Recital 26
(26) Online marketplaces play a crucial role in the supply chain - allowing economic operators to reach an indefinite number of consumers - and therefore also in the product safety system. They therefore need to be given greater responsibility for product and consumer safety, including when other economic actors in the supply chain do not act. This increased responsibility should not, however, apply to producers who are not established in the European Union. Online marketplaces are services that enable or help economic operators to make their products available to consumers. For the purpose of the safety of products that are made available on the market, online marketplaces should not be understood merely as platforms that directly facilitate the sale of products. Online marketplaces offer economic operators the possibility of placing advertisements, comparing offers, or providing advisory or reputational services, without which consumers would not have access to these products, services or traders.

4. Online marketplaces shall give an appropriate answer without undue delay, and in any event within five working day72 hours, in the Member State where the online marketplace operates, to notices related to product safety issues and dangerous products received in accordance with [Article 14] of Regulation (EU) […/…] on a Single Market for Digital Services (Digital Service Act) and amending Directive 2000/31/EC.
