Recital 4 a (new)
(4a) As things stand, Member States have encountered substantial difficulties in implementing the Water Framework Directive. This applies, in particular, with regard to controlling emissions of priority substances at national level, especially with the aim of eliminating emissions, as required in the case of priority hazardous substances. Coordination with other European legislative instruments should therefore be increased by implementing new, appropriate control measures.

3a. The following Article 5a is inserted : ‘Article 5a Control measures 1. For substances identified as priority substances and priority hazardous substances as referred to in this Directive, the Commission shall arrange for the adoption of control measures in accordance with the European Union law in force, as provided for in the following paragraphs. 2. For all priority hazardous substances included within the scope of Regulation (EC) No 1907/2006, the Commission shall ask the European Chemicals Agency (ECHA), within three months of the entry into force of this Directive, to prepare a dossier in accordance with Annex XV with a view to including the substances in the Candidate List of Substances. 3. With a view to reducing emissions from plants subject to the requirements laid down by Directive 2010/75/EU of the European Parliament and of the Council of 24 November 2010 on industrial emissions (integrated pollution prevention and control)1 in cases in which levels of emissions produced with the adoption of the best available technologies are not sufficient to comply with environmental quality standards, the Commission shall ensure that appropriate measures are taken, which shall be clearly incorporated into the Reference Documents (BREFs). 4. For substances identified as priority hazardous substances as referred to in this Directive and included within the scope of Regulation (EC) No 528/2012, the Commission shall arrange for the adoption of appropriate control measures in accordance with the European Union law in force. In particular: (a) By 31 December 2019 the Commission shall ensure that all permits issued in the European Union for active substances are reviewed on the basis of Article 15 of Regulation (EC) No 528/2012. (b) By 31 December 2019, the Commission shall ensure that these substances are subject to the exclusion criteria referred to in Article 5 and cannot be approved unless the conditions laid down in paragraph 2(a) of that article are complied with. (c) By 2019, Member States shall adopt safeguard measures as referred to in Article 7(2) of that Regulation. 5. For substances identified as priority substances and priority hazardous substances as referred to in this Directive and included within the scope of Regulation (EC) No 1107/2009, Member States and the Commission shall arrange for the adoption of the control measures provided for by that Regulation. In particular: (a) The placing on the market of any priority substance must result in a fresh assessment and in renewal of the approval of the substance within a period of 12 months, with a view to ensuring that emissions into water are gradually reduced. (b) For priority hazardous substances, the fresh assessment must ensure that the substance is replaced with other systems for controlling harmful organisms. If such systems are not yet sufficiently effective, a temporary permit may be considered only for closed systems which do not produce emissions detectable in air, water or the ground. (c) From 1 January 2020, all measures approving pesticides identified as priority hazardous substances shall be withdrawn and no new permit for such substances shall be issued after that date.’ ____________________ 1 OJ L 334, 17.12.2010, p.17
