PURPOSE: presentation by the Commission of the\nconsolidated annual accounts of the European Union for the\nfinancial year 2016, as part of the 2016 discharge procedure:\nperformance, financial management and control.
\nLegal reminder: the\nconsolidated annual accounts of the European Union for the year\n2016 have been prepared on the basis of the information presented\nby the institutions and bodies under Article 148(2) of the\nFinancial Regulation applicable to the general budget of the\nEuropean Union.
\nThe document focuses on the performance, financial\nmanagement and control of the EUs accounts in\ngeneral.
\nPerformance: implementing\nrobust performance frameworks is essential for ensuring a strong\nfocus on results, EU added value and sound management of EU\nprogrammes. The Commission is committed to ensuring that the EU\nbudget achieves better outcomes for citizens and that supports the\npolitical priorities. To ensure resources are allocated to\npriorities and that every action brings high performance and added\nvalue, the Commission implements its EU Budget Focused on Results\ninitiative. Building on the 20142020 performance framework,\nit promotes a better balance between compliance and\nperformance.
\nThe\n2014-2020 performance frameworks have been included as a new\ncompulsory element and as a key pillar of the increased result\norientation of this programming period. It foresees the\nestablishment of clear and measureable objectives, indicators and\ntargets as well as monitoring, reporting and evaluation\narrangements.
\nFinancial management: the main\nelement of EU financial reporting is the Integrated Financial\nReporting Package (IFRP) of the EU which comprises the consolidated\nannual accounts of the EU and other reports accompanying the\naccounts, i.e. the Annual Management and Performance Report for the\nbudget and the report on the follow-up to the discharge. The Annual\nManagement and Performance Report for the EU budget provides a\ncomprehensive overview on the performance, management and\nprotection of the EU budget. It explains how the EU budget supports\nthe European Unions political priorities, the results\nachieved with the EU budget, and the role the Commission plays in\nensuring and promoting the highest standards of budgetary and\nfinancial management.
\nThe\nIFRP provides the public with a comprehensive view of the financial\nand operational situation of the EU each year.
\nThe\nconsolidated annual accounts of the EU provide financial\ninformation on the activities of the institutions, agencies and\nother bodies of the EU from both an accrual accounting and\nbudgetary perspective. These accounts do not comprise the annual\naccounts of Member States.
\nThe\nconsolidated annual accounts of the EU consist of two separate but\nlinked parts:
\nControls: the European Court\nof Auditors (the Court) is the external auditor of the EU\ninstitutions (and bodies). The Court's mission is to contribute to\nimproving EU financial management, promote accountability and\ntransparency, and act as the independent guardian of the financial\ninterests of the citizens of the EU. The Courts role as the\nEUs independent external auditor is to check that EU\nfunds are correctly accounted for, are raised and spent in\naccordance with the relevant rules and regulations and have\nachieved value for money.
\nThe\nEUs annual accounts and its resource management are audited\nby the Court, which, as part of its activities, draws up for the EP\nand the Council:
\nDischarge: the final step\nof a budget lifecycle is the discharge of the budget for a\ngiven financial year. A discharge is given to the Commission and\nall other EU institutions and bodies. The discharge represents the\npolitical aspect of the external control of budget implementation\nand is the decision by which the European Parliament, acting on a\nCouncil recommendation, \"releases\" the Commission (and other\nEU bodies) from its responsibility for management of a given budget\nby marking the end of that budget's existence. The European\nParliament is the discharge authority within the EU. This means\nthat following the audit and finalisation of the annual accounts it\nfalls to the Council to recommend and then to the European\nParliament to give a discharge to the Commission and other EU\nbodies for implementing the EU budget for a given financial year.\nThis decision is based on an examination of the annual accounts,\nthe Commission's annual management and performance report for the\nbudget, the annual report, the audit opinion and special reports of\nthe Court, and replies of the Commission to questions and further\ninformation requests.
\nThis discharge procedure may produce three\noutcomes:
\nThe Committee on Budgetary Control adopted the\nreport by Bart STAES (Greens/EFA, BE) on discharge in respect of\nthe implementation of the budget of the European Union agencies for\nthe financial year 2016: performance, financial management and\ncontrol.
\nMembers emphasised that the agencies are highly\nvisible in the Member States and have significant influence on\npolicy and decision making and programme implementation in areas of\nvital importance to European citizens, such as health, safety,\nsecurity, freedom and justice, research and industrial development,\neconomic and monetary affairs, employment and social\nprogress.
\nThey expressed concern that in general the\nvisibility of agencies for European citizens is still\nlimited, whereas a high level of visibility is required for\ntheir accountability and independence.
\nOn a budgetary level, Members noted that\nthe agencies 2016 budget amounted to some EUR 3.4 billion,\nrepresenting an increase of about 21.42 % compared to 2015 and\nabout 2.4 % (compared to: 2 % in 2015) of the Unions general\nbudget. They pointed out that the increase is mainly related to\nagencies working on matters related to industry, research and\nenergy (additional EUR 358 million) and civil liberties, justice\nand home affairs (additional EUR 174 million).
\nThey also noted that of the EUR 3.4 billion\nbudget, some EUR 2.4 billion were financed by the Union general\nbudget, whereas some EUR 1 billion were financed by fees and also\nby direct contributions from Member States, the European Free Trade\nAssociation countries and other sources.
\nThe report called on the Commission to work in\nclose cooperation with the agencies Network and the individual\nagencies when preparing its proposal for the post-2020 Multiannual\nFinancial Framework and examining alternative sources of financing\nfor the Unions decentralised agencies.
\nMembers noted that the Court issued an unqualified\nopinion on the reliability of the accounts of all agencies.\nThey noted in addition that the Court\nissued an unqualified opinion on the legality and regularity of the\ntransactions underlying the accounts for all agencies, except for\nthe European Asylum Support Office (EASO).
\nThey called for the discharge procedure to be\nstreamlined and accelerated towards n+1 and on the agencies\nand the Court to follow the good example set by the private sector\nand proposes to set the deadline for the publication of the\nagencies final accounts, annual activity reports and reports\non budgetary and financial management on 31 March as well as\nadvance the publication of the Courts annual reports on\nagencies for 1 July at the very latest.
\nCommon Approach and\nCommissions roadmap: Members recognised the implementation by the\nUnion agencies of the Common Approach and its roadmap. They welcomed the\ncontribution provided by the Union Agencys Network in\ncoordinating, collecting and consolidating actions and information\nfor the benefit of the Union Institutions, including the\nParliament. They noted that its coordination tasks include the\nannual discharge and budget procedures, the implementation of the\nCommissions roadmap stemming from the Common Approach and\nrelated policy initiatives, and the review and implementation of\nFinancial and Staff Regulations. The Network provides for concrete\nadded value in the relations between the Union Institutions and the\ndecentralised agencies.
\nBudget and financial\nmanagement: the\nreport noted that despite a considerable decrease, a high level\nof carry-overs of committed appropriations remains the most\nfrequent issue in budgetary and financial management, affecting 23\nagencies, compared to 32 in 2015. Carry-overs may often be justified and do not\nnecessarily indicate weaknesses in budget planning and\nimplementation.
\nMembers pointed out that the tasks and budgets\nof the European Border and Coast Guard (Frontex) and EASO\nincreased significantly in 2016. These agencies were confronted\nwith administrative and operational challenges and high\nexpectations without much time to adapt their systems and\nprocedures and to hire the necessary staff. They faced problems in\nabsorbing additional Union funds granted during the budgetary year,\nleading to considerable cancellations and carry-overs as well as\ndifficulties in complying with budgetary and financial\nrules.
\nThe report noted with concern that public\nprocurement still remains an error-prone area.\nMembers expressed their dissatisfaction with EASO, the European\nMonitoring Centre for Drugs and Drugs Addiction (EMCDDA), the\nEuropean Agency for the operational management of largescale IT\nSystems in the area of freedom, security and justice (eu-LISA), the\nEuropean Medicines Agency (EMA) and the Body of European Regulators\nfor Electronic Communications (BEREC), which did not fully comply\nwith the public procurement principles and rules laid down in the\nFinancial Regulation. These agencies should pay particular\nattention to the Courts comments on public\nprocurement.
\nCooperation among agencies and\nwith other institutions shared services and\nsynergies:\nMembers noted with satisfaction that some agencies already\ncooperate according to their thematic grouping, such as the justice\nand home affairs agencies and the European supervisory authorities.\nOther agencies are urged to cooperate further. They noted that some\nagencies continue to have dual headquarters and multiple\noperational centres and offices and they called for all dual and\nmultiple seats which do not offer any operational added value to be\ndone away with at the earliest opportunity.
\nThe Joint Procurement Portal - the central\nregister of joint procurement opportunities was welcomed by\nMembers.
\nHuman resources\nmanagement:\nMembers welcomed the fact that most agencies have already met or\nexceeded the 5 % reduction of staff. However, they are concerned\nthat with the additional staff reduction, fulfilment of the\nagencies mandates and annual work programmes are proving\nincreasingly difficult to deliver, particularly for the agencies\nclassified by the Commission as cruising speed\nagencies. The Commission and the budgetary authority are\ncalled on to look into other options in order not to hinder the\nagencies ability to fulfil their mandate. Budgetary\nauthorities may authorise additional resources to agencies that are\nentrusted by the legislators to carry out new tasks.
\nConflicts of interest and\ntransparency:\nMembers expressed concern that only 22 agencies (71 %) have adopted\ninternal rules and guidelines on whistleblowing and reporting\nirregularities. They regretted that internal whistleblowing\nprocedures have not yet been implemented as justice and home\naffairs agencies were waiting for guidance or input from the\nCommission.
\nOther comments: Members noted the agreement\nreached at the General Affairs Council of 20 November 2017 to move\nEMA and the European Banking Authority (EBA) from London to\nAmsterdam and Paris respectively. They are aware of the potential\nimpact of the United Kingdoms departure from the Union on\nthem, in terms of future costs and loss of expertise, causing a\nrisk to business continuity.
\nThe European Parliament adopted by 558 votes to\n129, with 7 abstentions, a resolution concerning the discharge in\nrelation to the implementation of the budget of the European Union\nagencies for the financial year 2016: performance, financial\nmanagement and control.
\nMembers recalled the importance of the\nagencies tasks and their direct impact on the everyday lives\nof European citizens health, safety, security, freedom and\njustice, research and industrial development, economic and monetary\naffairs, employment and social progress. However, they expressed\ntheir concern that in general the visibility of agencies for\nEuropean citizens is still limited, whereas a high level of\nvisibility is required for their accountability and\nindependence.
\nOn a budgetary level, Members noted\nthat:
\nParliament called on the Commission to work in\nclose cooperation with the agencies Network and the individual\nagencies when preparing its proposal for the post-2020\nMultiannual Financial Framework and examining alternative\nsources of financing for the Unions decentralised\nagencies.

\nCommon approach and Commission\nroadmap: Members\nrecognised the implementation by the Union agencies of the Common\nApproach and its roadmap. They welcomed the contribution\nprovided by the Union Agencys Network in coordinating,\ncollecting and consolidating actions and information for the\nbenefit of the Union Institutions, including the\nParliament. Believing that the network provides for\nconcrete added value in the relations between the Union\nInstitutions and the decentralised agencies, Parliament suggested\nthat it would be a benefit to support the management of the\nNetwork´s Shared Support Office in Brussels;

Building on the 20142020 performance framework,\nit promotes a better balance between compliance and\nperformance.
\nThe\n2014-2020 performance frameworks have been included as a new\ncompulsory element and as a key pillar of the increased result\norientation of this programming period. It foresees the\nestablishment of clear and measureable objectives, indicators and\ntargets as well as monitoring, reporting and evaluation\narrangements.
\nFinancial management: the main\nelement of EU financial reporting is the Integrated Financial\nReporting Package (IFRP) of the EU which comprises the consolidated\nannual accounts of the EU and other reports accompanying the\naccounts, i.e. the Annual Management and Performance Report for the\nbudget and the report on the follow-up to the discharge. The Annual\nManagement and Performance Report for the EU budget provides a\ncomprehensive overview on the performance, management and\nprotection of the EU budget. It explains how the EU budget supports\nthe European Unions political priorities, the results\nachieved with the EU budget, and the role the Commission plays in\nensuring and promoting the highest standards of budgetary and\nfinancial management.
\nThe\nIFRP provides the public with a comprehensive view of the financial\nand operational situation of the EU each year.
\nThe\nconsolidated annual accounts of the EU provide financial\ninformation on the activities of the institutions, agencies and\nother bodies of the EU from both an accrual accounting and\nbudgetary perspective. These accounts do not comprise the annual\naccounts of Member States.
\nThe\nconsolidated annual accounts of the EU consist of two separate but\nlinked parts:
\nControls: the European Court\nof Auditors (the Court) is the external auditor of the EU\ninstitutions (and bodies). The Court's mission is to contribute to\nimproving EU financial management, promote accountability and\ntransparency, and act as the independent guardian of the financial\ninterests of the citizens of the EU. The Courts role as the\nEUs independent external auditor is to check that EU\nfunds are correctly accounted for, are raised and spent in\naccordance with the relevant rules and regulations and have\nachieved value for money.
\nThe\nEUs annual accounts and its resource management are audited\nby the Court, which, as part of its activities, draws up for the EP\nand the Council:
\nDischarge: the final step\nof a budget lifecycle is the discharge of the budget for a\ngiven financial year. A discharge is given to the Commission and\nall other EU institutions and bodies. The discharge represents the\npolitical aspect of the external control of budget implementation\nand is the decision by which the European Parliament, acting on a\nCouncil recommendation, \"releases\" the Commission (and other\nEU bodies) from its responsibility for management of a given budget\nby marking the end of that budget's existence. The European\nParliament is the discharge authority within the EU. This means\nthat following the audit and finalisation of the annual accounts it\nfalls to the Council to recommend and then to the European\nParliament to give a discharge to the Commission and other EU\nbodies for implementing the EU budget for a given financial year.\nThis decision is based on an examination of the annual accounts,\nthe Commission's annual management and performance report for the\nbudget, the annual report, the audit opinion and special reports of\nthe Court, and replies of the Commission to questions and further\ninformation requests.
\nThis discharge procedure may produce three\noutcomes:
\nThe Committee on Budgetary Control adopted the\nreport by Bart STAES (Greens/EFA, BE) on discharge in respect of\nthe implementation of the budget of the European Union agencies for\nthe financial year 2016: performance, financial management and\ncontrol.
\nMembers emphasised that the agencies are highly\nvisible in the Member States and have significant influence on\npolicy and decision making and programme implementation in areas of\nvital importance to European citizens, such as health, safety,\nsecurity, freedom and justice, research and industrial development,\neconomic and monetary affairs, employment and social\nprogress.
\nThey expressed concern that in general the\nvisibility of agencies for European citizens is still\nlimited, whereas a high level of visibility is required for\ntheir accountability and independence.
\nOn a budgetary level, Members noted that\nthe agencies 2016 budget amounted to some EUR 3.4 billion,\nrepresenting an increase of about 21.42 % compared to 2015 and\nabout 2.4 % (compared to: 2 % in 2015) of the Unions general\nbudget. They pointed out that the increase is mainly related to\nagencies working on matters related to industry, research and\nenergy (additional EUR 358 million) and civil liberties, justice\nand home affairs (additional EUR 174 million).
\nThey also noted that of the EUR 3.4 billion\nbudget, some EUR 2.4 billion were financed by the Union general\nbudget, whereas some EUR 1 billion were financed by fees and also\nby direct contributions from Member States, the European Free Trade\nAssociation countries and other sources.
\nThe report called on the Commission to work in\nclose cooperation with the agencies Network and the individual\nagencies when preparing its proposal for the post-2020 Multiannual\nFinancial Framework and examining alternative sources of financing\nfor the Unions decentralised agencies.
\nMembers noted that the Court issued an unqualified\nopinion on the reliability of the accounts of all agencies.\nThey noted in addition that the Court\nissued an unqualified opinion on the legality and regularity of the\ntransactions underlying the accounts for all agencies, except for\nthe European Asylum Support Office (EASO).
\nThey called for the discharge procedure to be\nstreamlined and accelerated towards n+1 and on the agencies\nand the Court to follow the good example set by the private sector\nand proposes to set the deadline for the publication of the\nagencies final accounts, annual activity reports and reports\non budgetary and financial management on 31 March as well as\nadvance the publication of the Courts annual reports on\nagencies for 1 July at the very latest.
\nCommon Approach and\nCommissions roadmap: Members recognised the implementation by the\nUnion agencies of the Common Approach and its roadmap. They welcomed the\ncontribution provided by the Union Agencys Network in\ncoordinating, collecting and consolidating actions and information\nfor the benefit of the Union Institutions, including the\nParliament. They noted that its coordination tasks include the\nannual discharge and budget procedures, the implementation of the\nCommissions roadmap stemming from the Common Approach and\nrelated policy initiatives, and the review and implementation of\nFinancial and Staff Regulations. The Network provides for concrete\nadded value in the relations between the Union Institutions and the\ndecentralised agencies.
\nBudget and financial\nmanagement: the\nreport noted that despite a considerable decrease, a high level\nof carry-overs of committed appropriations remains the most\nfrequent issue in budgetary and financial management, affecting 23\nagencies, compared to 32 in 2015. Carry-overs may often be justified and do not\nnecessarily indicate weaknesses in budget planning and\nimplementation.
\nMembers pointed out that the tasks and budgets\nof the European Border and Coast Guard (Frontex) and EASO\nincreased significantly in 2016. These agencies were confronted\nwith administrative and operational challenges and high\nexpectations without much time to adapt their systems and\nprocedures and to hire the necessary staff. They faced problems in\nabsorbing additional Union funds granted during the budgetary year,\nleading to considerable cancellations and carry-overs as well as\ndifficulties in complying with budgetary and financial\nrules.
\nThe report noted with concern that public\nprocurement still remains an error-prone area.\nMembers expressed their dissatisfaction with EASO, the European\nMonitoring Centre for Drugs and Drugs Addiction (EMCDDA), the\nEuropean Agency for the operational management of largescale IT\nSystems in the area of freedom, security and justice (eu-LISA), the\nEuropean Medicines Agency (EMA) and the Body of European Regulators\nfor Electronic Communications (BEREC), which did not fully comply\nwith the public procurement principles and rules laid down in the\nFinancial Regulation. These agencies should pay particular\nattention to the Courts comments on public\nprocurement.
\nCooperation among agencies and\nwith other institutions shared services and\nsynergies:\nMembers noted with satisfaction that some agencies already\ncooperate according to their thematic grouping, such as the justice\nand home affairs agencies and the European supervisory authorities.\nOther agencies are urged to cooperate further. They noted that some\nagencies continue to have dual headquarters and multiple\noperational centres and offices and they called for all dual and\nmultiple seats which do not offer any operational added value to be\ndone away with at the earliest opportunity.
\nThe Joint Procurement Portal - the central\nregister of joint procurement opportunities was welcomed by\nMembers.
\nHuman resources\nmanagement:\nMembers welcomed the fact that most agencies have already met or\nexceeded the 5 % reduction of staff. However, they are concerned\nthat with the additional staff reduction, fulfilment of the\nagencies mandates and annual work programmes are proving\nincreasingly difficult to deliver, particularly for the agencies\nclassified by the Commission as cruising speed\nagencies. The Commission and the budgetary authority are\ncalled on to look into other options in order not to hinder the\nagencies ability to fulfil their mandate. Budgetary\nauthorities may authorise additional resources to agencies that are\nentrusted by the legislators to carry out new tasks.
\nConflicts of interest and\ntransparency:\nMembers expressed concern that only 22 agencies (71 %) have adopted\ninternal rules and guidelines on whistleblowing and reporting\nirregularities. They regretted that internal whistleblowing\nprocedures have not yet been implemented as justice and home\naffairs agencies were waiting for guidance or input from the\nCommission.
\nOther comments: Members noted the agreement\nreached at the General Affairs Council of 20 November 2017 to move\nEMA and the European Banking Authority (EBA) from London to\nAmsterdam and Paris respectively. They are aware of the potential\nimpact of the United Kingdoms departure from the Union on\nthem, in terms of future costs and loss of expertise, causing a\nrisk to business continuity.
\nThe European Parliament adopted by 558 votes to\n129, with 7 abstentions, a resolution concerning the discharge in\nrelation to the implementation of the budget of the European Union\nagencies for the financial year 2016: performance, financial\nmanagement and control.
\nMembers recalled the importance of the\nagencies tasks and their direct impact on the everyday lives\nof European citizens health, safety, security, freedom and\njustice, research and industrial development, economic and monetary\naffairs, employment and social progress. However, they expressed\ntheir concern that in general the visibility of agencies for\nEuropean citizens is still limited, whereas a high level of\nvisibility is required for their accountability and\nindependence.
\nOn a budgetary level, Members noted\nthat:
\nParliament called on the Commission to work in\nclose cooperation with the agencies Network and the individual\nagencies when preparing its proposal for the post-2020\nMultiannual Financial Framework and examining alternative\nsources of financing for the Unions decentralised\nagencies.

\nCommon approach and Commission\nroadmap: Members\nrecognised the implementation by the Union agencies of the Common\nApproach and its roadmap. They welcomed the contribution\nprovided by the Union Agencys Network in coordinating,\ncollecting and consolidating actions and information for the\nbenefit of the Union Institutions, including the\nParliament. Believing that the network provides for\nconcrete added value in the relations between the Union\nInstitutions and the decentralised agencies, Parliament suggested\nthat it would be a benefit to support the management of the\nNetwork´s Shared Support Office in Brussels;

It called on the Commission to work on the revision\nof the formula used to calculate the correction coefficient in\norder to find a more effective balance between a tempting salary\nand a low cost of living.
