PURPOSE: to complement EU type-approval legislation\nwith regard to the withdrawal of the United Kingdom from the\nUnion.
\nPROPOSED ACT: Regulation of the European Parliament\nand of the Council.
\nROLE OF THE EUROPEAN PARLIAMENT: the European\nParliament decides in accordance with the ordinary legislative\nprocedure and on an equal footing with the Council.
\nBACKGROUND: on 29 March\n2017, the United Kingdom submitted the notification of its\nintention to withdraw from the Union pursuant to Article 50 of the\nTreaty on European Union. This means that, unless a ratified\nwithdrawal agreement establishes another date, all Union primary\nand secondary law will cease to apply to the United Kingdom from 30\nMarch 2019, ('the withdrawal date'). The United Kingdom will\nthen become a third country.
\nSubject to any transitional arrangement that may be\ncontained in a possible withdrawal agreement, the EU legislative\nframework governing type approval for a number of products will no\nlonger apply to the United Kingdom.
\nThis also means that the United Kingdom type-approval\nauthority will cease to be an EU type-approval authority.\nManufacturers who obtained approvals in the United Kingdom in the\npast will thus need to obtain new approvals from EU-27 type\napproval authorities, including for products already in production,\nin order to ensure continued compliance with EU legislation and\nretain access to the Union market.
\nWhile the legal framework for these products sets\nprocedural requirements harmonising the way in which type-approvals\nare granted across the EU, some safeguards make it difficult for\nrelevant manufacturers to take the necessary measures to ensure\nregulatory compliance and business continuity after the EU acquis\nceases to apply to the United Kingdom. For example:
\nThese issues create significant legal uncertainty\nfor manufacturers with United Kingdom type-approvals.\nManufacturers should be able to continue the production of\nvehicles, systems, components and separate technical units\npreviously based on approvals granted by the United Kingdom and to\ncontinue placing these products on the Union market. It is\ntherefore necessary to allow manufacturers to obtain new approvals\nissued by the authorities of Member States of the Union other than\nthe United Kingdom.
\nCONTENT: the proposed Regulation complements Directive\n2007/46/EC, Regulation\n(EU) No 167/2013, Regulation\n(EU) No 168/2013 and Regulation\n(EU) 2016/1628 by establishing special provisions for the EU\ntype-approval and the placing on the market of vehicles, systems,\ncomponents and separate technical units which have been\ntype-approved by the approval authority of the United Kingdom\nbefore the day Union law ceases to apply to and in the United\nKingdom.
\nThe present proposal aims to address them by\nmodifying temporarily and in a very targeted manner the existing\nrules to allow concerned manufacturers to obtain new EU-27\napprovals that replace their existing UK type-approved\nproducts.
\nSpecifically, the proposal:
