PURPOSE: Proposal for an Interinstitutional Agreement\nbetween the European Parliament, the Council and the Commission on\nbudgetary discipline, on cooperation in budgetary matters and on\nsound financial management.
\nCONTENT: the purpose of this Agreement is to\nimplement budgetary discipline and improve the functioning\nof the annual budgetary procedure and cooperation between the\ninstitutions on budgetary matters as well as to ensure sound\nfinancial management. Budgetary discipline in this Agreement covers\nall expenditure.
\nThe draft agreement contains provisions relating to\nthe following aspects:
\nMulti-annual financial framework (MFF) and special\ninstruments: during the budgetary\nprocedure and when adopting the budget, the institutions shall\nensure that sufficient margins are left available under the\nceilings for the different headings of the MFF. In 2024, the\nCommission shall update the forecasts for payment appropriations\nfor the period after 2027.
\nThe proposal also deals with the conditions for\nmobilising the Contingency Margin, the European Globalisation\nAdjustment Fund, the Emergency Aid Reserve and the Flexibility\nInstrument.
\nInterinstitutional cooperation during the budgetary\nprocedure: in the interests of\nbudgetary transparency, the Commission shall draw up an annual\nreport accompanying the Union's general budget, bringing together\navailable and non-confidential information on the Union's assets\nand liabilities.
\nEach legislative act, concerning a multiannual\nprogramme, adopted under the ordinary legislative procedure shall\ncontain a provision in which the legislator lays down the\nfinancial envelope for the programme. The European\nParliament and the Council, and the Commission when it draws up the\ndraft budget, undertake not to depart by more than 15 % from\nthat amount for the entire duration of the programme concerned,\nunless new, objective, long-term circumstances arise for which\nexplicit and precise reasons are given.
\nAs regards fisheries agreements, the Commission\nshall undertake to keep the European Parliament regularly informed\nof the preparation and progress of negotiations, including their\nbudgetary implications. During the legislative procedure, the\nprocedures should be completed as quickly as possible. Each\nquarter, the Commission would present detailed information to the\nEuropean Parliament and the Council on the implementation of the\nfisheries agreements in force and the financial forecasts for the\nremainder of the year.
\nThe total amount of CFSP operating expenditure\nshall be entered entirely in one budget chapter, entitled CFSP.\nThat amount shall cover the real predictable needs, assessed in the\nframework of the establishment of the draft budget, on the basis of\nforecasts drawn up annually by the High Representative of the Union\nfor Foreign Affairs and Security Policy. No funds may be entered in\na reserve.
\nEach year, the High Representative shall consult\nthe European Parliament on a forward-looking document setting\nout the main aspects and basic choices of the CFSP, including the\nfinancial implications for the general budget of the Union. If the\nCouncil adopts a decision in the field of the CFSP entailing\nexpenditure, the High Representative shall immediately, and in any\nevent no later than five working days thereafter, send the European\nParliament an estimate of the costs envisaged.
\nLastly, the Commission shall establish an informal\ndialogue with the European Parliament on development policy\nissues regardless of their source of financing.
\nSound financial management of EU funds: the Commission shall submit twice a year, the first\ntime together with the documents accompanying the draft budget and\nthe second time after the adoption of the general budget of the\nUnion, a complete financial programming for headings I, II\n(except the sub-ceiling for economic, social and territorial\ncohesion), III (for 'environment and climate and\nmaritime and fisheries), IV, V and VI of the\nMFF.
\nThat programming, structured by heading, policy area\nand budget line, shall identify: (i) the legislation in force, with\na distinction being drawn between multiannual programmes and annual\nactions; (ii) pending legislative proposals.
\nBefore presenting a proposal for the creation of a\nnew agency, the Commission shall produce a sound, complete and\nobjective impact assessment, taking into account, inter alia, the\ncritical mass of staff and competencies, cost-benefit aspects,\nsubsidiarity and proportionality, the impact on national and Union\nactivities, and the budgetary implications for the expenditure\nheading concerned.
\nOn the basis of that information and without prejudice\nto the legislative procedures governing the setting up of the\nagency, the European Parliament and the Council commit themselves,\nin the framework of budgetary cooperation, to arrive at a timely\nagreement on the financing of the proposed agency. The main steps\nin the procedure are described in the draft agreement.

\nSound financial management of EU funds: the Commission shall submit twice a year, the first\ntime together with the documents accompanying the draft budget and\nthe second time after the adoption of the general budget of the\nUnion, a complete financial programming for headings I, II\n(except the sub-ceiling for economic, social and territorial\ncohesion), III (for 'environment and climate and\nmaritime and fisheries), IV, V and VI of the\nMFF.
\nThat programming, structured by heading, policy area\nand budget line, shall identify: (i) the legislation in force, with\na distinction being drawn between multiannual programmes and annual\nactions; (ii) pending legislative proposals.
\nBefore presenting a proposal for the creation of a\nnew agency, the Commission shall produce a sound, complete and\nobjective impact assessment, taking into account, inter alia, the\ncritical mass of staff and competencies, cost-benefit aspects,\nsubsidiarity and proportionality, the impact on national and Union\nactivities, and the budgetary implications for the expenditure\nheading concerned.
\nOn the basis of that information and without prejudice\nto the legislative procedures governing the setting up of the\nagency, the European Parliament and the Council commit themselves,\nin the framework of budgetary cooperation, to arrive at a timely\nagreement on the financing of the proposed agency. The main steps\nin the procedure are described in the draft agreement.
