Proposal for a regulation
Recital 11 a (new)
(11a) Proper enforcement of rules is a precondition for a functional single market and the respect of the interests of drivers, passengers and businesses. Social partners at European and national level should be invited to contribute to better enforcement by undertaking joint actions and by establishing joint recommendations on issues relevant to the implementation of this Regulation.

Recital 11 b (new)
(11b) Enforcement authorities require adequate means of control and tools to ensure the proper control and enforcement of the new specific driving and rest time rules for occasional passenger transport drivers. In order to reflect developments of checks and tools available for enforcers, the power to adopt acts in accordance with Article 290 TFEU should be delegated to the Commission, with regards to amending the respective provisions and annexes of Directive 2006/22/EC on enforcement and Commission Regulation (EU) No 361/2014 on control documents in international carriage by bus and coach.

Article 11 – paragraph 1 a (new)
Article 1a In Article 11 a new paragraph 1a is inserted as follows: In order to ensure uniform conditions for the implementation of this Regulation, the Commission shall adopt implementing acts with one of the following aims: (a) to promote a common approach to the implementation of this Regulation; (b) to encourage a coherence between enforcement authorities and a harmonised interpretation of the provisions of this Regulation between enforcement authorities; (c) to facilitate dialogue between the transport sector and enforcement authorities. Those powers should be exercised in accordance with Regulation (EU) No 182/2011 of the European Parliament and of the Council. The implementing acts shall be adopted in accordance with the examination procedure referred to in Article 12(2) of Directive 2006/22/EC. By [date of adoption + 24 months], the European Commission shall provide a report to the European Parliament and the Council on the practical implementation of the provisions of this Regulation, including where appropriate proposals for follow-up measures.

Article 11 – paragraph 1 b (new)
Article 11 A Member State may provide for longer minimum breaks and rest periods or shorter maximum driving times than those laid down in Articles 6 to 9 in the case of carriage by road undertaken wholly within its territory. In so doing, Member States shall take account of relevant collective or other agreements between the social partners. Nevertheless, this Regulation shall remain applicable to drivers engaged in international transport operations. a (new) "In Article 11 a new paragraph 1b is inserted as follows: 1c. European Social partners are invited to cooperate with the enforcement authorities, with the objective to jointly contribute to the proper implementation of the provisions of this Regulation, including to issue recommendations to their respective members and inform the European Commission services and enforcers about their findings and proposals. The European Commission and the Member State in question may provide social partners with relevant information to the extent necessary for the purpose of checking compliance with these rules and in accordance with national law and practices, provided that: (a) the information relates to the territory of the Member State concerned; (b) the information is used exclusively for the purpose of enforcing these rules; and (c) data processing is carried out in accordance with Regulation (EU) 2016/679."
