2 a. This Directive, except for Section 2 of Title II, Chapter 1, does not apply to insurance activities within the scope of Directive 2009/103/EC of the European Parliament and the Council relating to insurance against civil liability in respect of the use of motor vehicles, and the enforcement of the obligation to insure against such liability.

(54) ‘insurance guarantee scheme’ means a scheme officially recognised by a Member State and financed through contributions from insurance andor reinsurance undertakings guaranteeing the payment of eligible insurance claims, in part or in full, to eligible policy holders, insured parties and beneficiaries or ensuring the continuation of insurance policies where an insurance undertaking is unable or likely to become unable to fulfil its obligations and commitments resulting from its insurance contracts;

Where the conditions in paragraph 1, points (a), (b) and (c) of this Directive are met, the supervisory authority shall not apply Articles 139 and 141, points (b) and (c) of Article 144(1), subparagraph 2 of Article 144(1), and paragraph 4 of Article 144, of Directive 2009/138/EC in respect of the insurance or reinsurance undertaking concerned;
