Notes that although Article 7(1) TEU can affect mutual recognition, according to the CJEU, the executing authority must assess in each specific case whether there are substantial grounds for believing that, following the surrender, the person will run the risk of having their fundamental rights contravened; underlines that the triggering of Article 7(1) TEU does not amount to automatic non-recognition; notes that the latter would seriously harm cooperation in criminal matters and would undermine the functioning of the whole system;
