2a. Stresses that robust safeguards to protect privacy and fundamental rights must be guaranteed where any personal data is exchanged with third States or international organisations; points out that data protection standards equivalent to those of the European Union must also apply when exchanging data with third States and organisations; states that, when exchanging and transferring personal data, Europol must ensure that the recipient of the data undertakes to use the data solely for the purposes for which it was transferred;

3. Calls on the Director and the Management Board of Europol to refrain, in the event of the draft decision being adopted, from starting any negotiations on operational agreements with any of the countries listed in it until the new Europol regulation enters into force, because of concerns with the currentsince the level of data protection is inadequate in some of the countries listed in the draft decision; and the basic right to protection of personal data cannot be upheld.

3a. Calls on the Council to review the existing list in Decision 2009/935/JHA as regards the list of third States and organisations with which Europol has already concluded agreements in order to check the extent to which the basic principles of data protection law and the protection of privacy are being complied with; points out that a report to this effect must be submitted to the Commission, the European Parliament and the European Data Protection Supervisor.
