Recital 6
(6) The proposed concentration limits in Annexes IV and V to Regulation (EU) 2019/1021 have been set applying the same methodology that was used to establish the concentration limits in previous amendments of Annexes IV and V to Regulation (EC) No 850/2004. The proposed concentration limits should be underpinned by the precautionary principle as set forth in the Treaty on the Functioning of the European Union (TFEU) and aim to eliminate, where feasible, the release of POPs into the environment, in order to achieve the objective of a high level of protection of human health and the environment associated to the destruction or irreversible transformation of the substances concerned. Those limits should also take into consideration the broader policy objective of achieving a climate- neutralthe zero-pollution ambition for a toxic-free environment, developing non-toxic material cycles where banned substances should not be reintroduced on the EU market through recycling activities, and a circular economy, enshrined in the European Green Deal26 . _________________ 26 COM(2019) 640 final

Recital 6 a (new)
(6 a) 2,3,3,3-tetrafluoro-2- (heptafluoropropoxy)propanoic acid, its salts and its acyl halides (HFPO-DA), are identified as substances of very high concern in accordance with Article 57(f) of Regulation(EC) 1907/2006 (REACH) in July 2019, based on the assessment that it poses an equivalent level of concern to human health or the environment as other chemicals listed as SVHCs that are considered carcinogenic, mutagenic or toxic for reproduction, persistent, bioaccumulative and toxic, or very persistent and very bioaccumulative. Considering that scientific and technical progress are rapidly evolving, the Commission should review the possibilities for banning its use and for setting concentration limits for HFPO- DA, its salts including GenX and its acyl halides in waste and, where appropriate, adopt a legislative proposal to set such values, consistent with the values for PFOA, for which GenX is used as a replacement. The Commission should act as quickly as possible and, in any event, not later than 1 January 2024.

(6 b) Perfluorobutane sulfonic acid (PFBS) and its salts are identified as substances of very high concern in accordance with Article 57(f) of Regulation(EC) 1907/2006 (REACH) as there is scientific evidence of probable serious effects to the environment and human health which give rise to an equivalent level of concern to those of other substances listed in points (a) to (e) of Article 57 of REACH. This substance has been added by ECHA to its Candidate List of substances of very high concern (SVHCs) in January 2020. Considering that scientific and technical progress are rapidly evolving, the Commission should review the possibilities for banning its use and for setting concentration limits for PFBS and its salts in waste and, where appropriate, adopt a legislative proposal to set such values, consistent with the values for PFOS, for which PFBS is used as a replacement. The Commission should act as quickly as possible and, in any event, not later than 1 January 2024.

(6 c) The Union is seriously concerned by the continuous release of persistent organic pollutants(‘POPs’) into the environment. Therefore, further measures need to be taken in order to protect human health and the environment against those pollutants. The Commission should prepare a proposal to the Council, pursuant to Article 218(9) TFEU, for the listing in accordance with the provisions of the Convention of per- and polyfluoroalkyl substances (PFAS) which the Agency has already identified as substances of very high concern in accordance with Article 57(f) of Regulation(EC) 1907/2006 (REACH) as there is scientific evidence of probable serious effects to the environment and human health which give rise to an equivalent level of concern to those of other substances listed in points (a) to (e) of Article 57 of REACH, including HFPO-DA and PFBS.

(6 d) Considering that scientific and technical progress are rapidly evolving, especially concerning the hazardous properties of PFAS, and in order to promote the traceability of waste containing POPs and ensure control, the Commission should set up, facilitate and ensure the proper use of a database containing all processes, materials and products containing PFAS. The Commission should act as quickly as possible and, in any event, not later than 1 January 2024.
