Recital 40
(40) Member States shouldall lay down rules on penalties for the infringements of the obligations provided for in this Regulation and ensure that those rules are implemented. Those penalties shouldall be effective, proportionate and dissuasive. Member States shall report the imposed penalties to the Commission annually, to monitor the coherence of the implementation of these provisions.

The administrative fines imposed by the Commission shall notmay also be in addition to the penalties imposed by the Member States in accordance with Article 89 for the same infringement and shall not exceed EUR 30 000 perif the Commission does not consider the latter to be effective, proportionate and dissuasive on the basis of a comparative index developed drawing on the average penalties provided for in all European Union Member States. The penalties imposed by the Commission shall not exceed the sale price of the non- compliant vehicle, system, component or separate technical unit.
