Details

PURPOSE: launch of automated data exchange with regard to vehicle registration data in Ireland.

PROPOSED ACT: Council implementing decision.

ROLE OF THE EUROPEAN PARLIAMENT: the Council adopts the act after consulting the European Parliament but without being required to follow its opinion.

BACKGROUND: the transmission of personal data provided for in Decision 2008/615/JHA on the stepping up of cross-border cooperation, in particular to combat terrorism and cross-border crime, may not take place until the general provisions on data protection set out that Decision have been implemented in the national law of the territories of the Member States involved in such supply.

Pursuant to Decision 2008/616/JHA , Ireland replied to a questionnaire on data protection and a questionnaire on the exchange of vehicle registration data (DRD). It carried out a successful pilot test with the Netherlands. An evaluation visit took place in Ireland and the Dutch/Portuguese evaluation team prepared a report on this visit.

On 7 March 2019, the Council, having noted the agreement of all Member States bound by Decision 2008/615/JHA, concluded that Ireland had fully implemented the general provisions on data protection set out in Decision 2008/615/JHA.

CONTENT: the purpose of the draft Council implementing decision is to authorise Ireland to receive and supply personal data for the purpose of automated consultation of vehicle registration data in accordance with Decision 2008/615/JHA.

The United Kingdom, Ireland and Denmark are participating in the adoption of the proposed decision.
