\nROLE OF THE EUROPEAN PARLIAMENT: the European\nParliament decides in accordance with the ordinary legislative\nprocedure and on an equal footing with the Council.
\nBACKGROUND: fraud affecting the EU's financial\ninterests is a cross-border phenomenon affecting all EU Member\nStates. Experience shows that the Union's financial interests\nare impacted by both fraud and irregularities.
\nThe implementation of the past Union multi-annual\nbudgets has been accompanied by a set of measures to support the\nMember States and the Union as a whole in preventing and fighting\nfraud affecting the Union's financial interests, and supporting\nmutual administrative assistance and cooperation in customs and\nagriculture matters.
\nThese measures include:
\nAlthough it is difficult to quantify their financial\nimpact, these measures have contributed to bringing back large\namounts of money into the EU budget. For example, Hercule\nfunded the development of the Automated Monitoring Tool (AMT), an\nIT tool that identifies anomalies in trade flows and was\ninstrumental in identifying large undervaluation fraud schemes in\nthe import of textile and footwear from third countries in\n2017.
\n\nThis proposal aims at\nstreamlining the financial support for these tools, for the\nduration of the next multi-annual financial framework\n2021-2027.
\nThe Commission stressed that the next multiannual\nfinancial framework shall be implemented against the background of\nsignificant changes in the legislative and institutional framework\nfor the protection of the Union's financial interests, in\nparticular with the establishment of the European\nPublic Prosecutors Office and the implementation of Directive\n(EU) 2017/1371 of the European Parliament and the Council on\nthe fight against fraud to the Union's financial interests by means\nof criminal law.
\nCONTENT: the proposed Regulation - presented for a\nUnion of 27 Member States - seeks to establish the EU anti-fraud\nprogramme. It lays down the objectives of the programme,\nthe budget for the period 2021-2027, the forms of Union funding and\nthe rules for providing such funding.
\nThe new programme is intended to replace the Hercule\nIII programme and shall have a budget of EUR 181 million for the\nperiod 2021-2027. Its general objectives shall be to protect\nthe financial interests of the Union and to support mutual\nassistance between the administrative authorities of the Member\nStates and cooperation between the latter and the Commission to\nensure the correct application of the law on customs and\nagricultural matters.
\nThe specific objectives of the programme shall\nbe threefold:
\nImplementation: the\nproposal specifies how the programme shall be implemented through\ngrants, including the possible beneficiaries of the grants.\nThe latter include public authorities which are likely to\ncontribute to the achievement of one of the objectives of the\nprogramme, from any of the following countries: a Member State or\nan overseas country or territory linked to it, a third country\nassociated with the programme or a third country listed in a work\nprogramme.
\nThe programme shall be implemented by OLAF, the\nEuropean Anti-Fraud Office.
