(2a) On 6 March 2023, the European Statistical Governance Advisory Board (ESGAB) published its Annual Report 2022. The report puts forward recommendations to improve the legal framework on European Statistics including by further strengthening the independence of the heads of national statistical institutes (NSI) and the Director-General of the Commission (Eurostat).

(7) Accessing and re-using new data sources, which emerge as by-products of digital services and the Internet of Things (IoT), is becoming vital for producing timely, suitably frequent and sufficiently detailed European statistics in a more efficient and less costly way. Therefore, access to new data sources in general and particularly to privately held data for the development and production of European official statistics on a sustainable basis and according to fair, clear and predictable rules should be ensured. Access to privately held data should be ensured in conformity with the principle of cost- effectiveness and not entail excessive burden on economic operators as enshrined in Article 338(2) TFEU.

(18) SIn order to keep up with the most recent academic trends and to improve the quality of statistical data and methods, statistical authorities should also promote, at both national and European level, a strong, structured and sustained interdisciplinary cooperation with academic and research institutions, especially when developing new statistics, testing new methods and technologies and promoting innovation and experimentation.

(1b) the following article is inserted: "Article 5b Selection procedure of heads of NSIs 1. Member States shall ensure that the procedure for the selection and recruitment of the heads of NSIs is in line with international best practices, and the appointment shall be made only on the basis of clear professional criteria, among which statistical reputation and a high level of competence in statistical matters are key. 2. The Head of the NSI shall be selected for a fixed, non-renewable term of up to 10 years. 3. The Head of the NSI shall have sole responsibility for deciding on processes, statistical methods, standards and procedures, and on the content and timing of statistical releases and publications for all statistics produced in the context of the ESS. When carrying out those statistical tasks, the Head of the NSI shall act in an independent manner and shall neither seek nor take instructions from their national government or any government or other institution, body, office or agency nor from any Union institutions or bodies. 4. Member States shall clearly specify the reasons for the early termination of the contract (dismissal) of the Heads of the NSI. Those reasons shall not compromise the heads of the NSI's professional or scientific independence or his or her internal management responsibilities outlined in this Regulation."

(1c) Article 6a is replaced by the following: Article 6a Director-General of the Commission (Eurostat) 1. Eurostat is the statistical authority of the Union and a Directorate-General of the Commission. It shall be headed by a Director-General. 2. The Commission shall ensure that the procedure for the recruitment of the Director-General of Eurostat is transparent and based on professional criteria. The procedure shall ensure that the principle of equal opportunities is respected, in particular with regard to gender. 3Director-General of Eurostat is selected for a fixed, non-renewable term of 7 years. 3. The selection and the recruitment process shall be open and transparent, in line with international best practices, and the appointment shall be made only on the basis of clear professional criteria, among which statistical reputation and a high level of competence in statistical matters are key. 4. The Director-General of Eurostat shall be responsible and accountable for all statistical activities and for matters regarding internal management and budget execution of Eurostat. The Director-General shall have sole responsibility for deciding on processes, statistical methods, standards and procedures, and on the content and timing of statistical releases and publications for all statistics produced by Eurostat. When carrying out those statistical tasks, the Director-General shall act in an independent manner and shall neither seek nor take instructions from the Union institutions or bodies, including other parts of the Commission, from any government or other institution, body, office or agency. 45. TReasons for the early termination of the contract (dismissal) of the Director- General of Eurostat shall be responsiblnot compromise his or her professional or scientific independence for the statistical activities of Eurostathis or her internal management responsibilities outlined in paragraph 4. 6. The Director-General of Eurostat shall appear immediately after appointment by the Commission, and annually thereafter, in the framework of the statistical dialogue before the relevant committee of the European Parliament to discuss matters pertaining to statistical governance, methodology and statistical innovation. 7. The Director-General of Eurostat shall publish an annual report. 8. The provisions outlined in paragraphs 2, 3 and 5 of this Article shall also apply to the deputy Director-General.

The Commission (Eurostat) shall publish a description of the main categories of costs related to the data processing for which compensation may be granted to the data holder and the methodology for calculating these costs taking into account the standard on cost-effectiveness and not entailing excessive burden on economic operators as enshrined in Article 338(2) TFEU.
