professional services in the\nEU. Members States shall undertake proper market analysis with a\nview to developing policies for making EU professional services\nglobally competitive in future decades.
\nMembers also stressed the importance of education,\nskills development and entrepreneurial training so that European\nprofessionals may remain competitive and be able to cope with the\nchanges affecting the liberal professions as a result of\ninnovation, digitalisation and globalisation.
\nIn this respect, they welcomed the Commissions\nacknowledgement of the need to reflect on the impact of new\ntechnologies in the field of professional services,\nparticularly in the legal and accounting sectors where procedures\ncould be improved.
\nThe Commission is called on to continue to keep\nParliament regularly informed on the state of play regarding\ncompliance with Directive 2005/36/EC by the Member\nStates.

\nBackground: Directive\n2005/36/EC of the European Parliament and of the Council on the\nrecognition of professional qualifications provides for\nautomatic recognition for a number of professions on the\nbasis of harmonised minimum training requirements, a general system\nfor the recognition of professional qualifications, an automatic\nrecognition system for professional experience, and a new system of\ncross border provision of services in the context of regulated\nprofessions.
\nIn 2013, Directive 2013/55/EU, amending Directive\n2005/36/EC introduced in its Article 59 a transparency and\nmutual evaluation exercise for all regulated professions in the\nMember States, whether they are regulated on the basis of national\nrules or on the basis of rules harmonised at EU level.
\nAccording to Article 59 of Directive 2005/36/EC the\nCommission was expected to present by 18 January 2017 its\nconclusions on the mutual evaluation exercise, together with\nproposals for further initiatives where necessary.
