PURPOSE: to approve, on behalf of the European Union,\nthe conclusion of the Treaty establishing the Transport\nCommunity.
\nPROPOSED ACT:\nCouncil Decision.
\nROLE OF THE EUROPEAN PARLIAMENT: Council may adopt the\nact only if Parliament has given its consent to the\nact.
\nBACKGROUND: strengthening regional cooperation\nwithin the Western Balkans is a key element for political\nstability, security, economic prosperity and social development in\nthe region.
\nTransport cooperation with the Western Balkans\ncountries had been governed by the South East European Transport\nObservatory (SEETO), a the Memorandum of Understanding (MoU) of 11\nJune 2004 signed by Albania, Bosnia and Herzegovina, Croatia, the\nformer Yugoslav Republic of Macedonia, Montenegro, Serbia, the\nUnited Nations Mission in Kosovo and the Commission. The main\nobjective of the MoU was to extend the Trans-European Tranport\nNetwork (TEN-T) and related policies to the Western\nBalkans.
\nThe MoU has, however, shown limits. Therefore,\nthe Commission proposed, based on the positive experience with the\nimplementation of the Energy Community Treaty, to take inspiration\nfrom this example for the purposes of the transport sector and\nnegotiate an agreement providing that the legislation, standards\nand technical specifications applied by the Western Balkans\npartners be made compatible with those of the Union.
\n\nThe Commission negotiated,\non behalf of the Union, the Treaty establishing the Transport\nCommunity (TCT) between the European Union and Albania, Bosnia and\nHerzegovina, the former Yugoslav Republic of Macedonia, Kosovo,\nMontenegro and Serbia.
\n\nThe TCT was signed on behalf\nof the Union on 12 July and 9 October 2017, subject to its\nconclusion at a later date.
\n\nAll South East European\nParties except Kosovo have already ratified the TCT. In the\nmeantime, the TCT is applied provisionally among the\nParties.
\nCONTENT: the Commission proposes that the\nCouncil decide to approve, on behalf of the European Union, the\nTreaty establishing the European Transport Community\n(TCT).
\nThe aim of this Treaty is the creation of a\nTransport Community in the field of road, rail, inland waterway and\nmaritime transport as well as the development of the transport\nnetwork between the European Union and the South East European\nParties. The Transport Community is based on the progressive\nintegration of transport markets of the South East European Parties\ninto the European Union transport market on the basis of the\nrelevant acquis, including in the areas of technical standards,\ninteroperability, safety, security, traffic management, social\npolicy, public procurement and environment, for all modes of\ntransport excluding air transport.
\nThe Commission considers that the TCT will\nbenefit the accession framework for the Western Balkans by speeding\nup the alignment of national legislation with the Union acquis on\ntransport and related areas.
\nThe TCT will also be a key instrument to foster\nthe reform process in the context of the Western Balkan Six\ninitiative as well as the implementation of the TEN-T as extended\nto the Western Balkans. It will replace the existing cooperation\nframework, the South East European Transport Observatory (SEETO),\nwhich is in place since 2004.
