Amendment 76 #
Proposal for a regulation
Recital 8
(8) In addition, such a multi-annual plan should apply to all demersal stockpopulations and their fisheries in the North Sea and should be based on the populations, fishing efforts and environmental situation of the North Sea rather than being completely inflexibly influenced by other previous multi-annual plans from different areas.

Amendment 84 #
Proposal for a regulation
Recital 10
(10) The objective of this plan should be to contribute to the achievement of the objectives of the CFP, and especially reachstoring and maintaining MSY for the stocks concerneall fish populations above levels capable of producing the maximum sustainable yield, contributing to the implementation of the landing obligation for demersal stocks subject to catch limits and contributing to the implementation of the ecosystem-based approach to fisheries management.

Amendment 92 #
Proposal for a regulation
Recital 12
(12) It is appropriate to establish the target fishing mortality (F) that corresponds to the objective of reaching and maintaining MSY as ranges of values which are consistent with achieving maximum sustainable yield (FMSY). Those ranges, based on scientific advice, are necessary in order to provide flexibility to take account of developments in the scientific advice, to contribute to the implementation of the landing obligation and to take into account the characteristics of mixed fisheries. The FMSY ranges have been calculated by the International Council for the Exploration of the Sea (ICES) and are derived to deliver no more than a 5% reduction in long-term yield compared to MSY40 . The upper limit of the range is capped, so that the probability of the stock falling below Blim or Abundancelimit is no more than 5%. That upper limit also conforms to the ICES “advice rule”41 , which indicates that when the spawning biomass or abundance is in a poor state, F be reduced to a value that does not exceed an upper limit equal to the FMSY point value multiplied by the spawning biomass or abundance in the TAC year divided by MSY Btrigger or Abundancelimit. ICES uses these considerations and advice rule in its provision of scientific advice on fishing mortality and catch options. _________________ 40EU request to ICES to provide FMSY ranges for selected North Sea and Baltic Sea stocks 41General context of ICES advice, July 2015upper limit of the range is capped, so that the maximum sustainable yield exploitation rate is achieved at the latest by 2020 for all fish populations and maintained thereafter.

Amendment 99 #
Proposal for a regulation
Recital 18 a (new)
(18 a) Recreational fisheries can have a serious impact on fish populations, therefore measures to ensure that recreational fisheries contribute to the objectives of this plan should be included. Member States should collect catch data of recreational fisheries, in line with legal requirements on data collection. Where recreational fisheries have serious negative impacts on fish populations, the plan should foresee specific management measures.

Amendment 184 #
Proposal for a regulation
Article 4 – paragraph 1
1. The target fishing mortality shall be achieved as soon as possible, and on a progressive, incremental basis by 2020 for theall stocks of Groups 1 and 2to which this Regulation applies, and shall be maintained thereafter within the rangobjectives set out in Annex Irticle 3(1) and (3).

Amendment 191 #
Proposal for a regulation
Article 4 – paragraph 4
4. Notwithstanding paragraphs 2 and 3, fishing opportunities for a stock may be fixed in accordance with the fishing mortality ranges set out in Annex I, column B, provided that the stock concerned is above the minimum spawning biomass reference point set out in Annex II, column A: (a) if, on the basis of scientific advice or evidence, it is necessary for the achievement of the objectives laid down in Article 3 in the case of mixed fisheries; (b) if, on the basis of scientific advice or evidence, it is necessary to avoid serious harm to a stock caused by intra- or inter- species stock dynamics; or (c) in order to limit variations in fishing opportunities between consecutive years to not more than 20%.deleted

Amendment 233 #
Proposal for a regulation
Article 6 – paragraph 1
Stocks of Group 5 shall be managed based on the precautionary approach in line with scientific advice. The absence of adequate scientific information shall not justify postponing or failing to take management measures to conserve target species, associated or dependent species and non- targeted species and their environment.

Amendment 237 #
Proposal for a regulation
Article 8 – paragraph 1
1. When scientific advice indicates that for a given year the spawning biomass of any of the stocks in Group 1 is below the MSY Btrigger or that the abundance of any of the functional units in Group 2 is below the Abundancebuffer set out in Annex II, column A, all appropriate remedial measures shall be adopted to ensure rapid return of the stock or functional unit concerned to levels above thosfish populations affected by this Regulation is declining, and below levels that are capable of producing the maximum sustainable yield. In particular, by way of derogation from Article 4(2) fishing opportunities shall be set at levels consistent with a fishing mortality, taking into account the decrease in biomass or abundance, that is reduced below the range laid down in Annex I, column A, all activities affecting the species concerned in a negative way shall be suspended until its population has fully recovered.
