PURPOSE: to authorise Member States to ratify, in the\ninterest of the European Union, the Protocol amending the Council\nof Europe Convention for the Protection of Individuals with regard\nto Automatic Processing of Personal Data (ETS No.\n108).
\nPROPOSED ACT: Council Decision.
\nROLE OF THE EUROPEAN PARLIAMENT: Council may adopt the\nact only if Parliament has given its consent to the\nact.
\nBACKGROUND: the Council of Europe Convention\nfor the Protection of Individuals with Regard to Automatic\nProcessing of Personal Data (Convention 108) is the only legally\nbinding multilateral agreement in the field of personal data\nprotection. Convention 108 requires the Parties to incorporate into\ntheir respective national laws the necessary measures to ensure\nrespect for the human right of all individuals with regard to the\nprocessing of personal data.
\nAt present, 51 States have ratified Convention\n108, including all 28 EU Member States.
\nConvention 108 was opened for signature in\n1981, long before the era of the internet and electronic\ncommunications. The development of technology and globalisation of\ninformation poses new challenges in the field of protection of\npersonal information.
\nOn 31 May 2013, the Council authorised the\nCommission to participate on behalf of the Union in the\nnegotiations on the modernisation of the Council of Europe\nConvention for the protection of individuals with regard to\nautomatic processing of personal data (EST 108) and the conditions\nand modalities of accession of the Union to the modernised\nConvention.
\nThe Protocol amending Convention 108 (the\namending Protocol) was adopted by the Council of Europe Committee\nof Ministers on 18 May 2018 and will be open for signature as of 25\nJune 2018.
\nThe amending Protocol aims to widen the\nscope, increase the level and improve the effectiveness of data\nprotection afforded under Convention 108.
\nGiven that the Union cannot sign or ratify the\namending Protocol, as under the current Convention 108 only States\nare Parties, Member States should therefore be authorised to ratify\nthe amending Protocol, acting jointly in the interests of the\nUnion.
\nCONTENT: the present proposal calls on the\nCouncil to adopt the decision to authorise Member States to ratify,\nin the interest of the European Union, the Protocol amending the\nCouncil of Europe Convention for the Protection of Individuals with\nregard to Automatic Processing of Personal Data (ETS No. 108) (the\namending Protocol) insofar as its provisions fall within Union\ncompetence.
