1. Notes that the scope of the definition of information society services provided for in the e-Commerce directive has been subject to a rich case-law by the European Court of Justice, especially regarding online platforms in the transport and short-rentals sectors, and hence needs to be clarified; notes that encouraging proactive measures by platforms ensure greater trust, security and safety for users;

Calls on the Commission to clarify the liability of Transport and Tourism platforms, depending on the business model employed in each case; invites the Commission to set a uniform obligation for platforms to verify the legality of the service offered and the service provider and to act on illegal content, once a competent authority has provided with information to constitute actual knowledge of an illegality, through a legally binding Notice and Action procedure.
